REGULAR MEETING The Regular Meeting of the Town of Groton Planning Board was called to order by Chairman Edward Neuhauser at 7:30 p.m. APPROVAL OF MINUTES — 17 JANUARY 2013 A motion was made by Member Monica Carey to approve the Minutes of the 17 January 2013 Planning Board meeting, as submitted. The motion was seconded by Member Bret Wyllie, with the vote recorded as follows: Ayes: Chairman Neuhauser Nays: None Member Carey Member Clark Member Baxendell Member Morey Member Wyllie Member Maloney Hahn Motion carried. This becomes Action #8 of 2013. OLD BUSINESS - NONE NEW BUSINESS James Houston, Applicant/Marlin Houston, Reputed Owner - 718 Sovocool Hill Road - TM #25.- 1-24.1 - Site Plan Review- Proposed Metal Fabricating/Welding Shop Chairman Neuhauser recognized Marlin Houston, representing the applicant who was seeking approval to open up a metal fabrication shop at this location in an existing building; he stated that the applicant had already started it. A majority of the work is done offsite. There will be no signs, and there is plenty of parking. Chairman Neuhauser advised the applicant that this application will require a Public Hearing and a Life Safety Inspection. CEO Gary Coats explained that it had been agreed upon that someone else would be performing the LSI, as Mr. Houston did not want it done by him. If inspected by the person Page 1 of 7 (T)Groton Planning Board Minutes of Regular Meeting 21 February 2013 who occasionally acts on CEO Coats'behalf (Mr. Anderson, an employee of the Village of Groton), there would be no charge to the applicant; however, if someone else (not an employee of the Village) was hired, the applicant would be charged a fee. The inspection would be done before the Public Hearing. With no further questions from the Board, a motion was made by Member Carey to accept the Preliminary Site Plan for the proposed metal fabricating/welding shop, as submitted, with the Public Hearing set for 21 March 2013 at 7:30 p.m. The motion was seconded by Member Wyllie, with the vote recorded as follows: Ayes: Chairman Neuhauser Nays: None Member Carey Member Clark Member Baxendell Member Morey Member Wyllie Member Maloney Hahn Motion carried. This becomes Action #9 of 2013. James W. Lockwood, Jr.. Applicant/Reputed Owner- 625-633 Old Stage Road - TM #20.-1-40.4 - Site Plan Review - Proposed Minor Subdivision w/Flag Lot Chairman Neuhauser recognized the applicant who was seeking approval to subdivide his 8.46±-acre parcel into two lots; the piece being subdivided is approximately 1.5 acres, as shown on a portion of the tax map accompanying the application. Mr. Lockwood stated that the newly created lot would be a flag lot with a 40 ft. wide pole running a distance of 450± feet to the 1±-acre building lot (190 ft. by 230 ft., more or less) at the rear of the subject parcel. This lot, he said, would be for his daughter. Chair Neuhauser commented that there needs to be at least one acre in the back. With no further discussion, a motion was made by Member John Morey that the Town of Groton Planning Board hereby declares itself as Lead Agency under SEQRA for a proposed Minor Subdivision w/Flag Lot. The motion was seconded by Member Lisa Maloney Hahn, with the vote recorded as follows: Ayes: Chairman Neuhauser Nays: None Member Carey Member Clark Member Baxendell Member Morey Member Wyllie Member Maloney Hahn Motion carried. This becomes Action #10 of 2013. Chairman Neuhauser then read aloud Part II of the Short Environmental Assessment Form. Negative responses were obtained to all questions in Part II. A motion was then made by Member Barbara Clark that, based on the information and analysis of the SEQR concerning this application, the Town of Groton Planning Board has determined that the proposed action will not result in any Page 2 of 7 (T)Groton Planning Board Minutes of Regular Meeting 21 February 2013 significant adverse environmental impact, resulting in a Negative Declaration. The motion was seconded by Member Maloney Hahn, with the vote recorded as follows: Ayes: Chairman Neuhauser Nays: None Member Carey Member Clark Member Baxendell Member Morey Member Wyllie Member Maloney Hahn Motion carried. This becomes Action #11 of 2013. With no further discussion, a motion was made by Member Carey to approve the Minor Subdivision, as requested, conditioned upon receipt of the required survey map. The motion was seconded by Member Maloney Hahn, with the vote recorded as follows: Ayes: Chairman Neuhauser Nays: None Member Carey Member Clark Member Baxendell Member Morey Member Wyllie Member Maloney Hahn Motion carried. This becomes Action #12 of 2013. Douglas VanBenschoten. Applicant/Samuel lis Cheryl Rose, Reputed Owners - Between Locke Road lis Chipman Cors. Road -TM #16.-1-32.42 - Minor Subdivision Chairman Neuhauser recognized the applicant who was purchasing 4.3± acres from the adjacent Rose property (128.78± A.); the purchased parcel would be combined with the applicant's land. With no further questions from the Board, a motion was made by Member Clark that for the purpose of the State Environmental Quality Review concerning this application, the Town of Groton Planning Board hereby declares itself as Lead Agency. The motion was seconded by Member Morey, with the vote recorded as follows: Ayes: Chairman Neuhauser Nays: None Member Carey Member Clark Member Baxendell Member Morey Member Wyllie Member Maloney Hahn Motion carried. Road - Part of TM #16.-1-32.42. 32.41 lis 4.62 - Boundary Line Change Chairman Neuhauser recognized the applicant who was seeking approval to combine the subject three parcels into one parcel, as shown on the map accompanying the application. Member Carey asked about the easement shown, and Mr. VanBenschoten explained the neighbor wanted this easement so he could take care of any brush that grows along there. With no further questions from the Board, a motion was made by Member Morey that for the purpose of the State Environmental Quality Review concerning this application, the Town of Groton Planning Board hereby declares itself as Lead Agency. This becomes Action #18 of 2013. Jalenia Mead, Applicant/Reputed Owner - 204 McLean Road - Part of TM #39.-1-28 - Site Plan - Proposed Dog Kennel Chairman Neuhauser recognized the applicant who explained that she is seeking approval to operate a day care for dogs (Those Krazy Kanines). She has 22 kennels that were existing when she purchased the property, but stated she only uses "a few" of them. Chair Neuhauser advised that there would have to be a Public Hearing held and there would be a fee. Member Morey asked if anyone would have to back out onto the highway, and Mrs. Mead responded that there was plenty of room to turn around on the property. With no further questions from the Board, a motion was made by Member Maloney Hahn to accept the Preliminary Site Plan for the proposed dog kennel (Those Krazy Kanines, LLC), as requested, with a Public Hearing to be held immediately following the first public hearing (Houston) on 21 March 2013. The motion was seconded by Member Carey, with the vote recorded as follows: Ayes: Member Carey Nays: None Member Clark Member Baxendell Member Morey Abstain: Chairman Neuhauser Member Wyllie Member Maloney Hahn Motion carried. This becomes Action #20 of 2013. Selection of Planning Board Vice-Chair for 2013 A motion was made by Chairman Neuhauser to select Monica Carey as Vice-Chair of the Town of Groton Planning Board for 2013. The motion was seconded by Member Baxendell, with the vote recorded as follows: Ayes: Chair Neuhauser Nays: None Member Clark Member Baxendell Member Morey Abstain: Member Carey Member Wyllie Member Maloney Hahn Motion carried. This becomes Action #21 of 2013. Selection of Planning Board Meeting Day/Time A motion was made by Member Carey to select the third Thursday of each month, 7:30 p.m., as the Regular Meeting day/time of Town of Groton Planning Board for 2013. The motion was seconded by Member Clark, with the vote recorded as follows: Ayes: Chairman Neuhauser Nays: None Member Carey Member Clark Member Baxendell Member Morey Member Wyllie Member Maloney Hahn Motion carried. This becomes Action #22 of 2013. OTHER MATTERS Town Code Enforcement Officer Gary Coats reported that: • A four-apartment building (former pie place in McLean) that never received Town approval is "still up in the air." As reported at last month's Planning Board meeting, it has a lot of fire issues. Electric for three apartments is being run off extension cords from one of the apartments.
