HomeMy WebLinkAbout1965-01-18I January 18, 1965 .The Lansing Town Board met in an adjourned meeting as called by the Supervisor at the adjournment of the January 12th meeting. The meeting was held at the Lansing Town Hall at 8 P.M. with Supervisor Dates presiding. ROLL CALL Harris Dates Supervisor Present James Kidney Councilman Present Charles Howell Councilman Present Floyd Ferris Justice Present Fred Spry Justice Absent Robert Williamson Town Attorney Present Jane C. Bush Clerk Present Visitors: John Moravec, Robert Gibbs, Ernest Idilkinson, Atty. LoPinto, Edwin Filmer, Karl Butler, Robert Scanlon and Thomas Puller. The Supervisor opened the meeting with the Roll Call,and with the approval of the Board, dispensed with the reading of the minutes. The Town Board inquired of Mr. Butler, who has just recently been involved with the management of the Lansing Water Works.-if he could submit a definite figure for the entire purchase of the Lansing Water Works including surveys, maps etc., for the Board to study. Mr. Butler stated that a relative figure would be $450,000.00, however', by February 10th or before, he would be in a position to give a positive figure. After much debate the following resolution was made: RESOLUTION by Mr. Kidney and seconded by Mr. Ferris: RESOLVED, that the town hereby authorize Thomas G. Miller, pursuant to the contract between said Miller and the Town of Lansing dated December 15, 1964, to prepare plans and cost estimates for the development of an alternate water supply from Bolton Point for.Lansing Water District No. 1, said authority to include the cost of test borings on said point; and be it further RESOLVED, that the engineer, pursuant to said contract, make an engineering appraisal of the Lansing Water Works Corporation system. Vote of Town Board . . . . (Aye) Harris B. Dates, Supervisor Vote of Town Board . . . . (Aye) James Kidney, Councilman Vote of Token Board . . . . (Aye) Floyd Ferris, Justice Vote of Town Board . . . . (No) Charles Howell, Councilman Mr. Howell stated that he voted "No" on the above resolution, pending further information on the Lansing Water Works. Carried Letter received from William H. Long, Jr., stating that he owns property on the west side of Route 34 which the Town may want to consider as an alternate source for water. Mr. Long most sincerely wants to go on record as wanting the water privileges extended to all. RESOLUTION by Mr. Howell and seconded by Mr. Kidney: RESOLVED, that the supervisor and the town attorney consult with the Local Board of Education officials and Albany officials, if necessary;" to determine on what basis water from the school district supply can be� made available to residents of Myers. Carried all present voted Aye. Robert Gibbs extended to the Town Board, his personal appreciation for the work done on the cemetery that is located behind the Frank Naegely residence on Burdick Hill Road. i, Ernest Wilkinson asked why the Town DdV Ikzy wanted to get in the water business for? Mr. Dates replied that ninety -four persons had petitioned the Board to establish a Water District, Mr. Butler,suggested that perhaps thea.�. Town might be interested in purchasing delivery bit Burdick Hill Road and Route 34 or at Triphammer Road, if they do not find it feasable to purchase the entire Water Works. At a meeting of the Town Board of the Town of Lansing, held at the Town Hall in the Town of Lansing, County of Tompkins_,.,_State of New York, on the 9th day of February, 1965, at 8 p.m. . Present: Harris B, Dates, Supervisor Charles Howell, Councilman James Kidney, Councilman Floyd Farris, Justice of the Peace Fred'Spry, Justice of the Peace. In the Matter of the Establishment of Lansing Sewer District No. 1. in the Town of Lansing, County of Tompkins, State of.New York, pursuant to Article 12 -A of the Town Law, for the purpose of acquiring sewer lines and related facilities. as generally shown on the map, plans and report on file with the Town Clerk; h 4 WHEREAS, a map, plans and report have been prepared in such manner and in such detail as has heretofore been determined -by the Town Board of the Town of Lansing, relating to the establishment of a sewer district for the purpose of acquiring sewer lines'and related facilities as generally shown on said map and plans in the southern area'of said town, and WHEREAS, said map, plans and report have been. duly filed in the Town Clerk's Office, and WHEREAS, said map, plans and report were prepared by O'Brien and Gere, a competent engineering firm, showing the boundaries of the proposed distri and a general plan of the sewer system, and a report of the proposed method of operation; and WHEREAS, said map shows the location and general.description of all the work required, and WHEREAS, the sewers to be' constructed will be approximately 1100 linear feet, 8 inch diameter sanitary sewers and apprutenances which will provide service to three commercial buildings and will serve as an outfall . -1- i for a large "vacant, parcel to the east of said buildings, and WHEREAS, the boundaries of the proposed district are as follows: ALL THAT TRACT OR PARCEL OF LAND situate in the Town of Lansing, County of Tompkins, and State of New'York, being part of Military Lot No. 99 in said Town and being more particularly described as follows: BEGINNING at a point in the Town line between the Town of Lansing and the Town of Ithaca, which line is also the northerly line of the Village of Cayuga Heights, at its intersection with the center line of North Triphammer Road; running thence easterly along said Town line, a distance of :about 2487 feet to a point in an easterly line of premises described in a deed to Otto B. Schoenfeld from Emily F. Cornell Stagg dated December ll, 19489 and recorde in the Tompkins County Clerk's Office in Book of Deeds 316 at page 480; said point being the southwesterly corner of premises now or formerly owned by Carrie Durbon, thence northerly along an easterly line of said premises conveyed to Schoenfeld and its northerly prolongation to the center line of New�York State Route 13; thence westerly along the center line of New York State Route 13 to its intersection with the center line of North Triphammer Road; thence southerly along the center line of said Triphammer Road to the point of beginning. Excepting therefrom, a parcel of land described in a deed'to New York State Electric and Gas Corp. from Otto B. Schoenfeld, recorded in the Tompkins County Clerk's Office in Book of Deeds 387 at page 540 All as shown on a petition plan of the Lansing Sewer District No. 1 made by O'Brien,,and Gere, Consulting Engineers and Land Surveyors, Sypacuse, New York, dated February 9.9 1965, and having File No. 620.2 -03 -P; and WHEREAS, the district is being established to acquire the sewer lines related facilities in said proposed district as indicated on said map, and WHEREAS, the maximum estimated cost for payment of engineering and legal fees'is $5,000.00, which sum shall be 'reimbursed to the town pursuant to a contract to be executed between the Town of Lansing and Otto B. Schoenfeld and Triphammer'Development Co. Inc.; and WHEREAS, the facilities will be built without the expenditures of any other public funds; and -2- WHEREAS, the sewer lines and .other related facilities are to be conv to the Town Boad of the. Town of Lansing on behalf of Lansing District No. 1 upon completion for the sum of ONE DOLLAR ($1.00); and WHEREAS, said map, plans and report describing said improvement are on file in the said Town.Clerk's Office for public inspection; and WHEREAS, the Village of Cayuga.Heights has indicated its willingness to accept the discharge of sewage from Lansing Sewer District No. 1 for conveyance, treatment and disposal-on a temporary basis in accordance with the terms of a contract to be executed between the,Village of Cayuga Heights and the Town of Lansing; and WHEREAS, formation of the sewer district is contingent upon the executii of the contracts aforementioned; NOW ON MOTION OF James Kidney ,seconded by Fred Spry it is hereby ORDERED, that -the Town Board of the Town of Lansing shall meet'and hold a public hearing at the Town Hall in the Town of'Lansing, New York on the 2nd day of March, 1965, at 8 o'clock of said day to consider said map, plans and report, and to hear all persons interested in the subject thereof concerning the same and to take such action thereon as is required or authorized by law.
