RESOLUTION NO, 17 DOG CONTROL LAW (LOCAL LAW NO. 2)

The meeting was held to discuss negotiations of new contract for 1978.
The Highway men asked for:
1 3 weeks vacation after eight years
2 1 sick day permonth
3 400 per hour pay increase
Agreement pending approval at tonight's Board Meeting:
1) 8 Regular Holidays
2 3 Floating Holidays
3 350 Per hour increase for Mechanic, Motor Equipment Operator and
Truck Driver

Mr. Walpole moved to accept minutes of Town Board Meeting held on August 1,
1977 as mailed. Seconded by Mr. Sovocool. Ayes - Walpole, Sovocool, Rankin
Claims #219 an #239 of the Highway Department and #199 an @224 of the General Fund
iswere presented for audit. Mr. Sovocool moved that the bills be paid and the Clerk
instructed to draw the warrant for them. Seconded by Mr. Walpole. Ayes - Walpole,

.� RESOLUTION NO. 18 MAINTAIN FIVE -MAN BOARD

RESOLVED, that the expiration of the Justice of the Peace term, that
the new Councilman-elected shall be elected for a three year term and
his 'successor for a four year term.
RESOLUTION N0. 19 REIMBURSE IACAL REVENUE SHARING TRUST FUND IN THE
AMOUNT OF $140000 EXPENDED IMPROPERLY FOR DEBT RETIREMENT

RESOLVED, that the Town of Groton borrow $14,000 from the First National
Bank of Groton, deposit money in General Fund and transfer to Federal
Revenue Sharing Fund. Transaction can possibly be done by Budget Notes,
Discussed Town Clerk as custodian of all records and none are to leave office unless

authorized by Town Board, Mr. Walpole, Town Justice, expressed the need of having
our own Court Room, thus eliminating Justice records being in two different locations
making access to records difficult.

were reviewed.
Action
was tabled to give committee more time
to consider.
Board felt there wasn't a need for an audit at this time.
Town Clerk will write
letter

Town Board to George Totman,
Chairman of Planning
Board, requesting him
to file
all
copies
of minutes,
notices,
maps, etc., in
the
Town Hall as they are
public
information.
Also, Mr.
Totman is
to notify Town
Clerk
of any meetings to be
held in
Town
Hall in
addition
to their
monthly meetings
that
are held the first Tuesday of
each
month
in order to
avoid any
conflict with
others
using facilities.
Board authorized printing of 250 copies of Dog Control Law for distribution to those
requesting provisions of the law.
Mr..Rankin appointed Mr. Walpole to work with Fire Department and Bob Brown to
update Town Directory.
Reviewed Gary Lees' feelings on Real Property Tax Legislation regarding shift from
current assessment practices to full value. There is nothing the Town can do since
we are assessed by the County.

We have no objections so our original approval of

will remain as
is.
Discussed Federal Mandate of State Unemployment Insurance Law to go into effect
January 1, 1978. Estimated cost is $3100 per year? Does it involve employees only
or elected officials also? Tabled until Town Attorney looks into.
State Equalization Rate is 47.43 up from 46.72 last year.
Discussed recent information on Fall Creek Corridor Management Plan. Some changes
in regulations have been made.
RESOLUTION N0, 20 YOUTH RECREATION PROJECT FOR 1978.

RESOLVED, that the Town of Groton will participate in Youth Recreation Project
in the amount of $3200 of which $1600 will be reimbursed by the State.
Two vacancies exist on the Planning Board due to the resignations of Fred Wilson
and Harvey Fink. Mr. Heffron moved that we appoint Mr. Lyle Raymond and Mr. James
MacNeil as recommended by the Planning Board. Seconded by Mr. Walpole. Ayes -

RESOLUTION NO. 21 ABOLISH MOBILE HOME ENFORCEMENT OFFICER POSITION &
CREATE ZONING OFFICER POSITION

RESOLVED, that Mobile Home Enforcement Officer position be abolished and
to create a new position of Zoning Officer, and
FURTHER RESOLVED, that Robert Brown be appointed as Zoning Officer.
Discussed $150.00 left over from Bridge (Item II) which was originally allocated
from Title II to Basso, now to go towards sidewalk at the West Groton Polling Place,
Town Clerk to contact Election Board for written statement that walk is required.
Mr. Walpole made motion to proceed with sidewalk in District #1 with $150 earmarked
for Bridge for Basso from Title II Funds from the first allotment with additional
monies ($690.00) coming from second Title II allotment for a total of $840.00 for
sidewalk. Seconded by Mr. Heffron. Ayes - Walpole, Sovocool, Heffron, Rankin

RESOLVED. that the Town of Groton Highway Association Employees' be
xPanted a 350 per hour increase and one (1) additional floating holiday
for their 1978 Agreement.

RESOLUTION NO*21.FEDERALrAID RAID,- HIGHWAY CDOSSING PROGRAM PROJECT
RESOLUTION of Town of Groton Agreeing to Permit the Department of Transportation
to Construct a Federal�Aid Rail�Highwayr Crossing Program Project on the Highways,
Streets and/or Roads of the Municipality,
WHEREAS, the New York State Department of Transportation has proposeda Rail -
Highuay Grossing Program Project, puMsuant to Section 203 of the Federal
Safety Act of 1973 as amended by Section 203 of the Federal Highway Safety
Act of 1976, and
WHEREAS, the'New York State Department of Transportation has notified tide
Board of the approval of plans and specifications for such a Rail- Highway
Crossing Program Project, for the ft il�Highway Crossings which are under the
Jurisdiction of the municipality, and which project is more completely described
as
covered under PIN and

kffiEREAS, the-New York State Department of Transportation has made Down its
intention to advertise a contract for the above described improvement az)d has
requested an a eement from the Board to the effect that it will permit the
State, its agents and employees to enter upon the highways, roads and/or streets
under the jurisdiction of the municipality for the purpose of performing the
abovemdescribed improvement.
N01r THEREFORE, BE IT RESOLVED: That the Board of the Town

duly convened in legal session held on the 6th day of September , 197,
does hereby approve of the above described improvement to be performed on the
highways, roads and /or streets of th�h-a municipality and does hereby agree with
the State Department of T sportation that the authorities will permit the
State, its agents and employees to enter upon the highways, roads and /or streets
of the municipality for the purposes of carrying out the above�desnri.bed Rail -
Highway Crossing Program Project, and IT IS FURTHXR
REHOLVED: That the Board of Trustees of this municipality does hereby agree
with the State Department of Transportation that the municipality shall. -retain
,jurisdiction over the highways, roads and /or streets within the project area
and mold harmless the State of New York for any damage to the property or persons
of others due to the performance of any of the employees or agents of the munici-
pality, and IT IS FURTHER
RESOLVED: That upon completion of the above described Rail - Highway Crossing
Program Project, the Municipality will maintain the improvement and the highways,
roads and /or streets so improved in accoln a ce with the New York State Highway
Law and the Federal Highway Safety Acts of 1973 and 1976 and Federal Standards
and criteria in connection with such project,
RESOLVED s That For the Rail�HighwayF Crossing Program Project, the municipality
agrees to schedule any highway resurfacing so that it will not obliterate
newly painted markings, except as necessitated by emergency situations whereby
resurfacing is essential to maintaining proper traffic operations, IT IS FURTHER
RESOLVED: That the clerk of this Board is hereby directed, within ten days
after the adoption of this resolution, to transmit (5) certified copies of
the foregoing resolution to the New York State Department of Transportation.
