Board of Zoning Appeals - Town of Groton
August 23 , 1983 Called to order at 8 : 15 p . m .
Present : Janet Bell , Chairperson , Nile Smith , Don Cummings ,
Mary Decker
Pursuant to Public Notice published in -(, the August 8 , 1983
issue of the Groton Courier , a public hearing was held on the
following applicationtia
The Zoning Board of Appeals will hold a public hearing at
the Town Hall , 101 Conger Blvd . , Groton , N . Y . , on Tuesday ,
August 23 , 1983 at 8 : 00 p . me for the purpose of considering the
application of George Tillotson , 222 Lafayette Rd . , requesting
an extension of temporary permit granted 10/12/82 for a period
of one year for a non- conforming trailer .
The chairperson of the board opened the hearing by reading
the text of the notice ; she then asked that any pertinent
written comments or reports concerning the appeal be read . There
were none offered .
Mr . Tillotison did not show for the hearing and there was
no one present to speak in favor of or in opposition to the
appeal . The chairperson asked for comments from the Board and
from George Totman . Mr . Totman explained that Mr . Tillotson
had just applied for a buildillngl : permlt on June , 1983 • The one
year temporary permit expires on 10/12/83 . He has waitedA
months before applying for a building permit and now wants an
extension of an additional 8 months .
At 8 : 18 p . m . , the hearing went into deliberations .
J . Bell explained that the building has already been started .
N . Smith asked , ",What can they do with the trailer when the
permit time is up ? " G . Totman answered , " He could take the
wheels off it and apply for a building permit and use it for
a storage building . " J . Bell stated , " The only thing we have
to decide is whether he can keep the trailer there . " N . Smith
stated , " I would be against it if he had not started building
already . " G . Totman suggested , " If you give him a full year ,
he might wait until next summer to finis;, . If you give him
6 months , he might finish sooner . " D . Cummings stated , " He ' s
asking for 11 months extension . If we give him 6 months and
he doesn ' t get it done , we ' ll have to come back down here again
in another 6 months . Maybe we should give him a year extension . "
N . Smith explained , " If we do give him an extension , we should
say that this is the last extension . " J . Bell stated , "We
told him that last year . " M . Decker stated , " If he was an
interested party , he should be here at this meeting . Last
year he didn ' t show up at the meeting either . If this board
is ever going to mean anything , we better have some substantial
power to reinforce the laws . " J . Bell stated , " I don ' t
understand . We gave him a year and he sat on it for 8 months
before he actually did anything . "
Mary Decker made a motion to give George Tillotson the
extension of a temporary permit granted only until May 1 , 1984 .
At that point , the trailer which does not conform to all
zoning laws of the Town of Groton must be removed . As of this
notice , there will be no further Variance granted on this
application .
Don Cummings seconded . A vote was held : One NO , three YES .
The motion was passed .
Meeting was adjourned at 9 : 00 p . m .

BOARD OF ZONING APPEALS
PUBLIC HEARING
DATE : August 23 , 1983
PRESENT : Janet Bell , Mary Decker ,
Don Cummings , Nile Smith
WHEREAS , George Tillotson has filed an application for a
variance of the extension of a temporary permit granted on
October 12 , 1982 for a period of one year for a non- conforming
. trailer , and a public hearing having been held after due
notice , and all those desiring to be heard were heard and the
testimony recorded , and
WHEREAS , this board , from the application , hearing all
parties , and viewing the premises and neighborhood concerned
finds :
1 . A building permit was issued in June 1983 , and the
building has been started .
2 . Mr . Tillotson is now asking for an additional 8 months
extension to finish building .
3 . Mr . Tillotson did not show up at the meeting to explain
why he has waited so long .
NOW , THEREFORE , be it resolved that based on the above
findings , the application be granted subject to the following
conditions :
The extension of a temporary permit is granted only until
May 1 , 1984 . At that point , the trailer on the property not
conforming to all zoning laws of the Town of Groton must be
removed . As of this notice , there will be no further Variance
granted on this application .
The foregoing resolution was submitted by Mary Decker , seconded
by Don Cummings and adopted by a 3 to 1 vote in favor .
