HomeMy WebLinkAbout2003-05-06 Campground definition REVISED 7/31/03 TOWN OF GROTON ZONING BOARD OF APPEALS (ZBA) MEETING REPORT MAY 617H, 2003 7 : 00 PM ZBA Members present, in addition to prospective ZBA candidates noted below : Pat Gaines , Steve Thane, John Pachai , Lyle Raymond . Item #1 : ZBA Candidates The ZBA met in Executive Session to interview two prospective candidates, Tammy Lyn Cooper, 212 Spring St. , Groton , and Andrea S . Trzaska, 606 S . Main St. , for a vacant position on the Board at the request of the Supervisor, Glenn Morey . The opinions of the ZBA members on the candidates will be given to the Supervisor in a separate confidential report. Item #2: Definition of a Campground Problem: Campgrounds are allowed by Special Permit under the Land Use Code in the Rural -Agricultural District. The CEO cannot determine when such a Special Permit applies because the Code does not define what a campground is. This problem was brought to the attention of the ZBA. ZBA Recommendation: How Campgrounds are defined in several other towns in the County, the state, and other states was reviewed , as well as the definition used by the NYS Health Department. It was concluded that the definition used by the NYS Health Department, with two changes felt to be needed for the Town of Groton, was an appropriate and workable possible definition of what a Campground is for applying the Groton Town Code. The proposed Campground definition is as follows (additions to the NYS Health Department definition are in italics ; deletions in parentheses): "Any parcel or tract of land including (buildings) cabins, tents, recreational vehicles, or other structures, under the control of any person, where five or more campsites are available for temporary or seasonal overnight occupancy for 90 days or more. " It was agreed by consensus that this draft of the ZBA ' s suggested recommendation of what a Campground is will not be formally adopted by the ZBA until it has been scrutinized by the Town Attorney to identify any legal problems inherent in the proposed definition.
