REGULAR MEETING The Regular Meeting of the Town of Groton Planning Board was called to order by Chairman Ed Neuhauser at 7:30 p.m. APPROVAL OF MINUTES - 17 SEPTEMBER 2015 A motion was made by Member Barbara Clark to approve the Minutes of the 17 September 2015 Planning Board meeting, as submitted. The motion was seconded by Member Lisa Maloney Hahn, with the vote recorded as follows: Ayes: Chairman Neuhauser Nays: None Member Clark Member Baxendell Absent: Member Carey Member Maloney Hahn Member Morey Member Wyllie Motion carried. This becomes Action #62 of 2015. OLD BUSINESS - NONE NEW BUSINESS Jon & Gail Finton, Applicants/Reputed Owners - Lick Street - TM #s 16.-1-18.162. 163 164 - Boundary Line Change Chair Neuhauser recognized the applicants who were seeking approval to combine the subject tax map parcels into one lot, as shown on the attachment to the application. Page 1 of 4 (T)Groton Planning Board Minutes of Regular Meeting 19 November 2015 A motion was then made by Member Maloney Hahn that the Town of Groton Planning Board declares itself Lead Agency under SEQRA for the proposed Boundary Line Change. The motion was seconded by Member Bret Wyllie, with the vote recorded as follows: Ayes: Chairman Neuhauser Nays: None Member Clark Member Baxendell Absent: Member Carey Member Maloney Hahn Member Morey Member Wyllie Motion carried. This becomes Action #63 of 2015. Chair Neuhauser then read aloud Part II of the Short Environmental Assessment Form. Negative responses were obtained to all questions in Part II. A motion was then made by Member Mark Baxendell that, based on the information and analysis of the SEQR concerning this application, the Town of Groton Planning Board has determined that the proposed action will not result in any significant adverse environmental impact, resulting in a Negative Declaration. The motion was seconded by Member Wyllie, with the vote recorded as follows: Ayes: Chairman Neuhauser Nays: None Member Clark Member Baxendell Absent: Member Carey Member Maloney Hahn Member Morey Member Wyllie Motion carried. This becomes Action #64 of 2015. With no further discussion, a motion was then made by Member Clark to approve the Boundary Line Change as requested. The motion was seconded by Member Maloney Hahn, with the vote recorded as follows: Ayes: Chairman Neuhauser Nays: None Member Clark Member Baxendell Absent: Member Carey Member Maloney Hahn Member Morey Member Wyllie Motion carried. This becomes Action #65 of 2015. Robert Walpole, Applicant/Merle Ploss Estate, Reputed Owner - Peruville lis Old Peruville Road - TM #s 36.-1-11. 21.2 & 67.2 - Minor Subdivision Chair Neuhauser recognized the applicant who was seeking approval for a four-lot subdivision as shown on the map accompanying the application. Mr. Walpole said this was the same subdivision he presented to the Board in August, but there has now been an adjustment in acreage of the lots. Chair Neuhauser stated there was a question "about this little piece," (Parcel A). Tax maps show that this piece belongs to another parcel. Mr. Walpole commented that this would have to be straightened out after the subdivision is approved and transferred to the heirs. Chairman Neuhauser stated that the map needs to be revised to resolve the matter before it can be approved; the Board cannot use the map as presented. Chair Neuhauser stated he had consulted with Town Attorney Dan Ellis who advised that the map needed to be revised. The applicant commented that the attorney was not here to clarify the matter, and he could have at least contacted him or sent him an email regarding the confusion. Page 2 of 4 (T)Groton Planning Board Minutes of Regular Meeting 19 November 2015 After considerable discussion, a motion was made by Member Baxendell to postpone consideration of this Minor Subdivision until the 21 January 2016 meeting of the Town Planning Board to allow time for the applicant to provide the requested revised map. The motion was seconded by Member Clark, with the vote recorded as follows: Ayes: Chairman Neuhauser Nays: None Member Clark Member Baxendell Absent: Member Carey Member Maloney Hahn Member Morey Member Wyllie Motion carried. This becomes Action #66 of 2015. Christopher Dempsey, Applicant/Reputed Owner - 125 Sears Road - TM #s 16.-1-11.21 lis 16.-1- 15.1 - Minor Subdivision lis Boundary Line Changes Chair Neuhauser recognized the applicant who was seeking approval for a four-lot subdivision and two Boundary Line Changes, as shown on the maps accompanying the application. Mr. Dempsey explained that he wanted to make his one-acre piece into a five-acre piece by a Boundary Line Change. They also want to create a separate lot for his wife's parents, and sell the rest of the property. A motion was then made by Member Baxendell that the Town of Groton Planning Board declares itself Lead Agency under SEQRA for the proposed Minor Subdivision and two Boundary Line Changes. The motion was seconded by Member Maloney Hahn, with the vote recorded as follows: Ayes: Chairman Neuhauser Nays: None Member Clark Member Baxendell Absent: Member Carey Member Maloney Hahn Member Morey Member Wyllie Motion carried. The motion was seconded by Member Clark, with the vote recorded as follows: Ayes: Chairman Neuhauser Nays: None Member Clark Member Baxendell Absent: Member Carey Member Maloney Hahn Member Morey Member Wyllie Motion carried. This becomes Action #69 of 2015. OTHER BUSINESS • Chairman Neuhauser introduced Rick Fritz, the new Town Code Enforcement Officer, who advised the Board that he plans on working five mornings per week, and that he can be contacted at 591-9898. ADJOURNMENT At 7:55 p.m., a motion was made by Member Clark to adjourn the meeting. The motion was seconded by Member Baxendell, with all members present voting in favor. J E.
