PUBLIC HEARING 711 Charles M. Bernhardt, Applicant/Reputed Owner- 515 Old Stage Road - Part of TM #20.-1-36.4 - Site Plan - Proposed Pet Kennel (Spotted Zoo Pet Hotel) At 7:30 p.m., Chairman Ed Neuhauser opened the Public Hearing by reading the Legal Notice as published in the Groton Independent on 8 May 2013. Proof of Publication has been placed on file for the record. Chairman Neuhauser recognized Charles Bernhardt who explained to those present that he was seeking Site Plan approval to have a 40 ft. by 60 ft. pet kennel/pet hotel (pole barn) constructed on the subject property. The business would accommodate any type of pet, mostly dogs and cats, but perhaps other small household pets that needed caring for while the owners were away on vacation, etc. Chair Neuhauser asked if there were any questions from the Board members or the public; there were none. With everyone being heard who wished to be heard, Chairman Neuhauser closed the Public Hearing at 7:32 p.m. REGULAR MEETING The Regular Meeting of the Town of Groton Planning Board was called to order by Chairman Edward Neuhauser at 7:325 p.m. APPROVAL OF MINUTES — 18 APRIL 2013 A motion was made by Member Lisa Maloney Hahn to approve the Minutes of the 18 April 2013 Planning Board meeting, as submitted. The motion was seconded by Member Monica Carey, with the vote recorded as follows: Ayes: Chairman Neuhauser Nays: None Member Carey Member Clark Member Baxendell Member Morey Member Wyllie Member Maloney Hahn Motion carried. Bernhardt, Applicant/Reputed Owner- 515 Old Stage Road - Part of TM #20.-1-36.4 - Site Plan - Proposed Pet Kennel (Spotted Zoo Pet Hotel) With no further discussion, a motion was made by Member John Morey that the Town of Groton Planning Board declares itself as Lead Agency under SEQRA for the proposed Pet Kennel. The motion was seconded by Member Barbara Clark, with the vote recorded as follows: Ayes: Chairman Neuhauser Nays: None Member Carey Member Clark Member Baxendell Member Morey Member Wyllie Member Maloney Hahn Motion carried. This becomes Action #41 of 2013. Chairman Neuhauser read aloud Part II of the Short Environmental Assessment Form. Negative responses were obtained to all questions in Part II. A motion was then made by Member Clark that, based on the information and analysis of the SEQR concerning this application, the Town of Groton Planning Board has determined that the proposed action will not result in any significant adverse environmental impact, resulting in a Negative Declaration. The motion was seconded by Member Carey, with the vote recorded as follows: Ayes: Chairman Neuhauser Nays: None Member Carey Member Clark Member Baxendell Member Morey Member Wyllie Member Maloney Hahn Motion carried. This becomes Action #42 of 2013. With no further discussion, a motion was then made by Member Carey to approve the Final Site Plan for the proposed Pet Kennel, as requested. The motion was seconded by Member Mark Baxendell, with the vote recorded as follows: Ayes: Chairman Neuhauser Nays: None Member Carey Member Clark Member Baxendell Member Morey Member Wyllie Member Maloney Hahn Motion carried. This becomes Action #43 of 2013. Page 2 of 5 (T)Groton Planning Board Minutes of Public Hearing&Regular Meeting 16 May 2013 NEW BUSINESS Clifton Fenner, Applicant/Reputed Owner - NYS Route 222 (Cortland Road) -TM #28.-1-3.2 - Proposed Two-Lot Minor Subdivision Chair Neuhauser recognized the applicant who explained that he wanted to divide the subject 4.68±- acre property approximately in half, resulting in one lot of 2.15± acres and one of 2.53± acres (one of which he said will be sold), as shown on a portion of the tax map accompanying the application. The property will be surveyed "tomorrow morning" he stated. With no further discussion, a motion was made by Member Bret Wyllie that the Town of Groton Planning Board declares itself as Lead Agency under SEQRA for the proposed Minor Subdivision. The motion was seconded by Member Morey, with the vote recorded as follows: Ayes: Chairman Neuhauser Nays: None Member Carey Member Clark Member Baxendell Member Morey Member Wyllie Member Maloney Hahn Motion carried. This becomes Action #44 of 2013. Chairman Neuhauser then read aloud Part II of the Short Environmental Assessment Form. Negative responses were obtained to all questions in Part II. This becomes Action #46 of 2013. Page 3 of 5 (T)Groton Planning Board Minutes of Public Hearing&Regular Meeting 16 May 2013 Steve Simons, Applicant/Reputed Owner - 421 Clark Street Ext. -TM #121.-1-13 - Proposed Two-Lot Minor Subdivision Chair Neuhauser recognized the applicant who explained that he wanted to divide the subject 2.066±- acre property approximately in half, resulting in two one-acre+ lots, as shown on an annotated 1986 survey map (by G. Bruce Davison, L.S.) accompanying the application. The house lot will be sold; the barn lot will be retained. Each proposed lot will have 250 feet of road frontage. With no further discussion, a motion was made by Member Morey that the Town of Groton Planning Board declares itself as Lead Agency under SEQRA for the proposed Minor Subdivision. The motion was seconded by Member Wyllie, with the vote recorded as follows: Ayes: Chairman Neuhauser Nays: None Member Carey Member Clark Member Baxendell Member Morey Member Wyllie Member Maloney Hahn Motion carried. Page 4 of 5 (T)Groton Planning Board Minutes of Public Hearing&Regular Meeting 16 May 2013 OTHER MATTERS • Training: CEO Coats reminded those present of upcoming training being held by the Town of Spafford regarding the SEQR process, to be held on the 23ra • Applications: CEO Coats advised the Board that the Agenda for the June meeting is filling up; he gave an overview of what will be coming up. • Town Attorney Victoria Monty advised the Board that Nixon Peabody LLP, Applicant for a proposed Verizon cell tower, did not have the additional items that the Board had requested at last month's meeting. She had talked with a representative who hoped the Board would schedule a Public Hearing for June. Chairman Neuhauser stated that the Board needed a Preliminary Site Plan first. A motion was then made by Member Maloney Hahn that the continued Site Plan Review of the proposed Verizon cell tower be postponed until the 20 June 2013 meeting of the Groton Town Planning Board to allow the applicant's representative to be present. The motion was seconded by Member Carey, with the vote recorded as follows: Ayes: Chairman Neuhauser Nays: None Member Carey Member Clark Member Baxendell Member Morey Member Wyllie Member Maloney Hahn Motion carried. ADJOURNMENT At 7:55 p.m., a motion was made by Member Clark to adjourn the meeting. The motion was seconded by Member Wyllie, with all members present voting in favor. J E.
