HomeMy WebLinkAbout1981-06-15 -t Town of Groton Zoning Board of Appeals June 15 , 1981 The meetingof the Town of Groton Zoning Board of Appeals g PP was called to order at 8 : 00 p . m . by Gordon Hoy , Chairman . All members were present: Gordon Hoy , Mary Decker , Janet Bell , George . Bushnell , Nile Smith . Others present : Tom Perkins , George Totman , Nancy Ostrander , Ed Trinkle , Robert Batzer , Sr . , Mr . Hoy read notice of the meeting in purpose for considering the application of Sonia L . Morehouse of 27 Smith Rd . , for a variance of the Zoning Ordinance of the Town of Groton in regard- to distance from rear property line . Tom Perkins was introduced as representing Sonia Morehouse , Mr . Hoy explained that this meeting concerns a building moved byoSonia Morehouse , too close to the back property line of Mr . Ed Trinkle . Mr . Hoy then cited Zoning Ordinance Section 804 on Yards , that . . . " no such accessory building shall be built closer than 6 feet from any lot line . . . " Mr . Hoy asked where the building had originally set . Tom Perkins answered that it had set up the road . Tom Perkins stated that the building now sets approximately 5 feet from the back boundary line and the demensions are 10 x 12 . Mr . Trinkle explained that he owns on the south , east , and north of the property . He stated that S . Morehouse had pulled a corner stake and put it back upon his request , planted a flower garden on the property line and pulled 2 locust posts that were on the line . He then requested that due to the fact that S . Morehouse moved the building without a permit , the Board of Appeals deny variance and ,give 30 days for the building to be moved 15 feet from the property line . J . Bell asked the possiblity of E . Trinkle selling that piece of land to S . Morehouse to bring the building into compliance . He answered , " no " . J . Bell asked if S . Morehouse had checked into a building permit before moving the building . Tom Perkins aswered , " yes " . G . Bushnell asked - if the building is on a temporary or a i permanent foundation . T . Perkins answered , " temporary " . M . Decker asked if E . Trinkle was aware of where the building was going to be set at the time it was moved . He answered , " no " . Mr . Batzer stated that he moved the building for S . Morehouse and that once he moved it , the building never stopped until it was set where it stands now . Mr . Hoy asked for further questions . He then explained that Mr . Perkins will be notified by mail as to the decision of the board . Mr . Trinkle also asked for notification of the board ' s decision . Everyone was dismissed for the board to discuss the variance . G . Bushnell moved that the variance request from S . Morehouse be denied and that the building should comply with the Zoning Ordinance which allows it to be 6 feet from the property line . J . Bell seconded the motion . A roll call vote was unanimously in favoroof the motion . Meeting was adjourned at 8 : 45 p . m . 'Respectfully submitted , Juleene Mestler Recorder
