The Lansing Town Board met in Regular Session at the Lansing Town
Hall on January 14, 1969 at 8 P.M. Meeting called to order by Super-
visor Harris Dates,

MOTION by Mr. Kidney and seconded by Mr. Spry that the minutes of
the December 10th, 1968 meeting as submitted by the Town Clerk be
approved. Carried
Letter read from Darwin H.S. Field, Assistant Chief of the Bureau
of Planning Administration stating that the Town of Lansing application
for Urban Planning Assistance is now being reviewed by the Federal Dept.
of Housing and Urban Development.
Resume of the'Annual Meeting of the Association of Towns received
and discussed.
Letter received and read from Mary Hyde Kenneson.
RESOLUTION offered by Mr. Spry:
WHEREAS, the Lansing Recreation Commission has recommended the
appointments of the following persons to said Commission for three
year terms beginning January 1, 1969 and terminating December 31, 1971,
now therefore be it
RESOLVED that Philip E. Kirk, '060 Ni. Triphammer Rd., Ithaca, N.Y.
be appointed to succeed Robert H. Ellis, 249 Drake Rd., Sol Lansing,
N.Y. and William H. Robinson, Jr., 144 Triphammer Terrace, Ithaca, N.Y.
to succeed himself. Female nomination to be made at a later date.

Supervisor Dates informed the Board that Dryden Supervisor,
Gary Lee had requested. water service to a portion of the Town of Dryden
from Lansing Water Dist. '#1. Consulting Engineer, Thomas Miller has
studied the matter in a preliminary way and advised that water could
be made available to the Town of Dryden from the water storage reser-
voir located at the Airport. Supervisor Dates will request the Town
of Dryden to conduct a feasibility study to determine the boundaries
of the proposed water district.and to.estimate the quantity of water
which will be required both now and in the future.
Supervisor Dates offered a resolution for consideration by the
Town Board. Said proposed resolution concerned retaining the firm of
Thomas G. Miller as engineers for the Town of Lansing for the-year 1969,
to supervise personnel concerned with the operation, maintenance and
repair of the facilities of the water districts and sewer districts in
the Town and to act as- consultants on an "as needed" basis for the
Highway Superintendent, Town Board and. other boards'of the Town.
Discussion followed. James Howell, Water Supt, felt more concern
should be made in hiring extra help in maintaining the operation of
the water district rather than retaining a supervising engineer".
Councilman Kidney suggested that Mr. Howell bring plans and suggestions
to the board for comparison and consideration. No further action taken.
A Resolution authorizing the issuance of an additional $175,000
serial bonds of the Town of Lansing, Tompkins County, New York, to
pay a part of the cost of construction of improvements in and for
Lansing Water District No. 1 in said town. Said resolution attached
hereto and made a part thereof,

Discussion held by the Town Board in the Matter of the Application
of NEW YORK STATE ELECTRIC & GAS CORPORATION for Discontinuance of the
Town Highway Known as STARKS ROAD, after which time the following
resolution was offered:
RESOLUTION offered by Justice Ferris$
UPON READING AND FILING the application of New York State Electric
& Gas Corporation dated and verified the 30th day of August 1968, and
upon the Order of the Town Superintendent, Donald Sharpsteen, ordering
and directing the discontinuance of Starks Road for highway purposes
in the Town as such road is shown on the maps of town roads of the Town
of Lansing, Tompkins County, New York, and on the tax maps of the Town
of Lansing, Tompkins County, New York, now therefore be it
RESOLVED that in accordance with the provisions of Article 8 of
the Highway Law of the State of New York, this Town Board authorizes
and directs the Town Supervisor to execute a deed conveying any and
all title which the Town of Lansing may have in Starks Road and that
the Town Superintendent of Highways shall enter his order releasing
and discontinuing as a public highway Starks Road as described in the
application of New York State Electric & Gas Corporation, and. be it
further
RESOLVED that the Town Clerk be and she hereby is directed to
forthwith cause a copy of this Resolution, copy of the application
and a copy of the Order of the Town Highway Superintendent to be
recorded in her office.

James Showacre, Chairman of the Lansing Planning Board., read a
resolution which was passed unanimously by his Board on January 13,
1969. Said resolution stated that Mr. James Wood, a. member of the ,
Planning Board had not attended a regular or special meeting of the
Planning Board for the entire period of February 1968 to the present
time and the Planning Board recommended to the Town Board that it
appoint a new person to complete Mr. Wood's term. Following discussion
by the Town Board, the following resolution was offered:
RESOLUTION offered. by Mr. Spry:
WHEREAS, Mr. James Wood, member of the Lansing Planning Board
has not been able to attend meetings of said Board due to conflicts
with other commitments; and
WHEREAS, the

RESOLVED, that the Supervisor, on behalf of the Town Board,
requests Mr. Wood to resign from the Planning Board. in order that
another person engaged in farming may be appointed to complete

The term, expiring Fe�-)ruary 14, 1969, of Alex Cima, member of
the Planning Board was discussed by the Board. Supervisor Dates felt
that the vacancy should be filled by a person engaged. in building and
contracting, however, no persons in that occupation could be suggested.
MOTION by Councilman Kidney that Peter Craig, Associate Professor
of Veterinary Pathology, be appointed to fill the vacancy of Alex Cima.
No other nominations presented.

MOTION by Mr. Howell and seconded by Mr. Kidney that the Ithaca
Journal be designated as the official newspaper for the Town of Lansing.

WHEREAS, it is the intention of the Town Board of the Town of
Lansing to establish a Youth Recreation project and.
WHEREAS, the Town Board of the Townof Lansing is about to submit
an application for such project to the NYS Youth Commission for its
approval, reimbursement of funds expended on said. project as provided
by Chanter 56 of the Laws of 1945 as amended; now therefore be it
RESOLVED that such application is in all respects approved and
Harris B. Dates, Supervisor is hereby-'-directed and authorized to duly
execute and to present said application to the NYS Youth Commission for
approval.
Section 2. This resolution shall take effect immediately.

A RESOLUTION AUTHORIZING THE
ISSUANCE OF AN ADDITIONAL 5175,000
SERIAL BONDS -OF THE TOWN OF
.LANSING, TOMPKINS COUNTY, NEW
YORK, TO PAY A PART OF THE COST OF A.
I CONSTRUCTION OF IMPROVEMENTS IN,
AND FOR LANSING WATER DISTRICTI
NO.I IN SAID TOWN.
WHEREAS, Lansing Water District No. 1
has heretofore been established - in
accordance with the approving order of the
Department of Audit and Control dated June
6, 1965 and the final order of this Town Board
adopted July 12, 1965; and
WHEREAS, this Board has heretofore on
October] 19, '1965 duly adopted a bond
resolution authorizing the issuance of
s900,000'serial bonds of said Town to pay the
cost of !construction of a water, system to
serve said District, said amount being the
maximum amount proposed to be expended
pursuant to said proceedings for the
establishment of said District; and.
WHEREAS, pursuant to proceedings had
and taken in accordance with the provisions
of Section 209 -h of the Town Law, and more
particularly an. order of this Board dated
November 6, 1968, and the approving order
of the State Comptroller dated October 17,
19t8, it; has -been- determined- to-be =in the"
public interest to increase' the maximum
amount to be expended for improvements in
said District from $900,000 to $1,075,000; and
WHEREAS, it is 'now desired to provide
for. thel financing of such increase; NOW,
THEREFORE, BE IT
RESOLVED, by the Town Board of. the
Town of Lansing, Tompkins County,. New
York, a -
s follows:
SECTION 1. The specific object -or
purpose of the Town of Lansing, Tompkins
County; New York, for which the serial
bonds herein authorized are tabe issueO is to•
pay -a part of the cost of construction of a
water system to serve said District. .
SECTION 2. The maximum estimated
cost of the aforesaid object or purpose is
now determined to be $1,075,000 (an increase
of 5175;000Yand the plan for the financing
thereof, is by the issuance of 6900,000 serial
bonds of said Town heretofore authorized by
a bond ;resolution dated October 19, 1965, as'
described in the preambles hereof and by
the issuance of an additional $175,000 serial
bonds of said Town hereby authorized to be
issued pursuant to the Local Finance Law ?.
SECTION 3. The period of probable
usefulness of the aforesaid specific object or
purpose is 'forty years pursuanti to
subdivision 1 of paragraph a of Section 11.00
of the ,Local Finance Law, computed from
November 3, 1965, the date of insurance of

the first bond anticipation note issued in
anticipation of bonds to be issued for such
'•object or purpose. It is hereby determined
that the maximum maturity of the bonds
herein authorized will exceed five years.
SECTION 4. The faith and credit of said
Town of Lansing, Tompkins County, New'
York, are hereby irrevocably pledged to the
- payment of the principal of and interest on
such bonds as the same become due rand
payable:. There shall be annually
apportioned and assessed upon the several
lots and parcels of land within said Lansing
Water District No. 1, which the Town Board
shallldetermine and specify to be especially
benefited by the improvement an amount
sufficient to pay the principal and interest of
said bonds as the same become due, but if
not paid from such source, all the taxable
real property in said Town shall be subject
to the levy of ad .valorem taxes without
limitation as to rate or amount sufficient to
pay the principal of and interest on said
bondslas the same become due.
i SECTION 5. Subject to the provisions of
the Local Finance Law, the power to
authorlize. the issuance of and to sell! bond
' anticipation notes in anticipation of the
issuance and sale of the serial bonds herein
•� authorized, including renewals of such
notes, is hereby delegated to the Supervisor,
the chief fiscal officer. Such notes shall be of
such terms, form and contents, and shall be
sold inl such manner as may be prescribed
by said Supervisor,, consistent with the
provisions of the Local Finance Law. 1
SECTION 6. The validity of the bonds may
be contested only if: .
1. Such bonds are authorized for an
object or purpose for which,said Town is not
authorized to expend money, or '
2. The provisions of law which should be
complied with at the date of publication of
this resolution are not substantially
complied with,
and an action, suit or proceeding contesting
such validity is commenced within twenty
days after the of such publication, or
3. Such bonds are authorized in violation
of the provisions of the Constitution. hich takes

effect immediately, shall be published in full
_in_The.tthaca._ Journal,- .- She._official
newspaper, together with a notice of the
Town Clerk in substantially the form
provided in Section 81.00 of the Local
Finance Law.
