PUBLIC HEARING
DATE : October 12 , 1982
PRESENT : J . Bell , M . Decker , N . Smith , D . Cummings
WHEREAS , Vickie L . Thayer has filed an application for a variance
of the Zoning Ordinance of the Town of Groton in regard to road frontage
on property owned by Gordon Howells located on Cemetary Lane , and a
public hearing having been held after due notice , and all those desiring
to be heard were heard and the testimony recorded , and
WHEREAS , this Board , from the application , hearing all. parties and
after viewing the premises and neighborhood concerned finds .
1 . Applicant 'habe, given purchase offer on 5 . 68 acres owned by
G . Howells and wife contingent on obtaining a variance to
build on land which does not have road frontage .
2 . A house conforming to all other zoning requirements will be
built on this land if application is granted .
3 . It appears from recent survey map that there is no road
frontage at all but possibly a R . O .W . back to the property .
4 . Applicant is presently negotiating with neighboring owner of
land for a strip of land wide enough for ingress and egress
to 5 . 68 acres ,
5 . If variance is not granted the land will remain valueless .
6 . Based on the , appearnance of many neighboring land owners ,
it appears there is confusion over who has use of R . O . W . and
where their boundaries are - since this is a legal problem
and determination the board felt it had no reason to take it
into consideration on wheter or not a variance was granted .
NOW, THEREFORE , BE IT RESOLVED that the application of Vickie L . Thayer
for the above variance be granted based on the above findings subject to
the following conditions .
1 . That a strip of land measuring at least 25 feet for
road frontage and permitting access to property ,
exclusive of right -of-way , if any , be acquired by
applicant .
2 . That no building will be placed on this 25 foot wide
strip of land .
3 . House to be built will meet all other zoning requirements
The foregoing resolution was submitted by D . Cummings , seconded by M . Decker
and Unanimously adopted .
