HomeMy WebLinkAbout1982-08-17 BOARD OF ZONING APPEALS - TOWN OF GROTON DATE OF MEETING : August 17 , 1982 PRESENT : J . Bell , N . Smith , M . Decker , D . Cummings WHEREAS , Robert and Ruth McFadden have filed an application for a variance of the zoning ordinance of the Town of Groton in regard to the denial of a building permit to build a carport onto their garage which is less than the required 55 feet from the center of the road , and a public hearing having been held after due notice , and all those desiring to be heard were heard and the testimony recorded , and WHEREAS , this Board , from the application , hearing all parties and after viewing the premises and neighborhood concerned finds . 1 . There is now on property an existing garage which was built in 1971 to which a 171 x i71 carport is desired to be attached . 2 . The existing garage is less than the required 551 from the center of road and the carport will be attached directly on garage and will be no closer to center of road . 3 . The carport ' , is necessary to accommodate a new vehicle which will not fit into existing garage . 4 . There is no other area on property where the carport would be feasible . 5 . The addition of the carport will not detract from the property itself or be detrimental to adjacent property owners or surrounding neighbors . 6 . No one appeared in opposition to said application . NOW , THEREFORE , be it resolved that based on the above findings the application of Robert and Ruth McFadden be granted . Foregoing resolution submitted by D . Cummings . Seconded by N . Smith . Unanimously adopted . S+ 1 1 Minutes Board of Zoning Appeals - Town of Groton August 17 , 1982 8 : 00 p . m . Present : Janet Bell , Chairperson , Mary Decker , Donald Cummings , Nile Smith Others : Robert and Ruth McFadden , George Totman , Mr . & Mrs . Ralph Cummings Pursant to Public Notice published in the August `4 , 1982 issue of the Groton Courier , a public hearing was held on the following application : McFadden - for purpose of considering the application of Robert and Ruth McFadden , 793 Salt Rd . , Groton for a variance of the zoning ordinance of the Town of Groton in regard to distance from road right - of- way . The chairperson of the Board opened the hearing by reading the text of the notice . She then asked that any pertinent written comments or reports concerning the appeal be read . There were none . She then asked that Mr . & Mrs . McFadden explain their plea for variance . Mr . McFadden explained , "We have a van too high to set into the garage . We don ' t want to leave it out and have to scrape ice and snow off it . We want it under cover , so have started an extension on the garage . M . Decker asked , " Is most of it constructed? " Mr . McFadden answered , "Yes , I had the lumber and wanted to get it up during vacation . I got a letter from Bob Brown saying that any new construction less than 55 sq . ft . does not apply to the variance . He said we should be able to get a variance because a case came up before like it and they were granted variance . I have 37 ' 5 " . I don ' t know when they changed the rule . " M . Decker asked , " How long ago was your garage constructed ? The zoning ordinance was passed in 1972 . Your garage was there prior to this law? " Mr . McFadden replied , " Yes . " 1 D . Cummings asked , " How long have you been there ? " Mr . McFadden answered , "Eleven years . " J . Bell stated , " In your sketch you have 37 ' to center . " Mr . McFadden replied , " Yes . " N . Smith asked , " How far up to the road is this going to be ? " N The board referred to the sketch and pointed it out . Mr . McFadden stated , " It isn ' t changing anything there . " M . Decker asked , "After you received the letter from Bob Brown , did you proceed ? " Mr . McFadden answered , " I applied for the permit . " G . Totman asked , " Can werget a copy of that letter that Bob Brown gave you ? " Mr . McFadden replied , " Yes , here it is . " J . Bell asked , " George , did you have anything to say? " G . Totman replied , "No , I guess not . " J . Bell stated , " If no one has anything more to question , we will close the hearing and will let you know of our decision very shortly .
