Absent: Francis P. Carey, Councilman
Absent; Verl Rankin, Jr. , Councilman
Purpose of meeting was to take action on appointing an Attorney for the
Town,
.No word was received from Atty. Wes McDermott. Atty. Evan Webster is not
interested in zoning. Atty. John Fitzgerald has indicated a desire to
render all legal services necessary for the Town to be compensated either
by the job, hour, quarterly, half-year or yearly.

POMEROY AS ATTORNEYS FOR THE TOWN

RESOLVED, that the Town of Groton retain Fit zgerald,' Taylor &
Pomeroy, Attorneys at Law, with offices at 16 Tompkins Street,
Cortland', N.Y. , as Attorneys for the Town for a period commencing
on- the-1st day of March, 1982, and ending on the 31st day of
December 1982, and
FURTHER RESOLVES to compensate-Law Firm quarterly for services
rendered, , but not to exceed $5000 for the calender year 1982,

Moved by Mr. Rankin, seconded by Mr. Carey, that the minutes of Februaxy
8 and 24 be approved as mailed. Ayes - Sovocool, Rankin,- VanBenschoten,
Carey, Robinson.
Highway Fund Claims Nos, -44 to 95 in the amount of $17,086.93 and General
Fund Claims Nos. 49 to 69 in the amount of $3,511.83 were presented for
audit, Mr. VanBenschoten moved that the bills be paid and the clerk
instructed cted to draw warrant for them. Seconded by Mr. Carey. Ayes Sovocool,
Rankin, VanBenschoten, Carey, Robinson.

Phil Shurtliff reported that County was pouring 'Slabs for bridge decking.
Both lanes of McLean bridge will be finished at one time. Newspaper has
done pretty good job out of Ithaca on County projects. If town has any
questions, be sure to contact Phil anytime. Enforcement of Fire Code was
discussed. Atlantic Inland is offering its services free.
Monthly reports from Town Clerk, Fire Department and Zoning Officer were
reviewed. , It was noted that eight homes were built in 1979 and as .total of
only seven for 1980 and 1981
wmr Correspondence from :harry J. Willis, Attorney, Department of State, clarifying
Fire Code administration and enforcement was received. It reads in part:
"Wher ea local government accepts the State F*re Prevention Code voluntarily,
as your town has done, it is required by Executive Law 9 396 to enact a
local law or ordinance providing for administration and enforcement of the .
Code. There is no specific requirement as to who the enforcement official (s)
must be: that is entirely up to the town board.
The fire-'chief becomes the enforcement official pursuant to Title 19 New
York Code of Rules and Regulations, Part 429,.3 only where a,town has no
building or fire code in effect on March 1, 1982 and thus allows the
State Fire Prevention Code to become effective automatically on that date,
and, further, takes no action to designate an enforcement official. Since, as
I understand it, your town has already accepted the State Fire bode, this
provision will 4 not apply to your town. "
At 81:00 P.M. the Clerk .read public notice to bidders for a 1982 tandem axle
dump truck-snow plow combination. Supervisor Robinson opened only bid
received. Mucci's Garage Inc. of 955 Spencer Street, Syracuse, N.Y. submitted
a bid for a 1982 Autocar, Model DC-64B, of $91,725-00 less trade allowance
of $35,000-00 for a total net bid of $56,725-00. Boaxd members, Highway
Superintendent and Attorney for Town, John Fitzgerald, inspected bid documents
and found that the bid met specifications and all documents'were in order.

RESOLVED, that the Town of Groton accept bid from Mucci's Garage Inc.
for a 1982 Autocar, Model No. DC-64B, Tandem Axle Dump Truck-Snow Plow
Combination for a price of $91,725-00 less trade in of 1975 Brockway,
Serial No. 87425, Single Axle Dump Truok-Snow Plow Combination of
.$35,-000.00 for a total net bid of $56,725-00.
BoardImembers reviewed Fire and Ambulance Contracts. Contracts were given
to. Atty. Fitzgerald to check over. He questioned paragraph four which
requires the Town to provide insurance for the firemen. The Village is
responsi sable for their own compensation and the Town shouldn't be contracting
for paragraph four.
Moved by Mr. Sovocool to table signing Fire and Ambulance Contracts.

.RESOLUTION NO, 7 - CONTRACT WITH HUMAN SERVICES COALITION AND
GROTON CHILD DEVELOPMENT CENTER FOR 1982

RESOLVED, that the Town of Groton contract with the Human Services
Coalition in the amount of $365-00 and the Groton Child Development
Center in the amount of $2000.00, to be paid from Federal Revenue
Sharing Funds,
Since Town Custodian is unable to fulfill duties, it was moved by Mr. Rankin,
seconded by Mr. Sovocool, to Mp2Lint Ambrose Collier as custodian. Ayes -

Board discussed agreement between Town and Attorney for Town, John Fitzgerald,
Atty. Fitzgerald explained that any additional compensation would only be for
recording papers, copies of deed, filing fees, etc. He is in perfect agree-

AND FITZGERALD,. TAYLOR & POMEROY, ATTORNEYS
AT LAW

with Fitzgerald, Taylor & Pomeroy, Attorneys at Law:
THIS AGREEMENTmade this 8th day of March, 1982 by and between
THE TOWN OF GROTON, a Municipal corporation having. its principal
place of business at Groton, New York, hereinafter called "Municipality"
and FITZGERALD, TAYLOR & POMEROY, attorneys at law, with offices at
16 Tompkins .Street, Cortland, New York, hereinafter called "LAW FIRM".
WITNESSETH.
That the Municipality does hereby employ and retain the Law Firm
as its attorneys for and during a period commencing on the I day
of March, 1982 and ending on the 31st day of December, 1982, and, in
consideration of the services to be rendered by the Law Firm as
hereinafter set forth, the Municipality does hereby covenant and agree
to pay unto the Law Firm compensation at the rate of Seventy-five
Dollars ($75.00) per hour to be billed quarterly, but not to exceed
Five Thousand Dollars ($,5,000.00) for the calendar year 1982,
The Law Firm accepts the employment and retainer aforesaid and
agrees to render all legal services necessary and proper for 'the
protection of the interests and property of the Municipality and in
the transaction of the normal business of the Municipality, hereby
agreeing to attend all Town Board meetings whenever necessary and
.required and to represent the Municipality in all civil actions and
proceedings where legal counsel is not provided by other'contractural
rights of the Municipality; hereby agreeing to examine and report upon
all titles to property in which the Municipality is now or may hereafter
become or contemplates an interest; hereby agreeing to prepare any and
all codes, contracts, instruments and documents necessary and proper
in connection with the business of the Municipality; hereby agreeing
to enforce and collect to the best Of his ability any and all claims,

enforcement or collection by the Municipality; and hereby agreeing
to render all and singular such legal servides of every kind and
nature as the Municipality shall require and deem proper in its

In addition to the compensation agreed to be paid to the Law
Firm as aforesaid, the Municipality shall reimburse the Law Firm for
all reasonable and necessary expenses which may be incurred on behalf
of the Law Firm in its representation of the Municipality in bringing
any action or proceeding or in the transaction of any and all business.

hands and seals the day and year first above written,

Planning Boaxd will meet With Atty. Fitzgerald and Town Board Representative,
Verl Rankin, to discuss proposed new zoning on a 3rd Wednesday of the month.
Mr.. Cargian, Chairman of Youth Program would like a meeting with Village
and Town Boards to discuss Youth project. Monday nights axe preferable.
March 22 is available for Town Board members. Supervisor Robinson will
get firm date and. notify everyone,
RESOLUTION NO, 9 APPROVAL OF FIRE AND AMBULANCE CONTRACTS
Moved by Mr. Rankin, seconded by Mr. Sovocool
Ayes - Sovocool, Rankin, VanBenschoten, Carey, Robinson
RESOLVED, that the Town of Groton approve Fire and Ambulance Contracts
provided paragraph four is deleted.
