The Lansing Town Board met in regular session at South Lansing Town Hall 8:00 P. M.

The Supervisor introduced the visitors:
From Summitt aidge Association., Gloria J. Zirbel, Josephine Walpole, Elaine Jolly,
Donald Jolly, Ava Vormwald, and Mr. Edwin r•ilmer.
The Supervisor asked the visitors from Summitt Ridge Assoc. what theit problem
was,
.Mrs Walpole stated their reason for attending the meeting was to learn if
it was possible to have Stark road extension built and maintained as a Town road
or if not as a Town road maintained bjr the Town.
Discussion:
The Jupervisor reqd the minutes regarding th time when Mr. Willis and Mr. Potter
came to the Board regarding the same problem soon after they had bought this Lake
frontage , also explaining meeting with them at the sight with the Hy. Silperintendent
and•finding that this road would involve a number of culverts which would make the cost
high . He also explained the policy of the Town on roads into new development areas
was that the developer build the road to the specifications of the highway Supt. and
at its completion deeded to the Town and from then on the Town would maintain it.
The Association asked about what the Hy. Supt. wouod.say the cost would be , this
was discussed and advised that a contractor bw consulted for an estimate .
Supervisor advised that at this time and until policy was changed nothing
could be done at this time as the Town could not maintain any privat� roads.
They thanked the Board for their time and also Mr. Tarbell explained ,how the assessment
'was figured on cottages being on private roads and that there would be some change
if on a public Town road.
The Supervisor advised the Board that Mr. Talandis had not finished forming
the Sewer District Corp. which had been presented to the Board in 1960 and again in
1962. The Supervisro stated this for information only .
He read a letter from Dr. Broad of Tompkins Co. Health dept. to Mr. Shull
advisein him that he could not operate a resturant unless approved sewer and water
were available . Letter filed.
He also read a letter from the Cayuga Heightes Village Board in regard to a change
in sewer service , and they would now be able to furnish sewer disposal service to
the Southern Section of the Town of Lansing.
Letter filed.
The question of what to pay the voting machine custodians due to the extra time
for Primary they felt that they should be paid more due to this.
Discussion:
Motion by Mr.. Ferris seconded by Mr. Spry.
That the voting machine custodians be paid at the rate of $75.00 each for 1963 and
that the Supervisor be authorized to make a transfer from extended balances the sum
of $50.00 to balance custodian account .
carried all voted Aye.

Councilman Howell advised the Board he had contacted Mr. E. La Vigne regarding
the cost to the Town for the drawings and plans for the Beach House at the Park
Myers which were drawn by him Mr. Howell said that Mr. La Vigne would present a
bill for $600.
discussion:
The Board were all of the same opinion that this figure of $600. was an excessive
amt. due to the fact that the bid had not been let and his fee as per the minutes
was to be subject to the awarding of the contract and the superviseing after the
commenceing the construction .
After -some discussion the Board were in agreement that the Supervisor dhould contact
him and offer to settle with him for this work in the amount of $300.00 ,
Motion by Mr. Howell seconded by Mr. Spry:
That the Supervisor be authorized to settle:with Mr. E. La Vigne for plans and Specifications
on the Beach House at Myers Park , in the amount of $300.00 .
Carried all voted Aye.

The Supervisor presented his monthly report explaining same in detail and fileing
same with the Clerk.
The Highway Ouperintendent brought the Board up to date on the condition of the
highway equipment especially the grader which neede to be replaced as the maintainence
was very heavy Some trucks would need to be repllced within a short time .
This was discussed and Highway Supt. requested to get prices on graders and other
equipment to be replaced this would enable the Board to discuss what to replace during
1964•.

That the bills numbered from 146 thru 192 listed in the record of Town accounts be paid
as audited

WHEREAS: The Tompkins County Doard of I:ealth�in connection with its
responsibility for the public health in Tompkins County, desires to
promote and assist in the orderly development of real estate and
building in Tompkins County and to maintain a healthy environment in
its development, and
WHEREAS: In June of 1960 the AMBO Corporation desired to construct
a group of apartment buildings on the Triphammer Road in the Town of
Lansing just to the North of the boundary of the Village o.L Cayuga
Heights, but had been unable to secure extension of se%ters by the
Village and
'4IIIEREAS: Not desiring to obstruct develop►�ent, it did :ollowing a
weeting of its Executive Committee with official representatives of
the Towns or Lansing and Ithaca and the Village of Cayuga THeights
approve, the construction and operation of a se..vage disposal plant,
there being, at the tine, no other solution to the disposal of the
sev-age frow such buildings and
WHIM EAS: After submission of various plans and described and defined
minum buffer zones, the plant and its appurtenances were approved by
the New York State Department of health to serve the buildings owned
by the AMMO Corporation, kno::n as the Lansing Apart ►cents, up to the
• capacity of the plant - 20,000 gallons per day, and
WHEREAS: On July 23, 1962 the Town of Lansing, acting upon the re-
quest of Manley Thaler, representing the Triphammer Shopping Center,
did establish a Sewer District designated and kno►:n as the Lansing'
Sewerage Corporation Seurage District, recorded with the County Clerk
of the County of Tompkins on August 13, 1962, this sei✓er district
fundamentally including the Lansing Apartments and the Triphammer
• Shopping Center, but its operation being contingent upon it being
incorporated under Chapter 60 of the Transportation Corporation Lai,;
of the State of !dew York and
� WHEREAS. The Tompkins County Health Department did in good faith;
the being no other solution to the disposal of se: ✓age, allovj'the
Shopping Center to run its sewer lines to the Lansing Apartment
sewage disposal plant, anticipating the necessary formation of the
Corporation under the Laiti, and

WHEREAS-: it now appears that the Corporation has not been formed
within the time limit established under the law and the AMBO Cor-
poration, asrepresented by Mr. Jerry Talandis, has not completed
the pre.s.ent- system nor presented plans for the necessary enlarge-
ment of his plant so as to adequately handle the sewage from the
Shopping Center and the additional 48 apartment units constructed
by him in 1963, and
WHEREAS: there now legally exists no Sewer District known as the
Lansing Sewerage Corporation Sewage District to serve the Trip-
hammer Shopping Center and
WHEREAS* The Ithaca Associates, represented by Mr. S. Arthur
Shull, is presently constructing a restaurant and a m©tel.of 75
units (potential 150 persons ) frith no approved means of disposal
of sewage, and that he has been informed by a letter addressed to
him from the Commissioner of Health of Tompkins County, Robert H.
Broad,M.D., dated Oct. 23, 1963, that the Tompkins County Health
Department cannot permit the operation of the restaurant and motel
until there is provided an adequate, potable water supply and a
satisfactory, legal means of disposal of sewage, and
WHEREAS0 At an adjourned meeting of the Tompkins County Board of
Health. on September 18, 1963, to which were invited and were in
attendance members of the Lansing Town Board, the Village Board
of Cayuga Heights and Mr. Jerry Talandis, the various aspects of
supplying sewerage service to the area were thoroughly discussed.
At this meeting, Mayor Marcham indicated the possibility of the
Village of Cayuga Heights accepting sewage from approximately
1,000 people in the southern part of the Town of Lansing. This
potential offer was confirmed in writing to Mr. Barris Dates,. by
Mayor Marcham. This would of course, necessitate the Tom of Lan-
sing, upon the advice of their engineer,to establish a sewer dis-
trict and define its metes and bounds and
WHEREAS: The operation of the sewage plant serving the Lansing
Apartments has not been satisfactory, has not discharged an eff-
luent compatible with the potential efficiency of the plant, and
the grounds around the plant have not been maintained in a manner
compatible with the maintenance of the surrounding area; and the

wet weather stream into which._ the -- eff.luent..._a s _.dis.charged has not
been 1:ept free of obstruction, and the sand f llters which were to
serve as final treatment before discharge have not as yet been con-
structed. Thus, the example so far demonstrated in the operation of
this small plant has not been of sufficiently high quality, espec-
Lally this summer, when operating at capacity, to warrant approval
on the part of the Board of Health to enlarge the plant and handle
the sewerage of the surrounding area, now
THEREFORE BE IT RESOLVED: that it is the responsibility and the
intent of the Tompkins County Board of Health to insure, to the
greatest possible extent, a satisfactory nuisance free method of
sewage disposal for the southern part of the Town of Lansing, and
in the interest of the public health and based upon information
presently available to the Board, it cannot at this time approve
the expansion of the Lansing Apartment sewerage disposal plant, and
BE IT FURTHER RESOLVED: that the Town of Lansing be requested to
immediately take the necessary steps to provide other legally con-
stituted means (sewer district ) to provide adequate sewage dls-
posal factl,ities for the Shopping Center, Motel and Restaurant,
and other portions of the Town which it anticipates will be devel-
oping in the near futures and
BE IT FURTHER RESOLVED: that
1. Neither the Motel nor the Restaurant, now being constructed
by Ithaca Associates shall be placed in operation until
provided with an adequate, potable water supply and a
satisfactory, legal means of sewage disposal.

2. The Triphammer Shopping Center be allowed to continue to
discharge its sewage via the Lansing Apartment Sewage
Disposal Plant until a satisfactory legal means of sewage
disposal is provided, but not After July 1, 1964. No
commercial laundty wastes shall be d1scharged until this
satisfactory legal means is attained.
