PLEASE TAKE NOTICE , that the Zoning Board of Appeals , Town of Groton
County of Tompkins , State of New York , will hold a public hearing at the
Town Hall , 101 Conger Boulevard , Groton , NY . , on Monday , July 20 , 19879
at 8 : 00 p . m . for the purpose of considering the application of MARVIN W .
CHASE of 227 Pleasant Valley Road for a variance to Section 352 . 1a & lb
( Minimum Lot Area and Frontage ) of the Town of Groton Land Use and
Development Code .
All interested persons will be heard ,
RAYMOND ,* We all have copies of the lot ana eh proposed addition Mr . Chase is
considering , Would you explain to the Board , in your own words , what
you have planned ,
CHASE : My main concern is I want to put a new roof on my livingroom . Right
now it is a shed type roof and when it rains it leaks into my living
room , It is unsafe and it does not have enough- pitch to shed water .
I propose to put a gable room on it to keep my livingroom dry and
extend it over the garage ,
RAYMOND : That is the present structure we saw on the back of the house ?
CHASE : Yes ,
RAYMOND : You also have proposed an addition ,
CHASE : Yes , I can go too ways , . I want to increase . the size of the garage on
the west side of the house , it is 2 foot from the property line .
I have talked with Marvin Torok and he has no problem with it ,

I want to come 14 feet towards the road , that would be 50 feet away from
the road , my house comes that far now .
RAYMOND : That would come to the corner of your present house ?
CHASE : No , it would be a few feet short of squaring the house off .
If I can ' t extend the garage them I want to build a bedroom off the
east side of the house . I don ' t want the bedroom if I can get the
garage . If I build the bedroom , I would go with the existing garage .
I would like to go with the new garage . The new roof would be
incorporated into the new addition to the garage' . Right now it is just
a shed .
RAYMOND : You said the existing structure is 2 feet from the boundary line ,
the new addition would be closer ?
CHASE : No , it would be just exactly as it is now . My garage already sets
there , I want to bring it 14 feet closer to the road .
OFNER : It will be flush with the house ?
CHASE : It will be back about 11 feet from the front of the house .
SMITH : It won ' t be any closer than the 2 feet it is now?
CHASE : No .
RAYMOND : This will be one story high ?
CHASE : Right , a gable roof with a pole structure for the garage .
RAYMOND :_ The sole use of it is for a garage ?
CHASE : Right .
RAYMOND : You are not going to build the other addition on the east if you can
build the garage ?
CHASE : If I can expand the garage I won ' t build the bedroom . I would move
the roof over the garage addition and make the existing garage into
a bedroom .
OFNER : Is the house the same shape as when you bought it ?
CHASE : Yes , it is . I have repaired the roof a couple of times in the back ,
but when there is a south wind with rain , it rains into the livngroom .
OFNER : You did not create the 2 foot distance from the ' boundary line ?
CHASE : No , it was there when I bought it .
RAYMOND : There is no possiblity of purchasing a strip of land of make it
conform ?

CHASE : I have talked with Marvin Torok , at the time he was in the Dairy
Buyout Plan and it was all tied up . But I am hoping in the future
to work something out with him .
OFNER : We encourage you to move in the direction of purchasing more land ,
we are satisfied you are trying to do that .
CHASE : I have a driveway with parking area with only half a garage . If I
come out 14 feet I would have a full size garage .
RAYMOND@ Does anyone else here want to make comments or ask questions on
Mr . Chase ' s application ?
GARROW : I live on the east side of Mr . Chase , and as long as he gets the
garage it is fine with me . If he goes the other way ,' we have had
problems in the past with the animals and it would create more
problems with an addition on our side of his house .
CHASE : I agree with him , that is why I would like to keep it on the west
side of the house .
RAYMOND : If you were to build the additon on the east side it would be a
10 x 20 room ?
CHASE : Yes , it would stick out 10 feet further from the existing house .
It would come to about 28 feet from the .boundary line .
RAYMOND : That meets the side distance boundary line .
Are there any other questions ?
S . ROBBS : I wasn ' t here in the beginning and I would like to know why he is
here ?
RAYMOND : Mr . Chase is proposing to build an addition on the west side of
. his house for a garage , an extention of an existing building that
is already there . He is feet from the lot line on the side he
proposes to build on . He then plans on converting the back of the
present building into a bedroom . If he can ' t get permission to do
that , he would build a bedroom on the east side of the house .
If there are no further questions , I will close the hearing
on the application of Mr . Chase .

ZONING BOARD OF APPEALS
WHEREAS , Application of MARVIN W . CHASE , a request for a variance of
Section 352 . 1a and lb ( Minimum Lot Area and Frontage ) of the Town of
Groton Land Use and Development Code was filed on 71111Z 7 , 1q R7 , and
WHEREAS , said Application requests a variance to permit extension of the
roof line and extension of an attached garage by . 14 feet on property
owned by MARVIN W . CHASE on 227 Pleasant Valley Rd . being a portion of
Tax Map No . 35 - 1 - 16 .
AND WHEREAS , all members of the Board present viewed the property ,
AND WHEREAS , after due notice a public hearing was held by the Board of
Zoning Appeals at 8 : 00 p . m . on . July 20 , 1987 to consider the Application .
AND WHEREAS , at said hearing all those who desired to be heard were heard
and their testimony recorded ,
AND WHEREAS , all testimony had been carefully considered and the following
facts noted :
1 . Does not exceed the existing dimensions as authorized by its
non- conformity .
2 . No other negative effects noted .
3 . Short Environmental Impact Statement reviewed : No . 5 - 2 eliminated ,
No . 9 Residential and Agricultural . Determined negative environmental
impact .
NOW , THEREFORE , BE IT RESOLVED that the Application of MARVIN W . CHASE for
a variance of Section 352 . 1a and lb to extend the roof line of the existing
residence and add 14 feet to the existing attached garage on a non- conforming
lot be GRANTED for reasons noted above .

RAYMOND : That is all of the; written documents that I have� had submitted .
I will now open the hearing to any comments . I think we should ask
Mr . and Mrs . Albern what you have in mind .
D . ALBERN : To build a garage with a second story loft up in the gable , it will
look like a one story building . It will be a woodframe with siding
like the house . Basically it would be replacing a barn / shed that
was near there . It is not in the same spot .
RAYMOND ,* We saw the pile of, wood with the canvas over it .
D . ALBERN : That is not where it is going to go . The old shed comes off the
back of the house and ran to the boundary line , it is down to about
10 x 10 now % The old one was right on the boundary line , the new one
we would move in 3 ', feet , The rest of the old barn will be removed

RAYMOND : What aout the distance from the lot lines ?
D . ALBERN : It is 3 foot from the side lines . I am not objectionable to moving
it farther up or over . The lot is not very big . I hate to use too
much of it up . With the 3 foot distance it is far enought in so any
snow will fall into my yard .
RAYMOND : As a rule an accessory structure on a residential lot the requirement
is 6 foot from the lot line .
D . _ ALBERN : I did not know abut the 6 foot rule when I drew that .
RAYMOND : The driveway comes out to Gulf Hill Road ?
D . ALBERN : Yes .
RAYMOND * The driveway is the same width as the structure ?
D . ALBERN : More or less . It would probably be one . foot shorter on each side .
OFNER : Mr . Albern , you have this marked as a garage , what is going to be
in the garage ?
D . ALBERN : I run a home improvement business . I have miscellaneous equipment ,
trucks , I have 2 trucks at the moment . There will probably be the
family .car and one truck .
OFNER : How about the building material in the yard ?
D . ALBERN : I am going to put that inside the garage , that is why the garage
is as long as it is .
OFNER0 You ' re going to use the building for partly storage ?
D . ALBERN : Most of the equipment sets on the truck , I don ' t carry an inventory .
I have miscellaneous things left over from different jobs and instead
of transporting them back to Syracuse I would store them in the
garage .
RAYMOND * How long have you been in the business ?
D . ALBERN : Since 1982 . It was Artcraft before that , I now subcontract under
my own name .
RAYMOND Are there any other questions for Mr . Albern ? Is there anyone else
here who would like to make any statements concerning Mr . Albern ' s
application ?
If there are no more statements and the Board has no more questions ,
I will close the hearing on Mr . Albern ' s application .

Code was filed on June 19 , 198,7 and
WHEREAS , said Application requests a variance to permit an accessory structure
on property owned by DOUGLAS R . ALBERN on One Gulf Hill Road , McLean being
a portion of Tax Map Parcel 38 - 6 - 1 by constructing the structure within three
feet of the lot line .
AND WHEREAS , all members of the Board present viewed the property .

Zoning Appeals at 8 : 15 p . m . on July 20 , 1987 to consider the Application .

RAYMOND : We have had submitted to us copies of the application and with that
a map that shows the lots and the location of the Metzler lot , giving
dimensions and the names of the neighbors of the other lots and a
sketch has been submitted with this giving the approximate dimensions
and the type . of addition they wish to make
BOARD : All stated have copies of papers and seen the property .
RAYMOND : We do not have any written documents pertaining to this application
so therefore I will go directly to the Metzlers and ask them to
explain what they are proposing .
C . METZLER : I have owned the home for 19 years and lived there with my husband
until he died three years ago . I can no longer live alone because
I am a diabetic and so I have rented the trailer to my sone in hopes

of building on a bedroom for myself . When you can ' t live alone and you ' re
not in shape where you want to go to a nursing home you have a problem .
This is the whole purpose behind this .
RAYMOND : According to the . sketch you are proposing , if I understand it , to
put an addition on the west side of the existing trailer with the
dimensions of 10 x 25 feet ?
C . METZLER : 10 x 24 feet . '
RAYMOND : It would be alongside of the trailer , that would be the 24 foot along
the side of the trailer and 10 feet away from it ?
C . METZLER : Yes , that will be the addition starting at the north end and
running south .
RAYMOND : On the south side there is a porch ? XXXXX1.XXXXXXXXKX.2X
C . METZLER : That is an existing porch .
RAYMOND : What are the dimensions of that ?
C . METZLER : I thing it is six foot by ten foot .
RAYMOND * What I am getting at is the addition you are going to put on is not
going to extend any futher out than the porch that already exists ?
C . METZLER : No .
RAYMOND : This is going to be a shed type roof ?
D . METZLER : It will have a 4 inch drop .
RAYMOND : A shed roof from the edge of the home ?
D . METZLER : Yes .
RAYMOND : The lot lines , how many feet from the west line of your lot are you ,
after you build the addition on ?
D . METZLER : At least 60 feet .
RAYMOND : How about the north side ?
C . METZLER : The north is probably about 30 foot .
RAYMOND * There would be no problem with the north and west side lines . How
far back from the road are you ?
D . METZLER : It is a corner lot , about 30 feet from ODgen Rd .
RAYMOND : Everything you are building meets the side line regulations . What
you are building is an additon on a non- conforming lot .
