AUDIT RESOLUTION by Mr. Kidney and seconded by Mr. Spry: RESOLVED that General Fund bills #190 thru #209 totalling $6,955.90 and Highway Fund bills #193 thru #224 totalling $20,520.81 be and the same are hereby approved for payment. Showacre, Chairman Aug. 23, 1968 _ —J Supervisor Dates.opened the Public Hearing at 8 P.M. and requested the Town Clerk to read the Proof of Notice, after which time, Mr. Niederkorn, Planning Consultant, who assisted preparing the Technical Basis for the Subdivision Rules and Regulations for the Town of Lansing was introduced. Mr. Niederkorn enumerated the changes and alterations made in the proposal since the first Public Hearing. The most definite change in the proposed rules was the defination of Subdivision, which has been added, "except that for the purposes of these rules.and regulations any parcel which is divided so as to create two to four parcels, none of which are to hP used for commercial purposes and involve no new public improvements, shall not be considered a subdivision." Numerous other alterations were made throughout the proposed ordinance and were discussed in detail. Otto Schoenfeld stated that the ordinance should not pertain to property divided and will4tto children. He also felt that if a living person wanted to divide his property to his children that the rules should also be excluded. The Planning Board and Town Board said they would consider adding to the ordinance: "It is not the intent of this ordinance to regulate or effect the divising of land by testators ". Roger Freedbauer, a future developer, asked that the effective date of subdivision review rules, if adopted, to be ahead so that�hegotiations now pending will not be affected. He suggested the ordinance to explicitly state, "Exempt from ordinance if already entered into contract and if consummated within three months after ordinance adopted ". The following persons, Herbert Howell, William LaLonde, Raymond Kul.akosky, Gordon Selden, C.'H. Murray and Charles Howell, objected to the proposal that subdividers berequired to either give land or money for neighborhood playgrounds or parks as stated in Article V1, Section 608, Robert Gibbs stated "With interest I observe we now have arrived at zoning through the back door ". All persons desiring to be heard, having been heard, the Hearing was terminated at 9:30 P.M. ZC.`�
