HomeMy WebLinkAbout1980-01-08 a TOWN OF GROTON ZONING BOARD OF APPEALS MEETING Held in the Town Hall , Groton , N . Y . Tuesday - January 8 , 1980 8 : 00 P . M . PRESENT : G . Hoy on Chairman P . Shurtleff F . Pierson Janet Bell Josephine Bell on Recording Clerk Mr . Hoy called the meeting to order at 8 P . M . to reach a decision on Marvin Torok ' s variance request . G . Hoy : Now , before we go too much further , I got a phone call the day after the public hearing from Mr . Benjamin Gebhart who owns a lot of land next to this property that we ' re talking about and he didn ' t receive his notice until that morning that he called me and he owns a lot of land next to the Todd property . At first he asked me if we did give a variance could we deny him the right to put in a trailer and I said we couldn ' t do that and we talked a little bit more and I told him he didn ' t want to build at the front of the property but out back , if he did decide to build , and after I explained that to him he wasn ' t opposed any more to either a trailer or a house . He thought that this wood lot property of Hamlins - on that they would have to go across Todd ' s property to get to their woods but other than that he didn ' t know anything more about it . J . Bell : Oh , — they went through this right of way here ? G . Hoy : Yes . J . Bell : Where does he come in ? G . Hoy : Benson ' s on one side and the road on the other - - is that possible ? F . Pierson : It could be . J . Bell : He owns this , - -right ? And , he owns here ? G . Hoy : Yes , and he even owns right back here on on completely circles the Cotton-Hamlin property . - 1 - J . Bell : Did anybody ever find out who owns this property right here ? The one right next to it ? The only reservation I have , at this point , - - and I never asked them , - - and maybe I just didn ' t hear it , - - but this Albert and Olive Barnes and Sauer - bier - - G . Hoy : They are the other two properties on each side of the right of way of the property we ' re talking about . J . Bell : When did they acquire it and who did they acquire it from? Did Todd sell this property and permit this - - you know -by selling off this land . G . Hoy : Even at that , that ! s kind of immaterial . This is just farm- land out here and this is the right of way and he isn ' t asking to build there . J . Bell : But he needs the frontage . G . Hoy : This is what the Planning Board discussed before NO we some people have had less frontage than this and still had plenty out back . It ' s really a problem to him . J . Bell : And this Neil Todd an an I imagine he got the property from his parents - - after they died . G . Hoy : Yes , that ' s. what I understand . J . Bell : So I ' m not even sure he , himself , could be responsible for this - - possibly his parents caused this . G . Hoy : Right . J . Bell : That was my only thought and other than that I can ' t see any - thing else to bring up . G . Hoy : Anything you would like to say at this time , Frank ? F . Pierson : I think there ' s - - with that larger acreage it would make more taxable base and I think the Planning Board and our Board will have to take into consideration there are more than one lot in the township that is landlocked like this one and as long as the house is built on the main part and not the narrow part . G . Hoy : I think we should specify that - - that the variance is given with the idea in mind the building be out back and not in the front of it . J . Bell : Would you make it a variance to build just one dwelling ? G . Hoy : That ' s all that it could be because if it goes into anything more it would go into some sort of a subdivision , see ? 2 an T J . Bell : Well , - -I ' ll make a motion to grant Mr . Torok the variance providing there ' s no structure built on the 137 ft x 1 , 054 ft right of way and that this frontage will never be diminished . F . Pierson : I second the motion . G . Hoy : Roll call vote an Janet ? J . Bell : Yes , G . Hoy : Frank? F . Pierson : Yes , G . Hoy : And I ' ll vote yes . Motion carried . I guess that covers it for now and we ' ll adjourn this meeting . The meeting adjourned at 8 : 20 P . M . Respectfully submitted , Josephine Bell - 3 -
