Present Justice Present Justice Present Councilman Present Councilman Absent Highway Superintendent Present Chairman Assessor Present Assessor Present Attorney Present Clerk Present Visitors: Mrs. Dart, Engineer Thomas Miller, Joseph Metz, John Thompson, Robert Wickens, Donovan Davis and Reporter James Dougherty, The Supervisor opened the meeting having the clerk take the Roll Call and read the minutes of the June 8th and June 15th meetings. Minutes approved as read. A petition, map and plans was filed with the Town Board by residents of the Myers area for the establishment of a water district. A discussion followed at which time Mr. Miller, Engineer and the members of the Board discussed the proposed.water district. MOTION by Mr. Spry and seconded by Mr. Kidney: That a Public Hearing be held on July 27th, 1965 at 8 P.M. to consider said petition for Establishment of Water District #2. Said order attached hereto and made a part thereof. Vote of Town Board . (Aye) Harris B. Dates, Supervisor Vote of Town Board . (Aye) Fred Spry, Justice Vote of Town Board . (Aye) Floyd Ferris, Justice Vote of Town Board . (Aye) James Kidney Councilman Vote of Town Board . Absent Charles Howell, Councilman The motion was thereupon declared duly adopted. MOTION by Mr. Ferris and seconded by Mr. Spry: That Wiley Sutphin and Bernard Campbell be reappointed custodians from July 15, 1965 to July 14, 1966. Carried all present voted Aye. Mr. Williamson, Atty., discussed briefly the Public Hearing that was held by the State of New York Dept. of Conservation Water Resources Commission on July 7, 1965. MOTION by Mr. Kidney and seconded by Mr. Spry: That the Supervisor, Atty. Williamson and Engineer Thomas Miller make all possible efforts in appealing to the State Water Resources Commission at Albany to expedite plans to obtain temporary relief for persons in the Dart Road Area. Water for this division could be purchased temporarily from Cornell. Motion carried all present voted Aye. RESOLUTION by Mr. Kidney and seconded by Mr. Ferris: WHEREAS, Lansing Water District #1 has been approved by the State Dept. of Audit and Control, and WHEREAS, in order to finance the construction of said Water District, the obligations must be approved by Bond Attorney's, NOW THEREFORE BE IT RESOLVED, that the firm of Sykes, Golloway and Dikeman of New York City be and they hereby are retained as attorney's for the Town of Lansing relative to the issuance of bond obligations for the financing of the construction of the Lansing Water District #1. Resolution carried all present voted Aye. MOTION by Mr. Ferris and seconded by Mr. Spry: That the Supervisor be authorized to offer the Lansing Water Works Corp. the sum of $225,000.00 for the purchase of same. Motion carried all present voted Aye. 5 i MOTION by Mr. Kidney and seconded by Mr. Spry: That Order Establishing Lansing Water District #1 be adopted. Absent Charles Howell, Councilman The Motion was thereupon declared duly adopted. Mr. Williamson, Atty., discussed the Franchise Agreement between Ceracche Television Corp. and the Town of Lansing. Date for Public Hearing to be set after further consultation with Mr. Cerrache's Attorney to modify said Agreement. Mr. Tarbell, Assessor Chairman, stated that he had received a letter from the Lansing Water Works Corp. requesting no assessment for the year 1965. He said he had arrived at an assessment of $89,900.00 after using the Engineer's appraisal value of $2149000.00 and the State Equalization rate of 42 %. The New York State- Electric & Gas requested a $400,000.00 reduction on Miliken Plant and Mr. Tarbell gave them a reduction of $125,000.00. The Board felt Mr. Tarbell had made a fair and just decision of these parcels. The Supervisor presented his monthly report and explained same in detail. Filed with Town Clerk. AUDIT RESOLUTION by Mr. Kidney and seconded by Mr. Ferris: RESOLVED, that General Fund bills # 114 through #134 totalling $ 59958.61 and Highway bills #•176 through # 188 totalling $ 5,616.86 be and the same are hereby approved for payment. The Supervisor adjourned the meeting until July 271 1965 at 8 P.M. when the Public Hearing is to be held to consider said petition for Establishment of Lansing Water District #2 and any other - business that may need to be'acted upon by the Board. • . . Miller, '.;licensed ;ehgn.eier, in the State of New York, in manner, and -in, such detail, as was determined necessary by the Town Board of the Town of Lansing, having been filed with the Tbwn Clerk of the Town of Lansing and pursuant to Artcile 12 -A of the Town Law an Order having been duly adopted by the Town Board on the 6th day of April, 1965, reciting the filing of said map, plan and report, the improvements proposed, the boundaries of the proposed district, the estimated expense thereof, the proposed method of financing, the fact that the map, plan and report-.describing same, are on file in the Town Clerk's Offic for public inspection and stating all other matters required by law to be stat and -specifying April 20, 1965, 8 o'clock p.m.., in the Town Hall, Town of Lans ag the time, and the place where the said Town Board would meet'to consider map, plan and report, and to hear all persons interested in the subject thereof concerning Lansing Water District No. 1, and it having been duly resolved and determined following such.hearing on April 20, 1965, that the Notice of Hearing was published and posted as required by law and was otherwise sufficient; that all property and property owners within the proposed district would be benefitted thereby; that all the property and property owners:;benefi are'incl.uded within the limits of the proposed district, and that it is in the public interest to establish said water district; and it being further resolved that the proposed improvement including construction costs, cost of acquisition of land and easements, legal and engineering fees and all other expenses be financed by the issuance of Serial Bonds of said town to mature (I in such number of annual installments not exceeding forty as may hereafter be determined by the Town Board of the Town of Lansing; the cost of cons the improvements to be assessed by the Town Board in proportion as nearly as may be to the benefit which�-reach: lot or parcel will derive therefromiand it 9 f being further resolved that the estimated maximum cost of such project shall not excedd $900,000.00 and it having then and there been,further duly resolved that the establishment of such district as proposed be approved, and Application having thereafter, on the 20 day of April 1965 been duly made in duplicate to the State Departmenv.of Audit and Control at Albany, New York for permission to create such district as..more'fuly provided by*•�the Town Law, and the State Comptroller-having duly made an order in duplicate dated June 30, 1965, granting permission for the creation of such district in all respects as approved--by the Town Board of the Town 1. of Lansing as aforesaid; and one copy of such order having been duly filed in the office of the State Department of Audit and Control at Albany, New Y and the other in the office of the Town Clerk of this town, and the Town Clerk having duly presented such evidence to this board at this meeting being its first meeting held after the said order was filed with her, it is hereby ORDERED, that a Water District be established in the said Town of Lansing, Tompkins County, New York as described in the Order of the State Comptroller aforesaid to be designated as the Lansing Water District and to be No. 1 of the Town of Lansing, New York/, of the description and boundary set forth in Schedule "A" annexed hereto and made a part hereof.
