PRESENT ( *present ) PUBLIC PRESENT Janet Bell , Chairman George Hajney *Lyle Raymond , Acting Chairman Helena Hajney *David Ofner George Totman *Mary Decker *Nial Smith Lyle Raymond , Acting Chairman , opened the Public Hearing at 8 : 00 p . m . by reading the attached Legal Notice published September 16 , 1985 . The Board introduced themselves to the public . RAYMOND : Mr . and Mrs . Hajney wish to eliminate a mobile home and replace it with a regular house . Unfortunately , he does . not have the proper, road frontage . G . HAJNEY : There are houses on either side of us so . we cannot extend the lot . RAYMOND * What is the frontage ? G . HAJNEY : 103 feet . The house we wish to construct is 40 feet wide and goes back 62 feet . It will not be as wide as the mobile home that is on the lot now . RAYMOND : There is sewer and water on the lot now? G . HAJNEY : YEs . SMITH : Will it pass the Health Department for the requirements for a house ? G . HAJNEY : I have not checked . What is there now is for a two bedroom mobile home and I want to replace it with a two bedroom house . I don ' t know what they require that is different . OFNER : He can ' t get a building permit until we approve this . ZONING BOARD OF APPEALS PUBLIC HEARING - 2 - October 1 , 1985 OFNER : Mr . Hajney , as I read it you would have to go before this Board for approval ; if approved , you would have to see the Code Enforcement Officer for a building permit . We do not issue building permits . TOTMAN : He was denied a permit before . If you approve the application , he will apply for a building permit . OFNER : All of us have seen the property . It will not increase the density t, of the area . SMITH : Your frontage problem is the same as the rest of the neighborhood . RAYMOND ! There is a map attached to application indicating the size of the lots in that area . TOTMAN : THis lot is 30 feet longer than the one next door to it . OFNER : The lot on the other side is 60 . feet . RAYMOND : The frontage , as it exists , falls into the general character of the neighborhood . Your lot is narrower on the back side than the front . G . HAJNEY : A little bit . TOTMAN : I live across the road . The only thing I ' d like to say the Ordinance was passed with the concept that any time you can eliminate a mobile home with a wooden structure , it is what the content of the ordinance is about . The value of the land around would increase . Normally , Ordinance calls for 200 foot frontage in accordance with the County Health Department . This lot has been approved for a mobile home dwelling . The Ordinance considers a mobile home same as a house after it is on the lot . The house will add more value to the Town and in future years , if you keep the mobile home nice a different class of people could buy it . . . . If a wood structure is built , after years go by it makes the land more valuable around it . RAYMOND : The Board has received a letter addressing this situation. - expressing ZONING BOARD OF APPEALS PUBLIC HEARING - 3 - October 1 , 1985 an opinion . "We sincerely regret that wil will be out of town on Tuesday , October 1 , 1985 and therefore will be unable to attend the public hearing of the Zoning Board of Appeals , Town of Groton . Therefore we wish at this time to express our support for Helena Hajney in her request for a variance in regard to road frontage . George and Helena Hajney have been our neighbors for years and we applaud their plan to build a permanent home to replace the mobile home in which they presently reside . Such a proposal will add greatly to the value and attractiveness fo the area . i signed by Frederick L . and Veronia D . Billard RAYMOND *@ Are there any other questions or comments to be made concerning this matter ? OFNER : Does anybody know how many people were notified of this hearing ? TOTMAN : About eight different families received the notice . OFNER : The only comments we have are positive , in support of the proposal . RAYMOND : If everyone has stated all the opinions that they have , I will close this hearing . We will move to a regular meeting of the Zoning Board of Appeals to make a decision on this matter . St . , McLean BEING A PORTION OF TAX MAP PARCEL 38 - 3 - 4 AND CONTAINING + ACRES OF LAND , By Helena Hajney AND WHEREAS , ALL MEMBERS OF THE BOARD PRESENT VIEWED THE PROPERTY , AND WHEREAS , AFTER DUE NOTICE A PUBLIC HEARING WAS HELD BY THE BOARD OF ZONING APPEALS AT < TIME > 8o00 p . m . ON < DATE > October 1 , 1985 TO CONSIDER THE APPLICATION AND WHEREAS , AT SAID HEARING ALL THOSE WHO DESIRED TO BE HEARD 1 WERE HEARD AND THEIR TESTIMONY RECORDED , AND WHEREAS , ALL TESTIMONY HAD BEEN CAREFULLY CONSIDERED AND THE FOLLOWING FACTS NOTED : 1 . The existing non- conforming lot varies substantially from Town requirements in regard to road frontage . 2 . No increase in population will be generated by construction of this residence . 3 . No substantial change in the character of the neighborhood or adjoining property will occur . 4 . There is no practical alternative for the proposed action . 5 _ The lot size is in general conformity with the established character of the neighborhood . 6 . Considering all of these factors , the interest of justice will be served by granting this variance .
