Pierson Town Clerk MINUTES OF THE 'TOWN BOARD MEETING HELD ON MONDAY, MARCH 6, 1978 AT 7:30 P.M. Those present were: Teresa M. Robinson, Supervisor Robert F. Walpole, Town Justice Gordon C. VanBenschoten, Councilman Ellard L. Sovocool, Councilman Verl Rankin, Jr., Councilman Benjamin J. Bucko, Town Attorney Also present were: L. Cornelius, M. :Dempsey, G. Totman, Mr. & Mrs. Floyd Galbraith, L. K. Wood, C. Holden, F. Satterly, K. Rorke, R. Skinner, T. Eldred., 1o1. Perkins, Nancy McGuerty reporter for Groton Journal, and others Mr. Walpole moved to accept minutes of previous meeting as mailed. Seconded by Mr. VanBenschoten. Ayes - Walpole, VanBenschoten, Sovocool, Rankin, Robinson Claims #25 to #55 of the Highway Department and #31 to #7O of the General Fund were presented for audit. lair. Rankin moved that the bills be paid and the Clerk instructed to draw the warrant fox •them. Exemption Permits, as presented,, will be granted to operators of vehicles in excess of 4 tons per axle ors roads posted by the Town for purposes of deliveries to residents and ingress and egress.by residents. On March 3, 1978, the Town Clerk received by certified mail "Notice of Abandonment of the Lehigh Valley Railroad. between Dryden (Mile Post 321.2) and Locke (Mile Post 335.4) effective 12:01 A.M. on April 4, 1978. Some discussion was held as to official position as £ar as ConRail taking over Line, who is responsible for culverts, etc. Also discussed -abandoned LVRR in McLean. Mr. Satterly reported that the County Public Works Commit-tee discussed this railroad and are having a meeting on March 27 on whether to retain or revert back to landowners. Howard Stevenson indicated initial cost of maintenance would be $60;000 plus approxi- mately $6000/year. On the question of who is responsible for culverts, flooding conditions,,etc., Mr.. Satterly indicated. that Town Attorneys would be :receiving a Flood Emergency Statement from Frank Liguori and }toward Stevenson. It is Mr. Satterly's understanding that whoever gets title to it is responsible. • • 1 Kx. MT', Walpole has received complaints from nine people in the Ogden Hill area about dogs running, etc. We have a leash law, taut need cooperation for SPCA which we have been unable to get, Mr. Satterly wi11 check at county level to see if anything can be done. Board meeting reopened at 8:04 P.M. Mr. Torn Eldred:, Cayuga. County Histox'ian, spoke on microfilming Town paper. He is interested in Croton because Surnmerhill and Tj'ocke dverlap..counties, Reason for microfilming is for protection of permanent records. Kevin Rorke requested the boaxd to consider the transfer of ATC to Time, Inc, as quickly as possible. They hope to complete meager bylMdy ox June, Mr, Bucko requested Mr. Rorke to submit data on f`.i.nancia.l and manage- ment aspects. Mr. Rorke agreed to do so, but indicated no changes in management or status, Mr. Lyle Raymond attended meeting held in Auburn on FebTivary 22 on the Owascc Watershed PLooject, His re-port on how it will affect Groton was given to Supervisor Robinson. Discussed partial tax exemption for persons 65 years of age and older. Supervisox Robinson will find out how many residents are curaren'tly pax'tial.ly exempt before any decisions can be made. A special meeting will be called by the Supervisor, since any ohange dust be adopted by April 1, 1978. Discussed mining report for Town's gravel bank to be filed with the State, Estimated- cost to do project- is $1000 rlL s. The consensus of the hoard wag that they are tired of State mandates and furthermore where does the money £ox this project come from, since it wasn't budgeted. If we don't comply the State w7Jl shut down mine and ve must go 'bask to 1975 gravel. rate. A't'torney Bucko will seek more information. Report must be renewed every three years. They want amount of gravel taken out, crops- sec'Lion, then hors we intend to reclaim land. A couple of possibilities would be to have it on the Agenda for the Municipal Officials' Association Meeting to see what other towns are doing, or let the State tell us Prow to do it. 3,2 Mr'. Mahlan Perkins, agent for 37 property owners along abandoned LVRR in McLean was present to discuss preferential rights to acquire a portion of the abandoned LVRR property that'is held' jointly by -the County of Tompkins, Town of Groton, Totem of Dryden and Village of Freeville. Mr. Perkins indicated the desire of the landowners *to -have land .roverted back to- them. They will have to buy from railroad at $10.O/a.cre; individual owners would be responsible for removal of culverts; trackage and ties are the railroads; four individuals have reverter clause 'but he recommended a quit claim deed; opposition is Sierra Club, Environmental 'Council, etc. The proposed resolution as submitted by Mr. Perkins was adopted as follows: RESOLUTION NO. 4 - RELINQUISH PREFERENTIAL RIGHT TO ACQUIRE ABANDONED RAILROAD PROPERTY' Moved by Mr. Walpole, Seconded by Mr. VanBenschoten Ayes - Walpole, ,VanBenschoten, Sovocool, Rankin, Robinson 'rlHEREAS, the Town of Groton has heretofore acquired jointly with the County of Tompkins, Village of Freeville, and-Town of Dryden, a preferential right to acquire a portion of the abandoned railroad property, which is known and identified generally as a portion of the Lehigh Valley Railroad Company, El -nira, Cortland and Northern Branch from Freetirille, Tompkins County (M.P. 59.4) extending to Cortland, Cortland County (M.P. 57.8) as shown on Index map Evaluation Section 19, Tompkins and Cortland Counties ;,' State of h; ew York, and INTHEREAS, the Town of Groton does not desire to exercise such preferential right and desires to .relinquish such , preferenttial right to the New York State Department of Transportation pursuant to an. assignment and authorization by said New York State Department of Transportation dated Parch 16, 1977, and WHEREAS, it is the desire of the Town of Groton to see that said abandoned ,railroad. property is returned to the adjacent property owners and it is also the desire of the Town of Groton that the County of Tompkins relinquish its preferential right. NOW, 'THEREFORE, the Town of Groton does hereby assign and relinquish its preferential right to acquire a portion of the abandoned .railroad property to the New York State Department of Transportation, subject to the adoption of similar resolutions by the County of Torpkins, Village of Freeville and Town of Dryden. Mr. Rankin moved to appoint Roger Gleason for another seven -year term on the Planning Board. Seconded by Air. Walpole, Ayes - Walpole, - VanB enscho ten, Sovocool, Rankin, Robinson Mr. Rankin moved. to appoint George Bushnell to the Appeals Board for a term of five years. Seconded by Mr. Sovocool. Ayes - Walpole., VanBenschoten,, Sovocool, Rankin, Robinson Mr. William Shaw and Mr. John Gaines of the County Youth Bureau were present to advise board of State Aid eligibility for Youth Recreation that the Town now has and Youth Service money that is available, Deadline date is April i for applying for State Aid. With recreation program Town now has, we'll loose some State Aid, however., money is available for Youth Services on Local Level. Based on 1970 Town Census of 1200 youth, Groton receives $1.20 per child (1334 youth currently) or $1600 State Aid for Recreation. We are eligible for $1.05 per person for Youth Services or $1400 State Aid for Youth Services. Some-local youth services might be informal counciling, remedial reading in school and educational programs. Air. Walpole reported that the Town Directory can be compiled. from County Tax Roll and Fire Coordinator for a fee of $250 - $300, typed and ready to go to press in three weeks. Town would have to pay for printing. Mr. Sovocool moved that the Directory be compiled and payed for from Federal Revenue Sharing Funds. Seconded. by Mr. VanBenschoten. Ayes - Walpole, VanBenschoten, Sovocool, Rankin, Robinson Mr. Pat Galbraith brought to the Board's attention a drainage problem of water running into field and he has no access to field now due to ditch Town made. Needs a ditch to carry drainage into inlet. Mr. Cornelius, Highway Superintendent,.will take care of problem in the Spring. Mr. Galbraith also questioned why the junkyard ordinance is enforced in some instances and not in others. Mitch Peter is an example -- Enforcement Officer said. he is in violation but cars are in neat order.. Another example is C • 1 i i 33 Carl White by Cotanchs' on Peru Road. Peters is in violation -- nothing was done a year ago. Either enforce or get rid of ordinance. Supervisor Robinson assurred 10Ir. Galbraith that the Town is working on it. VanBenschoten, Councilman • Verl Rankin, Jr., Councilman Ellard 1. Sovocool, Councilman Also present: Leland E. Cornelius, Highway Superintendent Supervisor Robinson presented the 1977 Annual Supervisor's Report to the Board for their review. Several items were discussed. Supervisor Robinson will deliver Report to Albany on Monday and discuss with them any matters that are in question. Discussed partial tax exemption for aged. There is currently 45 people exempt in the Town of Groton. The County has raised the income .rate to $7200, with the Town, Village and School rate currently at $6000. It was the consensus of the Board to stay at the current rate of $6000 along with the Village and School. Moved by Mr. Walpole to retain rate of $6000, seconded by Mr. Rankin. Ayes - Walpole, VanBenschoten, Rankin, Sovocool, Robinson Discussed Youth Services - The County Youth Program has indicated to us that we can get matching state funds of $1440 for Youth Services. Since Town hasn't budgeted extra money in 1978 budget, we cannot at this time participate in program. In the meantime, Board will be considering possible programs for the Torn. L • Supervisor Robinson presented brochure on new copy machine for Boards consider- ation. It is a Canon Plain Paper Copies., NP50, which sells for $2559.00. Empire Photocopy' will allow us $400.00 trade -in on our current machine. Would save Town $7.00 per thousand sheets in.addition to producing a copy that is on bond. and can be printed on both sides of sheet. Our current machine is in rough shape, needing repairs regularly. No action taken by Board. Discussed. Sherry O'Brien having a used car lot that is .in violation of zoning ordinance. Zoning Officer should take care of. Fir. Walpole reported seeing 17 cases in the west section of the township that are in violation of zoning ordinance. Of the 17 violations, four (4) were businesses.in an Agricultural District started after zoning. Per. Cornelius reported to Board that loader blew headgasket. Needs motor job. Syracuse Supply quoted $4000 for job to include everything new. Loader is now 10 years old.. New loader now costs 'between $90,000 & $95,000. Thinking ahead, in two years we should be thinking about purchasing new loader. Paid $32,000 in 1968 for loader - -mill allow $35,000 on a new one. There being no further business, P9r.
