Applicants/Christine Kves, Reputed Owner - 956 Salt Road -TM #17.-1-4- Minor Subdivision Chairman Neuhauser opened the Public Hearing at 7:30 p.m. by reading the Legal Notice as published in the Groton Independent on 8 January 2013. Proof of Publication has been placed on file for the record. Chairman Neuhauser recognized the applicant who explained to everyone present what he was planning to do (reference is made to the 20 December 2012 Planning Board Minutes for specifics). Chair Neuhauser then asked if there was anyone from the public who wished to speak on this application; there was no one. With everyone heard who wished to be heard, Chair Neuhauser closed the Public Hearing at 7:34 p.m. 11 REGULAR MEETING The Regular Meeting of the Town of Groton Planning Board was called to order by Chairman Edward Neuhauser at 7:345 p.m. APPROVAL OF MINUTES — 20 DECEMBER 2012 A motion was made by Member John Morey to approve the Minutes of the 20 December 2012 Planning Board meeting, as submitted. The motion was seconded by Member Monica Carey, with the vote recorded as follows: Ayes: Chairman Neuhauser Nays: None Member Carey Member Clark Member Baxendell Member Morey Member Wyllie Member Hahn Motion carried. This becomes Action #1 of 2013. Page 1 of 4 (T)Groton Planning Board Minutes of Public Hearing&Regular Meeting 17 January 2013 OLD BUSINESS Floyd (Dusty) Kyes & Rich Teeter, Jr., Applicants/Christine Kyes, Reputed Owner - 956 Salt Road -TM #17.-1-4- Minor Subdivision Chairman Neuhauser acknowledged receipt of a letter from the Tompkins County Department of Planning stating the proposed subdivision had no State- or County-wide impact; therefore, the application was being returned to this Board for local determination. A copy of this letter has been placed on file for the record. The application was also submitted to the Town of Summerhill as a courtesy. With no further questions from the Board, a motion was made by Member Barbara Clark that for the purpose of the State Environmental Quality Review concerning this application, the Town of Groton Planning Board hereby declares itself as Lead Agency. The motion was seconded by Member Lisa Maloney Hahn, with the vote recorded as follows: Ayes: Chairman Neuhauser Nays: None Member Carey Member Clark Member Baxendell Member Morey Member Wyllie Member Maloney Hahn Motion carried. This becomes Action #2 of 2013. Chairman Neuhauser read aloud Part II of the Short Environmental Assessment Form. Negative responses were obtained to all questions in Part II. A motion was then made by Member Carey that, based on the information and analysis of the SEQR concerning this application, the Town of Groton Planning Board has determined that the proposed action will not result in any significant adverse environmental impact, resulting in a Negative Declaration. The motion was seconded by Member Clark, with the vote recorded as follows: Ayes: Chairman Neuhauser Nays: None Member Carey Member Clark Member Baxendell Member Morey Member Wyllie Member Maloney Hahn Motion carried. This becomes Action #3 of 2013. With no further discussion, a motion was made by Member Clark to approve the Minor Subdivision, as requested. The motion was seconded by Member Mark Baxendell, with the vote recorded as follows: Ayes: Chairman Neuhauser Nays: None Member Carey Member Clark Member Baxendell Member Morey Member Wyllie Member Maloney Hahn Motion carried. This becomes Action #4 of 2013. Page 2 of 4 (T)Groton Planning Board Minutes of Public Hearing&Regular Meeting 17 January 2013 NEW BUSINESS Jeffrey Warner, Applicant/Reputed Owner - 540 Pleasant Valley Road - Part of TM #32.-1-43 - Minor Subdivision & Flag Lot Chairman Ed Neuhauser recognized the applicant who was seeking approval (after-the-fact) to subdivide this parcel which was on both sides of the road, as shown on a portion of the tax map accompanying this application. The road would be the subdividing line, and a new lot was created (#35.1-30) that had a 2221 ft. pole with 40± feet of road frontage. CEO Coats advised the Board that approval of the flag lot should have been done a long time ago but never came before the Planning Board; the applicant filed the subdivision without a map and approval needed to be done to update the Town's records and "save problems way down the road." With no further questions from the Board, a motion was made by Member Morey that for the purpose of the State Environmental Quality Review concerning this application, the Town of Groton Planning Board hereby declares itself as Lead Agency. The motion was seconded by Member Baxendell, with the vote recorded as follows: Ayes: Chairman Neuhauser Nays: None Member Carey Member Clark Member Baxendell Member Morey Member Wyllie Member Maloney Hahn Motion carried. Page 3 of 4 (T)Groton Planning Board Minutes of Public Hearing&Regular Meeting 17 January 2013 OTHER MATTERS Town Code Enforcement Officer Gary Coats reported that: • One application "coming in next month" is a four-apartment building (former pie place in McLean) that never received Town approval. It has a lot of fire issues. Electric for three apartments is being run off extension cords from one of the apartments. • There's an application for a welding shop that is not farm-related on Sovocool Hill Road, even though it is on a farm; therefore, it needs Board approval. • There's a bed and breakfast proposed for a landlocked parcel which may end up before the Planning Board. Should go to ZBA first. ADJOURNMENT At 7:55 p.m., a motion was made by Member Carey to adjourn the meeting. The motion was seconded by Member Wyllie, with all members present voting in favor. J E.
