FOR THE PURPOSE OF CONSIDERING THE APPLICATION OF
ROBERT A . AND ALLSON J . MANZANO , GROTON CITY ROAD ,
R . D . 25 FOR A VARIANCE OF THE ZONING ORDINANCE OF
THE TOWN OF GROTON IN REGARDS TO FRONT SETBACK LINE .
Held at the Town Hall , Groton , N . Y .
Tuesday , April 12 , 1977 , 8 PM

Mr . Hoy called the hearing to order and read aloud
the Notice of Public Hearing which was published in
the Journal and Courier on March 28 , 1976 , a copy of
which is on file in the Town Clerk ' s office .
G . Hoy : Now the ordinance reads : "Section 1300 . . . . . except as
otherwise provided in this article the lawful use of
any . . . . . . . may be continued even though such use does
not . . . . . . . . . . . . . non- conforming use subject to the pro-
visions of this article remain with the land when title
is transferred . "
Now : "Extension or Enlargement - - a non- conforming use may
not be . . . . . . . . . . . . . . . . except by means of a variance granted
by the Board of Appeals . No . . . . . . . . . . . . . . unless the
regulations of this ordinance . . . . . . . . can be substantially
complied with or the Board determines that a hardship exists . "
Now , Bob , would you like to explain to us just what you want
to do ?
R . Manzano : What we have now , - -we have an existing old barn which is 21 '
x 25 ' and it ' s 33 ' from the center of the road and one corner
is 25 ' from the center of the creek and the other corner is 30 '
from the center of the creek , - - it ' s the one in blue here on
the map . What we would like to do is take that one down and
erect a new garage which would be 40 x 28 and that would sit
45 ' from the road , one corner would be 33 ' from the creek
and the other corner 32 ' from the creek .
G . Hoy : Thank you . I guess that ' s it .
All of you can look at these maps . Now , you ' re pushing it
back just as far as you can without getting into your septic
system which would be a hardship to change .
R . Manzano : Right , that would involve moving it or digging it up or
whatever .
R . Bell : This would just sit over the leach field itself , then ?

R . Manzano : Well , - -no , - - there ' s a dry well there and then there ' s a leach field
beyond that . The tank is here but then there ' s a dry well and
then crushed stone there .
R . Bell : Yes ,
F . Pierson : Is this a new system , - - the leach system , - -has that been put in
in the last few years or just an existing one ?
R . Manzano : When we bought the house there used to be an older system in the
house because I can see that this one was-" put in recently .
F . Pierson : This is an improved one but not in the last 5 years ?
R . Manzano : I ' d say within the last 5 to 10 years , - - it ' s hard to believe
but there are old pipes hanging out of the house this way as
though it was on the neighbors ' lawn or something . I dug a
hole to find out where the septic tank was and found out
where the dry well was and the leach field is right at the end
of it .
G . Hoy : Are there any other questions ?
R . Manzano : The structure that is there now is a two - storey structure and
the new one would be just a single story so it would be a
lower profile . One end of the old one now isn ' t in too good
a shape .
Janet Bell : Can you use it for anything ? Did you use it for a garage
before ?
R . Manzano : We have a car and boat in there now but structurally it ' s not
too strong .
R . Bell : This is your old one , - - the new one would be bigger?
R . Manzano : Right for storage of the car and boat and maybe a workshop
area .
R . Bell : I was just curious as to whether you could shorten it up and
widen it instead .
R . Manzano : Widen it instead?
R . Bell % Maybe shove it out 35 ft . the other way .
R . Manzano : Going this way there ' s a stream there , - - I thought about turning
it this way but that wouldn ' t allow me enough room if I had to
get a truck to the back part of the house . I have a sidewalk
coming from the house extending about 21 ft . so I ' m leaving
enough room between the garage and the sidewalk to get a
vehicle or truck back there . I didn ' t want to lock myself in
because I don ' t have enough room to get anything in around here .
F . Pierson : This is all kind of wet there , too , isn ' t it ?
R . Manzano : Right .

F . Pierson : I see your point there , - -where you really don ' t want to
block yourself off .
R . Manzano : My main concern was if I ever had to do anything about the
septic system I would be land - locked . I ' m leaving somewhere
between 10 to 12 ft . roughly between the garage and the
sidewalk and the sidewalk ends where the yard ends also .
G . Hoy : Any more questions or comments ? Well , if there are no more
questions I ' 11 •close the hearing . Seeing as how you don ' t
have a ride home , Bob , you can sit there if you like or
join the other meeting .
The hearing adjourned at 8 : 10 PM .
G . Hoy : Well , what do you think?
F . Fouts : It ' s 5 ft . further back than the other goes .
G . Hoy : The way I look at it , he ' s trying to improve it all he can
without putting himself into hardship .
J . Bell : I make a motion that the variance be granted since it will
be an improvement of the lot .
F . Fouts : I second the motion .
Roll Call was as follows :

The motion was carried unanimously .
The meeting adjourned at 8 * 20 PM .
