Snell - Zoning Enforcement F . Fouts * Officer * R . Bell' V . Hoy - Recording Clerk * Janet Bell* John Jackson* F . Pierson* Mrs . Jackson* - Denotes those present . Mr . Hoy opened the hearing at 8 PM and read aloud the Notice of Public Hearing on the application of John Jackson which was published in the Journal and Courier on June 16th , 19.769 a copy of which is on file in the Groton Town Clerk ' s Office , G . Hoy : Section 704 , 9, - garages and similar accessory buildings not attached to the principal building may be located in required side yard space but no such accessory building shall be built closer than 6 feet from any lot line , nor have walls higher than 12 feet , without Board of Appeals approval , Would you like to explain your situation to us , Mr . Jackson? J . Jackson : I had it planned to build within 3 feet of� my neighbor ' s land , That is where I want it , and I have his permission , The reason I want to build so close to the line is because of the service pole . G . Hoy : You all have the diagram ; we are talking 3 feet , J . Jackson : Well , actually when I bought this property off of my father , I intended to put a garage there , The side road on Elm Street Extension is a dirt road and it drops off making it quite inconvenient to build it there . I have the uti-lity pole - - it would restrict putting it any closer to the trailer , It could be done if I set it ahead of the pole , The problem is my wellhouse ; it is built underground and I would have to run my driveway over that . It would - 1 - be a problem . We just feel this s the logical and most practical place to pu the garage . Eventually , we will be replacing it with a ranch house . F . Pierson : Are there any alternatives like behind the trailer . J . Jackson : The leachbed is there so it would be impossible . G . Hoy : You said that you had plans to build a ranch - type house . J . Jackson : We kicked the idea around for a long time now . It is just a question of time now . G . Hoy : Have you considered having a garage built right into the ranch house ? J . Jackson : I just never considered building a house with a garage . R . Bell : With the distances that Dana said and you said , having at least 4 feet between the garage and the trailer and a 6 foot clearance beside the other property . . . J . Jackson : I don ' t think we have all that , D . Snell : I ' m sorry that I didn ' t take it .from the line to the pole . . R . Bell : The whole thing is trying to cram the whole thing . . . J . Jackson : I have got to believe that eventually they will do something to that road down their . I don ' t advise putting the driveway into that side road , would you? G . Hoy : But your present drive is off this road right now , J . Jackson : I have room to park my two cars right now which is off that street . F . Pierson : You could put the garage behind the mobile home . To walk around the mobile home isn ' t any further . He hasn ' t got . . . I don ' t think he would have any worse time with a driveway on Elm than on LaFayet . G . Hoy : Your leachbed runs the same way your trailer does ? J . Jackson : Yes it does . I have also got a cherry tree which is right straight below the letter " m " in home . Also an apple tree on the other side of the mobile home in the corner , G . Hoar : The thing that sets in my mind is the garage on the neighboring property , How close is that to the line ? - 2 - J . Jackson : His garage to the line is one foot . D . Snell : You figured that you owned a foot of the garage . J . Bell : So within 4 feet there is going to be two garages ? J . Jackson : Right . His garage is facing north and south and our ' s would be facing east and west . D . Snell : Your ' s would set back of his a little ? J . Jackson : Yes , it would be back further . G . Hoy : Are there any more questions or discussion? F . Fouts : If the pole could be moved , it . . . R . Bell : The pole is no problem to move , D . Snell : He was figuring a little bit on the well too . F . Fouts : You are going to drive by the well any way . J . Jackson : I would have to stagger it to avoid getting into that well . I think probably that will be closer to that mobile home I could honestly say that . As I remember , I wouldn ' t have this problem if it wasn ' t for that trailer and if it wasn ' t for that well . That ' s the way it is . I think that moving the pole would give me the width of the pole but not much of an advantage . I would like very much to put the garage over there . Some discussion was held on this by G . Hoy , D . Snell and others . G . Hoy : We ' re open for a motion , - - R . Bell : I make a motion to deny the variance . F . Pierson : I second the motion . Roll call was as follows : F . Pierson - Yes - F . Fouts - Yes , R . Bell - Yes , J . Bell - Yes , G . Hoy - Yes . The motion was passed unanimously . Mr . Hoy closed the hearing at 8 : 45 P . M .
