The Lansing Town Board met in regular session at the Lansing Town Hall on
May 11, 1965 at 8 P.M. with Supervisor Dates presiding.

The Supervisor opened the meeting having the Clerk take the roll call and
reading the minutes up -to -date.
Approved as read.
Mr. Howell stated that he would have a report-to bring before the Board
at a later date concerning the preservation of- the - Asbury Church.
The Supervisor opened the meeting for the-discussion and action to be
taken on the proposed Sewer District #1 to service-the-Triphammer Shopping
Center, the Holiday Inn and property owned by Otto Schoenfeld. The tentative
contracts, agreements etc. were read by Atty. Williamson and gone over in
detail. The contract between the Village of Cayuga Heights & the Town of
Lansing to be a four year contract, renewable each.year and shall be financed
without the expenditure of public funds. After a lengthy discussion, the
following resolution was offered.
RESOLUTION by Mr. Spry and seconded by Mr. Kidney: Approving the
Establishment of Lansing Sewer District #1, Said Resolution attached hereto
and made a part thereof.
Mr. Howell stated that he voted No to said resolution as he believed said
Sewer District #1 was not in the best interests of the people Qf this area,
Mr. Ferris stated that he voted No as he felt all persons should be included
in one district.
Mr.- Dates stated that at times a difference of opinion of the Town Board
is a healthy situation but there also.comes a time when we should all pull
together for the good of the Town.
Mr. Howell departed from the meeting.
A formal request was made to the Town Board by Mr. Arthur Shull, President
of Ithaca Associates Inc., to consider the establishment of a Sewer District
for said property, further adding that the contemplated district could
encompass the property of Karl D. Butler north of Route 13, as well as the
property of Mr. Butler and Martin Catherwood south of Route 13, if they so
desire. Said request would prefer that the District issue bonds to cover the
necessary professional and construction costs and hope that they could be
connected to the Village of Cayuga Heights disposal.system. The Board's
decision was to first, find out definitely who wants to be a part of district
and secondly, to obtain a.feasable plan from O'Brien & Gere on same.

and the hiring of a Town Operator in behalf of a private Water System located
in North Lansinge, Town Atty. Williamson explained that it was illegal for
public equipment to be used for private benefits, plus a liability problem in
the event of anyone being injured, the town would be negligent.
RESOLUTION by Mr. Spry and seconded by Mr. Kidney:
RESOLVED, that Harris Be Dates, Supr., be and he is hereby authorized to
execute the contracts between the Town of Lansing, Otto Be Schoenfeld, Triphammer
Dev, Co. Inc, and the Village of Cayuga Heights'in connection with said
Sewer District #1.

The results on Liquid Bituminous Letting held on April 30, 1965 for Tompkins
County Highway Departments were read, the successful supplier being K6ppers Co. Inc.
Results attached hereto and made a part thereof.
Clerk read two notices from State of New York Public Service Commission, Albany,
concerning Lansing Water -Works Corp. Filed same.
Clerk read letter received from Roger & Olive Wilkinson petitioning the Town
Board to remove their property from the proposed Lansing Water District.
Mr. Sharpsteen advised the Board that Cornelius Stockton had requested the
Lansing Station Extension to be extended.
Mr. Spry reported to the Board that the cemeteries in the Town were shaping up
nicely.
The bids that were received and opened on May 6th for a one ton truck and one
dump truck were gone over in detail by Highway Superintendent Sharpsteen and the
Board, 0 •
MOTION by Mr. Kidney and seconded by Mr. Spry: That the Highway Superintendent
execute for the purdhase of one dump truck and one one tone truck. The
financing of said equipment to be by the issuance of serial bonds.

Youth Program was discussed. The Park Commission has taken over the water
front activities.
Oliver Holden reported that he and Engineer Miller met with Mr. Buckley,
Supervising Principal of the :Lansing•School, concerning terms•& negioations
that can be made to have a Myers Water District. Complete report to be brought
before the board at a later date.
Supervisor presented his monthly report and explained in detail. Filed
same with Town Clerk.
AUDIT RESOLUTIOM by Mr. Kidney and seconded by Mr. Ferris:
RESOLVED, that General Fund bills #69 through #93 totalling $2,976.96,,and
Highway Bills #121 through #144 totalling $10,911.20 be and the same are
hereby approved for payment.

witbgequipment as specified, consists of the issuance of a serial bond or
bonds,of said town in the principal sum of $24,500.00 and the remaining

n the Town of Lansing, County of Tompkins, State'of New York, pursuant
to Article 12 -A of the Town Law.
WHEREAS, a map, plan and report relyting to the establishment of the
foE �.JgEpas�.811JCgas�ring sewer line
proposed:Lansing Sewer'District Noe 1 1�prepared.by O'Brian and Gere, a
competent engineering firm, in manner.and in such detail, as has been
determined by the Town Board of the.Town of Lansing, has been duly filed
with the Town Clerk of Lansing in accordance with the requirements of
Article 12 -A of the Town Law; and
WHEREAS, an Or or'was duly adopte .by the Town Board of the Town of
Lansing on the Jay of 1965; reciting the filing of said map,
and to be acquired by the Town,
plan and report, -the improvements propose /the boundaries'of the proposed
district, the* estimated expense thereof, the proposed method of financing,
the fact that the map, plan and report describing same,.are on file in
the Town Clerk's Office for public inspection, and stattinyll other matters
as required by law to be stated, ,and specifying the day of� l

town, as the place where the said Town. Board would.meet'to consider said
map, plan and report, and to hear all persons interested in the subject

RESOLVED AND DETERMINED:
A. That the notice of hearing was published and posted as required'.by
law, and is otherwise sufficient.
B. That all property and property owners within the proposed .
district are benefitted'therebyy.
C. That all the property and property owners benefitted'are included
within the limits.of the.proposed. district.
D. That it is in the public interest to establish such sewer district;
AND IT IS FURTHER RESOLVED AND DETERMINED, That the establishment of
a sewer I district as set forth*in said map, plan and report, be approved,
requested sewer lines and related facilities
that the jtMPx%iMmmn$s*herein mentioned-be acquired by the Town of Lansing
and the necessary easements and lands be acquired by said town pursuant
to contract between-the-Town of Lansing and Otto B. Schoenfeld and
Triphammer.Deveopment Co. Inc.; that such district shall be known and
designated as the "LANSING SEWER DISTRICT NO. 1 "'in the Town of Lansing,
and shall be bounded'.and described.as follows:
"ALL THAT TRACT OR PARCEL OF LAND situate in the Town of Lansing,
County of Tompkins and State.of New .York, being part of Military Lot
No. 99 in said Town and.being more particularly described as follows:
-Beginning at a point in the'Town line between the Town of Lansing
andthe Town of.Ithaca, which line is also the northerly line of the
Village of Cayuga Heights, at.its intersection with the center line of
North:Triphammer.Road; running thence easterly along said Town line, a
distance of about 2487 feet'.to a point in an easterly line of premises
described'in a deed.to.Otto B. Schoenfeld from Emily F. Cornell Stagg
dated December 11, 19439 and recorded in the TompkiksceCounty Clerk's
Office in Book of Deeds 316 at page 480; said point being the southwest
corner.of premises.now or formerly owned by Carrie Durbon; thence north
along an easterly line of said premises:conveyed ' to Schoenfeld and its
northeirly'prolongat -ion to the . center line of New York State Route 13;
thence westerly along the center line of New York State Route 13 to its
intersection with the center line of North Triphainmer'Roade thence

southerly along the.center line of said Triphammer Road to the point
of beginning. Excepting therefrom, a parcel of land described in a deed'
-to New'York State Electric and Gas Corp. from Otto Be Schoenfeld,
recorded in the Tompkins County Clerk's Office in Book of Deeds 387 at
page-54. All as shown on a petition plan of the Lansing Sewer District
No. 1 made by O'Brian and Gere, Consulting Engineers, and Land Surveyors,
Syracuse, New York,.dated'February 9, 1965, and having file No. 620,2 -03-P
AND BE IT FURTHER RESOLVED, that the proposed improvements shall
be financed without the expenditure of any.public.funds; and be it furth
RESOLVED, That the inaxiimumc� estimated cost for payment of engineering
and legal . fees is ) Z / /a / Dollars, which
sum shall be reimbursed'to the town pursuant to a contract between the
Town of Lansing, Otto Be Schoenfeld and Triphammer.Development Co. Inc.;
and be it further
RESOLVED, that facilities'-as requested by'the Town of Lansing,
are to be conveyed to. the Town ' Board of the Town of Lansing on behalf
of Lansing Sewer'.District No. 1 upon their completion for the 'sum
of One�D011ar (.$1.00); and be it further.
RESOLVED, that the'said district will discharge its sewage into
the Village of Cayuga Heights Sewer.System pursuant to.contract between
the .Mown of Lansing and the Village of Cayuga Heights; and be it further
RESOLVED, that this resolution is subject -to a permissive referendum
as provided in Section 209 -e of the Town Law.
The.adoption of the foregoing resolution was duly put to a vote
and upon roll call the Vote was as follows:
