HomeMy WebLinkAbout1965-03-17March 17, 1965 The Lansing Town Board met in an adjourned meeting as called by the Supervisor at the March 9th meeting. The meeting was held at the Lansing Town Hall and called to order at 8:45 P.M. with Supervisor Dates presiding. ROLL CALL Harris B. Bush Clerk Present Visitors: Mr. McWain & Mr. Grosso from O'Brien & Gere, Thomas G. Miller, Arthur Shull, James Dougherty, Atty. Manley Thaler, Karl Butler, John Myskow, Gord6n Selden & Mrs. Loretta Boothroyd. The Supervisor asked the Town Attorney to explain in detail to the board and visitors, the position as it now stands of the Order of the Town Board on the Lansing Sewer Dist. #1 which was adopted February 9, 1965. The Attorney explained that after the Order of February 9th had been adopted, excluding Howard Johnson's Motor Inn Complex, said order was not published after Mr. Shull, at the meeting of February 16th, decided that Howard Johnson's should be included. The Board decided at that meeting to modify order to include them. MOTION by Mr. Howell and seconded by Mr. Spry: That the Order of the Town specifying Time & Place of Public Hearing on Establishment of a Lansing Sewer Dist. #1, adopted February 9, 1965 be recinded. The Supervisor stated the meeting was now open for discussion on the Proposed Sewer Dist. #1. Mr. Shull stated at this time that Ithaca Associates Inc. are not opposed to the formation of the proposed Lansing Sewer District #1, however, the motel will submit a petition for another sewer district which will meet the requirements of the Tompkins County Health Dept. Mr. Butler inquired if the subject of a larger sewer district will eventually be discussed? Mr. Dates replied that as more persons express the desire for same it will be considered. Mr. Dates stated that the Village of Cayuga Heights have agreed to service the proposed district but they would not go on the Northeast side of Graham Road, Mr. McWain discussed proposals recommended by O'Brien & Gere for immediate solutions and effects of same on the County Sewer District, which report has been accepted and submitted to the County Sewer Agency for future decision. Mr. Butler stated that the proposals outlined by Mr. McWain were all satisfactory to him as long as the Town endeavored to negotiate with Cayuga Heights to be served by them. Mr. Selden asked the engineers to express their opinion on what the future effect to the south end of Lansing would be on two sewer districts now under discussion. It was stated by Mr. Thaler, and confirmed by the engineers, that if the County Sewer District is created there will be no problem, however, if this does not materialize, Lansing sewer districts would have to disconnect from Cayuga Heights and share . in the expense of a trunk line and sewer plant. MOTION by James Kidney and seconded by Fred Spry: That a Public Hearing be held on Establishment of Lansing Sewer Dist. #1. Said Order attached hereto and made a part thereof. FEW A letter dated March 12, 1965 was received from Karl D. Butler, Consultant for Lansing Water Works Corporation, stating that the Corporation was interested in negotiating with the Town for sale of the entire Lansing Water-Works Corporation and indicating they are prepared to submit a sale price. Mr. Dates replied by letter dated March 17, 1965, proposing that an offer be submitted to the Town Board for consideration on or before March 24th. The meeting was adjourned until April 6th, the date for the Public Hearing and to take up any other business that may need to be acted upon by the Board. Meeting adjourned at 10:00 P.M. ORDER OF TOWN BOARD SPECI- FYING TIME AND PLACE OF PUBLpC HEARING ON ESTAB. LISHMENT OF LANSING SEWER' DISTRICT NO. 1. At a meeting of the Town Board of the Town of Lansing, held at the Town Hall in the Town of Lansing, Oounty of Tompkins, State of. New York, on the 17th day of March, 1965, at 8 p.m. Present: Harris B. Dates, Supervisor Charles Howell, Councilman James Kidney, Councilman Fred Spry, Justice of the Peace In the Matter of the Establishment of Lansing Sewer District No. 1 In the Town of Lansing, County of Tomp- kins, -State of New York, pursuant to Article 12 -A of the Town Law, for the purpose of acquiring sewer lines and related facilities ' as generally shown on the map, plans and report on file with the Town Clerk; WHEREAS, a map, plans and report have been prepared in such manner and in such detail as has heretofore been determined by the Town Board of the Town of Lansing, relating to the establishment of a sewer district for the purpose of acquiring sewer lines and related facilities as generally shown on said map and plans in the southern area of said town, and WHEREAS, said map, plans and report have been duly filled In the Town Clerk's Office, and WHEREAS, said map, plans and report were prepared by O'Brien and Gere, a competent engineering firm, showing the boundaries of the pro- posed district and a general plan of, the sewer system, and a report of the Proposed method of operation, and WHEREAS, said map shows the lo- cation and general description of all the work required, and WHEREAS, the sewers to be con Mructed- will be approximately 1,100'. Unear feet, 8 inch diameter sanitary i sewers and appurtenances which will provide service to three commercial; buildings and will serve as an outfall for a large vacant parcel to the east' of said buildings, and WHEREAS, the boundaries of , the, proposed district are as follows: ALL, THAT TRACT, OR PARCEL OF LAND situate in the Town of Lansing, County; of Tompkins, and State of New York„ being part of Military Lot No. 99 in said Town and being more particularly described_as_ follows.: i�BEGINNING at- a point In the Town Line between the Town of Lansing and the Town of Ithaca, which line is also the northerly line of the Village of Cayuga Heights, at its intersection with the center line of North Trip= hammer Road; running thence easterly along said Town Line, a distance of about 2,487 feet to a point in an east- erly line of premises described - in a deed to Otto B.. Schoenfeld from Emily F. Cornell Stagg dated December 11, 1948, and recorded in the Tompkins County Clerk's Office in _Book of Deeds 316 at page 480; said point being the southwesterly corner of premises now or formerly owned by Carrie Durbon, thence northerly ,along' an easterly line of said premises con- veyed to Schoenfeld and its northerly t prolongation to the center line of New York State Route 13; thence westerly along the center line of New York State Route 13 to its intersection with the center line of North Triphammer Road; thence southerly along the cen -.. ter line of said Triphammer Road 'to the point of begining. All as shown on a petition Plan of the Lansing Sewer District No. 1 made by O'Brien and Gere, Consulting Engineers and, Land Sur- veyors, Syracuse, New York, dated February 9, 1965, and having File No. WHEREAS, the district is being established to acquire. the sewer lines and related facilities in said proposed district as indicated on said map; and WHEREAS, the maximum estimated cost fer payment of engineering and legal - fees is 55,000.00, which sum shall be reimbursed to the town pur- suant to a contract to be executed between the Town of Lansing and, Otto B. Schoenfeld and Triphammer Development Co. Inc.; and WHEREAS, the facilities will be built without the expenditures of any other nublic funds; and WHEREAS, the sewer lines and other related facilities are to be conveyed to the Town Board of the Town of Lansing on behalf of Lansing District No. 1- upon completion for the sum of ONE DOLLAR ($1.00); and WHEREAS, said map, plans and report describing said improvement are on file in the said Town Clerk's Office for public inspection; and WHEREAS, the Village of Cayuga Heights has indicated its willingness to accept the discharge of sewage from Lansing Sewer District No. 1 for conveyance, treatment and dis- posal on a temporary basis in ac- cordance with the terms of a contract to be executed between the Village of Cayuga Heights and the Town of Lansing; and WHEREAS, formation of the sewer district Is contingent upon the execu- tion of the contracts aforementioned; NOW ON MOTION of James Kidney, seconded by Fred Spry, it is hereby ORDERED, that the Town Board . of the Town of Lansing shall meet and hold a public hearing at the Town Hall in the Town of Lansing, New York, on the 8th day of .April, 1965, at 8 o'clock of said day to consider said map, plans and report, and to hear all persons interested in the sub- ject thereof concerning the same and to take such action thereon as Is re- quired or authorized by law.
