PUBLIC HEARING 711 Thomas Ludgate, Applicant/Reputed Owner - 3 Stevens Road - TM #38.-4-5 - Proposed Retail Antique Store The Public Hearing was opened a 7:30 p.m. by Chairman Ed Neuhauser. The Board Secretary read aloud the Legal Notice as published in The Shopper, proof of publication has been placed on file for the record. Chair Neuhauser recognized the applicant who explained that he was seeking approval to operate a retail antique store at this location (former quilt shop/pie place). Chair Neuhauser then asked if there was anyone from the public who wished to speak regarding the proposes store; responses received were as follows: Elizabeth Snvder - Asked if Board had any special concerns about opening this store, concerns that the community could answer. The Board had none. Chair Neuhauser acknowledged receipt of two letters from the public. The first letter was from Larry and Juanita Converse of 59 Gulf Hill Road in McLean, dated 12/7/14, in full support of opening the retail antique store at this location. The second letter (via email) was from Chuck and Nancy Peakcock of the Elm Tree Inn at 2 McLean Road, dated 12/15/14. The Peacocks felt the proposed store would be an "enhancement' to McLean and fully supported approval of the Final Site Plan. With everyone being heard who wished to be heard, Chairman Neuhauser closed the Public Hearing at 7:34 p.m. Page 1 of 5 (T)Groton Planning Board Minutes of Public Hearing&Regular Meeting 18 December 2014 REGULAR MEETING The Regular Meeting of the Town of Groton Planning Board was called to order by Chair Edward Neuhauser at 7:34 p.m. OLD BUSINESS Thomas Ludgate, Applicant/Reputed Owner - 3 Stevens Road - TM #38.-4-5 - Proposed Retail Antique Store Chairman Neuhauser commented that the applicant needed to make sure that items placed outside for sale shall remain on the porch. Mr. Ludgate stated that he would make sure this happened. A motion was then made by Member John Morey that the Town of Groton Planning Board declares itself as Lead Agency under SEQRA for the proposed Retail Store. The motion was seconded by Member Bret Wyllie, with the vote recorded as follows: Ayes: Chairman Neuhauser Nays: None Member Baxendell Member Carey Member Clark Member Morey Member Maloney Hahn Member Wyllie Motion carried. This becomes Action #89 of 2014. Chair Neuhauser then read aloud Part II of the Short Environmental Assessment Form. Negative responses were obtained to all questions in Part II. A motion was then made by Member Barbara Clark that, based on the information and analysis of the SEQR concerning this application, the Town of Groton Planning Board has determined that the proposed action will not result in any significant adverse environmental impact, resulting in a Negative Declaration. The motion was seconded by Member Lisa Maloney Hahn, with the vote recorded as follows: Ayes: Chairman Neuhauser Nays: None Member Baxendell Member Carey Member Clark Member Morey Member Maloney Hahn Member Wyllie Motion carried. This becomes Action #90 of 2014.0 With no further discussion, a motion was then made by Member Monica Carey to approve the Final Site Plan for the proposed Retail Antique Store, as requested, conditioned that all outside materials be placed on the porch. The motion was seconded by Member Wyllie, with the vote recorded as follows: Ayes: Chairman Neuhauser Nays: None Member Baxendell Member Carey Member Clark Member Morey Member Maloney Hahn Member Wyllie Motion carried. This becomes Action #91 of 2014. Page 2 of 5 (T)Groton Planning Board Minutes of Public Hearing&Regular Meeting 18 December 2014 NEW BUSINESS Arlene Blake, Applicant/Reputed Owner - 711 Cobb Street - TM #23.-1-16.3 - Proposed Minor Subdivision Chair Neuhauser recognized the applicant who explained that she would like to sell 20.4± acres of her 24.05±-acre parcel, keeping the remainder for herself. She stated that the survey of the property had been completed, and a copy of the map was attached to the application. The purchaser planned to use the land for hunting purposes. A motion was then made by Member Maloney Hahn that the Town of Groton Planning Board declares itself as Lead Agency under SEQRA for the proposed Minor Subdivision. The motion was seconded by Member Clark, with the vote recorded as follows: Ayes: Chairman Neuhauser Nays: None Member Baxendell Member Carey Member Clark Member Morey Member Maloney Hahn Member Wyllie Motion carried. Page 3 of 5 (T)Groton Planning Board Minutes of Public Hearing&Regular Meeting 18 December 2014 Michael Klimaszewski, Applicant/Reputed Owner - 771 Clark Street Ext. - TM #20.-1-7.2 - Proposed Minor Subdivision Chair Neuhauser recognized the applicant who explained that he would like to sell 30± acres of his 32±-acre parcel, as shown on the maps accompanying the application. Kelly Smith, who lives adjacent to the parcel stated that, in the past, they (she and her brother-in-law) have allowed a farmer to access the subject parcel from the back of their property. Once sold, she said, she wanted it noted that that access will no longer be made available and the new owner will have to access the property from the 111.7± ft. road frontage as indicated on a portion of the tax map accompanying the application. A motion was made by Member Morey that the Town of Groton Planning Board declares itself as Lead Agency under SEQRA for the proposed Minor Subdivision. The motion was seconded by Member Maloney Hahn, with the vote recorded as follows: Ayes: Chairman Neuhauser Nays: None Member Baxendell Member Carey Member Clark Member Morey Member Maloney Hahn Member Wyllie Motion carried. The motion was seconded by Member Carey, with the vote recorded as follows: Ayes: Chairman Neuhauser Nays: None Member Baxendell Member Carey Member Clark Member Morey Member Maloney Hahn Member Wyllie Motion carried. This becomes Action #98 of 2014. ADJOURNMENT At 7:55 p.m., a motion was made by Member Clark to adjourn the meeting.
