MEMBERS OF PLANNING BOARD OTHERS : D . Payne - Chairman* Erma Lyons* G . Totman - Vice- Chairman* Evan Webster* Z . Kane - Secretary* Josephine Bell* F . Scheffler* D . Chase* R . Gleason R . Cotanch * - Denotes those present . D . Payne : This meeting is called to consider preliminary approval for a minor subdivision submitted by Mrs . Lyons , G . Totman : Don , do you have all the paper work that is required ? D . Payne : Yes , five copies of the map showing the subdivision . On her original application she showed a single house in the process of building right now and also on the back and on a separate sheet . The other one - - haven ' t decided the location of the house on that lot as yet . E . Lyons : I have no idea of the size of the house or anything , or when I will build it . G . Totman : As I understand it - - I think to clarify our point a little bit , - you are 11 . 4 ft . short of the requirements if we are to stay in line with the zoning ordinance and in passing this will be passing something not according to - hoyle so to speak , so one of the reasons we want to make sure it is understood we don ' t want to set a precedent . Want to make sure we have something to hang our hat on as to why we are approving something that hasn ' t the required frontage . In the ordinance it does say we can come in a few feet from the requirement if there is no problem with the sewage , and the main thing we are concerned with is if the sewage is being taken care of and approved by the County Health Department . This would give us something we can hang our hats on . E . Lyons : I think any misunderstanding of this was - - 30 , 000 square ft . , - - there is way more than that so this is where I evidently got lost . D . Payne : This is one of the things we took into consideration when we de - cided not to question the shortage in frontage as long as the depth was there and there is no problem with the sewage . G . Totman : We want growth but if we have an ordinance and bypass it can ' t say no to somebody else so if you make an exception to the rule then you want to have a reason why . - 1 - a . Z . Kane : The way this is , it will be easy enough to say to somebody else look at the depth , - - it will be easy enough to explain as far as that is concerned . D . Payne : Mrs . Lyons has submitted all the information required so far as I can see . Z . Kane : How about the water supply . Is that also adequately provided for ? E . Lyons : It will be to the front of the house . Z . Kane : Yes , '- - O . K . E . Lyons : This has to be , - - the County Board of Health will be on your back if not put in according to their specifications . Z . Kane : This is what we have to make sure of , - - that you have checked with them and have done it their way . D . Payne : I also have Mrs . Lyons ' check for $ 20 . 00 , - - the required amount for a minor subdivision application , - -her application for review and approval of the subdivision and a letter from her giving the names and addresses of all of the people on adjoining properties . According to the Subdivision Regulations , one copy of the map . goes back to the subdivider , one copy remains with the Planning Board and one copy goes to the Town Board and on the back of these any restrictions or revisions are made that the Planning Board decides on . Does anyone have any ideas or any restrictions they feel should be on them in any way , with the exception of following according to the County Board of Health ' s specifications concerning septic system and water supply ? G . Totman : I think , from our meeting the other night , we asked that these be submitted according to the regulations and that , as long as that is satisfactory what we set up the other night , I ' m per - fectly willing to go ahead . What we have to do now , as long as we agree , we have to hold a public hearing - - D . Payne : Another thing that is required also and that is that we notify everyone on the adjoining lands . One of them I believe is in Connecticut . G . Totman : That ' s his problem . You only have one close neighbor and there should be no problem there , - - should be beneficial to him . G . Totman : We have to hold the public hearing and decide from that . D . Payne : We have to give preliminary approval formally prior to the public hearing . Would anyone like to make a motion ? F . Scheffler : , I move we give preliminary approval to Mrs . Lyons for her minor subdivision . Z . Kane : I ' ll second the motion . 2 - (At this point in the- meeting Mr . Da" n Chase , a member of the Planning Board came in . ) D . Payne : Don , we have just been going over Mrs . Lyons ' application for a minor subdivision and have all agreed there are no problems . We have the Board of Health ' s approval for the one house in process right now . Frank has made the- motion that we formally give preliminary approval for the subdivision , prior to the public hearing , and Zana has seconded it . Those in favor - Ayes Those opposed ? - None The motion is carried . D . Payne : Now we have to set a date for the public hearing . Is there any date you can ' t make it , Mrs . Lyons ? E . Lyons : Not as long as I know ahead of time . D . Payne : The hearing has to be advertised in the paper five days prior to the hearing and , of course , the paper for this town is the Journal and Courier . G . Totman : That won ' t be coming out again until next Thursday , - -week from tomorrow will be May 24th . Z . Kane : So the earliest date would be the 29th or 30th of May . D . Payne : How about the 31st of May , which is on a Thursday , at 8 P . M . in the Town Hall . Everyone present agreed that this date would be satisfactory .
