OF APPEALS PUBLIS HEARING HELD IN
THE TOWN HALL , GROTON , N . Y .
THURSDAY , JULY 6 , 1972 AT 7 : 30 P . M .

This public hearing was called on behalf of Rodney L . Doubleday and Esther
Doubleday for a variance of the zoning ordinance side yard restrictions of
a minimum of 8 feet to 6 . 6 feet .
J . Wargo : As chairman of the Board , I call this hearing to order on
behalf of the Doubledays . The Notice for this hearing was
published in the official Town newspaper , The Journal . and
Courier , on June 21 , 1972 .
(Mr . - Wargo) then read the Public Notice in this respect
aloud and copies of the application and other pertinent
papers in connection with this request are hereto attached
and made a part of these minutes . )
J . Wargo : Mr . Doubleday , have you anything to say ?
Mr . Doubleday : You have my case .
L . Volpicelli : Is this the new house going up past the Elm Tree on the way
to Cortland ?
Mr . Doubleday : Yes .
L . Volpicelli : Construction is well underway .
Mr . Doubleday : Y'ou turn the rain off long enough , I ' ll get it done .
G . Lawrence : When was the construction started ?
Mr . Doubleday : June 1st .
D . Snell : When I was over there the basement wall was all up , and then
they called me .
Mr . Doubleday : I asked for the variance as per my application . According to
the zoning ordinance must have a public hearing to gain 2 fte
to build an 18 ft . garage or to be within your limitations .
L . Volpicelli : If the house had been set parallel to the road , you would have
had your 2 ft .

Mr . Doubleday : I could have had to 2 ft . towards the hedges and yard , too .
L . Volpicelli : Why didn ' t you?
Mr . Doubleday : I wanted the house at the angle it is there . The existing
property next door is at the same angle only in the opposite
direction . Therefore to have it look correctly on the road
it ' s angled like this . If you notice there ' s a slight curve
in the road in that area . It ' s not a straight road there .
They make it a raceway but it ' s still not a straight road .
G . Lawrence : 18 ft . is that a two -car garage ?
Mr . Doubleday : Yes , sir .
J . Wargo : Does anybody else have anything they want to say ?
G . Hoy : If you have to go back to 8 ft . you won ' t have enough room
for a two - car garage ?
Mr . Doubleday : That ' s right .
J . Wargo : Has anybody else any other comments ?
G . Hoy : Is there a lot on the other side of you there ?
Mr . Doubleday : According to your surveying map it ' s roughly 365 ft , to the
next existing building and the sewage comes down through
there , - -couldn ' t build next door to me if you wanted to be-
cause of the sewage problems .
G . Lawrence : So no one could build in between you and the next house ?
Mr . Doubleday : No , the Board of Health wouldn ' t let anyone .
Some discussion was held on this by Mr . Doubleday and the
Board members .
G . Hoy : How close is it to the house on the other side of you ?
Mr . Doubleday : 16 feet , - - 16 ft . plus 75 ft . , - - it ' s a cement wall . No
property could be built between because , according to your
rules and regulations , wouldn ' t have enough frontage for
building lots in-between .
J . Wargo : Anybody have any other questions or comments ? If not , I ' ll
close the hearing then and we can decide this matter .
The Members of the Zoning Board of Appeals then discussed
the pros and cons regarding this variance .

L . Volpicelli : Can we ask Mr . Snell his reason for turning this down ? Was
it because it didn ' t comply with the 18 ft . ?
D . Snell * I turned it down because it was 6 . 6 ft . instead of 8 ft . but
I personally don ' t see what harm it does .
L . Volpicelli : That ' s what we wanted to know . Why a public hearing . for such
a minor matter ?
Mr . Doubleday : Because your zoning regulations state that for such and such
you have to have a hearing .
J . Wargo : In this Town , - - it doesn ' t mean too much right now .
Mr . Doubleday : It ' s going to , eventually .
J . Wargo : Yes , - - when it gets more crowded .
G . Hoy : You put up a wall '?
Mr . Doubleday : Not for the garage , - - I ' m waiting for a decision from this
Board before I do anything . It ' s your move .
L . Volpicelli : I make the motion that Mr . Doubleday be granted the variance
requested .
R . Bell : I second the motion .
A Roll Call vote on this followed :
Ayes : L . Volpicelli George Lawrence Gordon Hoy Richard Bell J . Wargo .
The motion was carried unanimously .

This public hearing was called on behalf of Ella M . Stevens for a variance
of the zoning ordinance front yard restrictions of 30 ft . to 13 ft . and
Notice of same was published in the official Town newspaper , the Journal
and Courier , on June 21 , 1972 .
J . Wargo opened the hearing and since Mrs . Stevens wasn ' t present or any
members of the general public , and the members of the Board wanted to get
more information before passing on this application , he then , on the advice
of Mr . Bucko , adjourned the hearing until 7 : 30 P . M . Tuesday , July 18 , 1972 ,
and Mrs . Stevens is to be notified to this effect and whatever other steps
are necessary to take care of this adjournment .

This public hearing was called on behalf of Jesse G . Bailey for a variance of
the zoning ordinance front yard restrictions of a minimum of 30 ft . to 10 ft .
and Notice of same was published in the official Town newspaper , the Journal
and Courier , on June 21 , 1972 . Jesse G . Bailey , or any members of the general
public , did not attend .
Mr . Wargo opened the hearing as follows :
J . Wargo : Dana , do you have anything to say about the Bailey ' s variance ?
D . Snell : No , not particularly . It ' s going to be close to the road but
this is a hardship on them if it isn ' t granted with him in a
wheelchair .
J . Wargo : Are they elderly people ?
H . Dow : I ' d say in their 601s . He ' s had heart attacks over the last
few years also .
J . Wargo : Has anyone else any other comments ?
D . Snell : The garage right next to their place is built as close to the
road as his would be , or closer . In fact there are two of
them , - - the other one right below him .
H . Dow : They ' ve been there for some time .
J . Wargo : If there aren ' t any more comments , the hearing is closed and
the meeting is now open . Does anybody want to make a motion
or comments or anything on the Bailey variance ?
H . Dow : If I understand it correctly , this is more or less of an
open ramp and they want to build something similar to a
carport shelter over the ramp so the rain won ' t fall on the
ramp and freeze .
G . Hoy : What is the distance from the center of the road to the edge
of the carport ?
H . Dow : If they bring this carport out in line with their foremost
part of the building , - - do you have a picture there ?

G . Hoy : Yes .
H . Dow : Let ' s see . If they bring it out , will be 10 ft . from the
edge of the road and the ramp is right alongside of the
house here so , - - to get the shelter out over the ramp , - -
gives them , - -
G . Hoy : The ramp comes down here and back here to the side of the
car ?
H . Dow : So they can unload him where it is dry . So the ramp would
be in an L - shape ,
G . Hoy : If you ask me , this would be a help from where they have
had their car , - -right out on the edge of the road all
winter ,
J . Wargo : Does someone want to make a motion ?
G . Hoy : I make the motion that the Baileys be granted the variance
as requested .
G . Lawrence : I second the motion ,
