Re : Appeal of Tichenor

Dear Mr . Raymond :
I write to request that the Board of Zoning Appeals hear an appeal
from the permit denial dated December 15 , 1989 , by the Town Enforcement Of -
ficer , Gary L . Wood . Enclosed is a copy of Mr . Wood ' s denial letter ad-
dressed to my client for your convenience in reference .
Mr . Wood has taken the position that his decision is non - appealable
because of a similar 1987 request and denial by the then BZA . While we do
not agree with Mr . Wood , we ask you to review this matter in the interest
of fair play and common sense . Unless ,you review the permit application ,
we will have no alternative but to bring an Article 78 proceeding at con -
siderable additional inconvenience and expense to the Town and to us .
' There are good reasons why the permit requested should be granted . The
Tichenors would like the opportunity to present them to you .
In the event that you grant us a hearing , may we request that it be
scheduled for your first available date after May 7 , 1989 . Mr . & Mrs .
Tichenor are not available until on and after that time .
