PUBLIC HEARING #1 Donna Schlesier, Applicant/Reputed Owner - 112 Chipman Corners Road - TM #16.-1-32.31 - Proposed Seasonal Plant Nursery & Sales (Reference is made to the Planning Board's Minutes of 19 August 2010 regarding this matter.) Chairman Ed Neuhauser opened the Public Hearing at 7:30 p.m. The Board Secretary read aloud the Public Hearing Notice as published in The Shopper on 7 September 2010; Proof of Publication has been placed on file for the record. Chairman Neuhauser recognized the applicant who explained to everyone present that she was seeking approval to establish a small nursery (Freedom Farms Nursery) for plants, trees, produce, etc., and eventually have a greenhouse. Parking would be diagonally, as shown on the sketch accompanying the application. Chair Neuhauser then asked if there was anyone present who would like to make any comments regarding this application; there was no one who wished to comment. With everyone being heard who wished to be heard, Chairman Neuhauser closed the Public Hearing at 7:34 p.m. PUBLIC HEARING #2 Mitchell S. Metzgar, Applicant/Reputed Owner- 470 Locke Road - TM #16.-1-4.813 - Proposed Short-Term Housing Rental (Reference is also made to the Planning Board's Minutes of 19 August 2010 regarding details of this matter.) Chairman Neuhauser recognized the applicant who explained to everyone present that he had purchased this 23-acre property improved with a three-bedroom two-bath residence (700 ft. off the road) which he has since refurbished to provide transient, short-term rental housing (Peg Mill Retreat), to be located as shown on a portion of the tax map accompanying his application. He planned to rent it to those needing "family type" housing for short-term use, e.g., corporate officials, Cornell University/Ithaca College persons visiting area for scheduled events, etc. Page 1 of 4 (T)Groton Planning Board Minutes of Public Hearings&Regular Meeting 16 September 2010 Chair Neuhauser then asked if there was anyone present who would like to make any comments regarding this application; there was no one who wished to comment. With everyone being heard who wished to be heard, Chairman Neuhauser closed the Public Hearing at 7:36 p.m. REGULAR MEETING The Regular Meeting of the Town of Groton Planning Board was called to order at 7:37 p.m. by Chairman Ed Neuhauser. APPROVAL OF MINUTES — 19 AUGUST 2010 A motion was made by Member Janice Haines to approve the Minutes of the 19 August 2010 Planning Board meeting, as submitted. The motion was seconded by Member Mary Gloster, with the vote recorded as follows: Ayes: Chair Neuhauser Nays: None Member Baxendell Member Clark Absent: Member Carey Member Gloster Member Haines Motion carried. This becomes Action #32 of 2010. OLD BUSINESS Donna Schlesier, Applicant/Reputed Owner - 112 Chipman's Corners Road - TM #16.-1-32.31 - Final Site Plan Review for Proposed Seasonal Nursery & Sales As requested by Chairman Neuhauser, the Board Secretary read aloud Part II of the Short Environmental Assessment Form. Negative responses were obtained to all questions in Part II. A motion was then made by Member Mark Baxendell that the proposed action will not cause any significant adverse environmental impact, resulting in a Negative Declaration. The motion was seconded by Member Barbara Clark, with the vote recorded as follows: Ayes: Chair Neuhauser Nays: None Member Baxendell Member Clark Absent: Member Carey Member Gloster Member Haines Motion carried. This becomes Action #33 of 2010. With no further discussion, a motion was made by Member Baxendell to approve the Final Site Plan for the proposed seasonal nursery, as requested, with the hours of operation from 9 a.m. to 7 p.m., seven days a week. The motion was seconded by Member Clark, with the vote recorded as follows: Ayes: Chair Neuhauser Nays: None Member Baxendell Member Clark Absent: Member Carey Member Gloster Member Haines Motion carried. This becomes Action #36 of 2010. NEW BUSINESS Deborah S. Satterly, Applicant/Reputed Owner - 930 Spring Street Extension - TM #22.-1-16.1 - Boundary Line Change Chairman Neuhauser recognized the applicant who explained to the Board that she would like an adjacent lot (Lot 3 of a Minor Subdivision approved on 18 March 2010, then owned by Rodney and Barbara Mott, Part of TM #22.-1-16.2), now owned by the applicant, to be combined with her lot, TM #22.-1-16.1, as shown on a portion of the tax map accompanying her application. Chair Neuhauser acknowledged that "under 6 NYCRR Part 617.5(c)(10), (12) or (13) of the State Environmental Quality Review Law, the proposed action is a Type II action and is determined not to have a significant impact on the environment, or is otherwise precluded from environmental review under the Environmental Conservation Law, Article 8." A motion was then made by Member Gloster to approve the Boundary Line Change, as requested. The motion was seconded by Member Haines, with the vote recorded as follows: Ayes: Chair Neuhauser Nays: None Member Baxendell Member Clark Absent: Member Carey Member Gloster Member Haines Motion carried. This becomes Action #37 of 2010. Page 3 of 4 (T)Groton Planning Board Minutes of Public Hearings&Regular Meeting 16 September 2010 OTHER MATTERS Chairman Neuhauser asked if there was any other business to be brought before the Board. Responses were as follows: • Supervisor Morey advised that the Town Board had advertised the vacancy on the Planning Board and two applications have been received. The Planning Board will be reviewing them and making their recommendation to the Town Board for filling the vacancy. • Supervisor Morey reminded the Board that it was budget time and they should make any requests known. A Public Hearing will be held on 19 October 2010. • Supervisor Morey stated everyone on the Planning Board should have received a copy of the proposed Land Use & Development Code. Please get any questions or comments to him as soon as possible. • Supervisor Morey reported that he had not heard nor received any complaints regarding the recently held concert at Robert Eckard's. • CEO Coats reported that the signs on Route 222 (John Beck property) are still an ongoing problem and are in clear violation of the Zoning Code. No more than two signs are allowed with a total square footage of 50 SF. Owner has been served by Sheriffs Department. Judge gave violator 45 days to file motions, etc. Will update the Planning Board at October's meeting. • CEO Coats reported that the proposed zoning will allow the waiving of a public hearing for certain things. • CEO Coats reported that, under the new regulations, applicants are to explain their proposed subdivisions to the Planning Board at the first meeting, with paperwork to be presented at a second meeting. ADJOURNMENT At 8 p.m., a motion was made by Member Clark to adjourn the meeting. The motion was seconded by Member Haines, with all members present voting in favor. Joan E.
