Totman - Vice - Chairman* Z . Kane - Secretary* Be Bucko - Town Attorney* F . Scheffler* R . Gleason* J . Bell * William Lockwood * # - Denotes those present . D . Payne : Has everyone read the minutes ? G . Totman : I make a motion that the minutes be approved , as written . Z . Kane : I second the motion . ( Motion carried . ) D . Payne : The purpose of our meeting tonight is to discuss the minor subdivision proposed by Mr . Lockwood . Mr . Lockwood has had the land - - the total plat - - sur - veyed of which we have five copies here . ( Mr . Payne passed the copies out to the Planning Board members and Mr . Bucko to look at . ) I5r . Lockwood : I gave him a little more on this one lot so the line would be straight . I wasn ' t thinking when I did it . D . Payne : It cuts it off from you , right ? Z . Kane : It shouldn ' t bother anything , should it ? Be Bucko : Not as far as a minor subdivision is concerned . D . Payne : The Tompkins County Board of Health forwarded a letter to me stating that they can no longer issue permits on sand filters without State approval . They did say they have given preliminary approval on this particular land now in the process of being sold : The one for Lee and Charlotte Kelley . And they don ' t expect any problems from the State Health Department for final approval . Mr . Lockwood has filled out his application - - Be Bucko : Has he paid the fee ? D . Payne : No , he hasn ' t yet . - 1 - Z . Kane : He came here with the understanding that he had that approval . Some discussion was held on this by B . BUbko , D . Payne , Z . Kane , W . Lockwood and others . D . Payne : Now , let ' s set something else here straight , too . Mr . Lockwood mentioned before if he wanted to go and sell 10 acres of land and you said he couldn ' t do it , - - but once this is approved he can sell two more lots , - - am I correct ? Be Bucko : No . When he files this he is saying these are lots to be in the subdivision . If he wanted to sell this whole piece right here he wouldn ' t have to come in for an amendment but if he sold this lot over here he would have to come in for an amendment because that would then , or could , create a land lot situation or road . Some discussion was held on this by Z . Kane , Be Bucko , W . Lockwood and others . G . Totman : Let ' s set the public hearing date . D . Payne : 0 . K . Be Bucko : When do they want to get in , - - the Kelleys ? W . Lockwood : In the spring . Be Bucko : What I ' m trying to say is today ' s the 16th , if they publish the notice for the hearing , - - say they publish it on the 30th and have the hearing on the 6th of February . W . Lockwood ,* It will take two or three weeks to get that . Be Bucko : We can get the notice drawn upm ready to submit the 28th - 12 days from now - - to be published on the 30th with the hearing on the 6th and 45 days from that takes you until around the 20th March . D . Payne : They told me they weren ' t interested in building for a few years . Be Bucko : They told Hicks Dow around New Year ' s they didn ' t know when they were going to build . W . Lockwood : They can put a trailer there though , can ' t they ? Z . Kane : After this is approved - it can be anything . W . Lockwood : Say I want to put a house on my own lot , - - do I just need a building permit ? Z . Kane : Yes , - - that ' s all . Be Bucko : You would have to locate the house so the trailer will have a lot by itself . - 4 - D . Payne : What Ben means is make sure you locate the house so each one has the required lot . Some discussion was held on this by G . Totman , Z . Kane , W . Lockwood and others . G . Totman : Then we are setting the date for the hearing on February 6th at 8 P . M . here ? D . Payne : Zana , - - you write the necessary letters but check with me beforehand so I ' ll be sure we have the State approval . Be Bucko : Who is going to draw the notice up ? D . Payne : I will . Z . Kane : You call me when you get the approval , Don and then I ' ll get the lettdrs � off , - - right ? Mr . Gleason suggested the notice be put in the paper by January 25th in order to be sure it was published in time . D . Payne : Can we go ahead with the public hearing without the State approval if we give conditional approving pending acceptance by the State ? Be Bucko : Let me put it this way , - - this subdivision can be approved with the sand filters . The only problem that would come up is whether or not 5 . 47 acres is big enough for the State of New York ^ to accept for sand filters . You can approve the subdivision with the requirement that sand filters are in there but the Kelleys can ' t construct until they get the approval . Z . Kane : 0 . K . I can go ahead and write these people . When would be a good time to write to these people ? D . Payne : The last week in January because it won ' t be until the 6th of February . G . Totman : Don ' t you think in the meantime if you are going to meet with Mr . Lockwood , Ben , and change this line right here over to right here , that this should be done before the public hearing so we can check the map and see it is right before we hold the hearing ? Be Bucko : Right , - -we can meet this week . I ' ll talk to the Woods ' s and all they are concerned about is their trailer and the stream and as long as they get their trailer here and get their 400 ft . that is all they care about . W . Lockwood : I ' m not that hard to get along with . Be Bucko : And then we ' ll submit new maps before the hearing . D . Payne : You ' ll take care of that ? - 5 - Be Bucko : Right . G . Totman : 0 . K . That ' s it then . D . Payne : And you make sure Mr . Kelley drops off the check . W . Lockwood : 0 . K . - - thanks - - good night . D . Payne : As of this date� we haven ' t heard anything from Mr . Holecek concerning his minor subdivision or -Z . Kane : You ' ll never hear from him . D . Payne : Or from Mr . Barber concerning his proposed major subdivision . Mr . Barber does have two trailers on lots up where he wants his subdivision and there has not been a permit issued for the second one . G . Totman : The one issued for the first one - - the trailer is not where the permit calls for it to be . Some discussion was held on this by Be Bucko , G . Totman , D . Payne and others . D . Payne : Would someone make a motion that this meeting be adjourned ? Z . Kane : I make a motion that the meeting be adjourned . F . Scheffler : I second the motion . ( Motion carried . ) Re pectfully submitted , Jos phine Bell it January 17 , 1974 - - Don Payne telephoned me this date and said to note at the bottom of these Minutes that he had received the $ 20 . 00 fee from Mr .
