The Regular Meeting of the Town of Groton Planning Board was called to order at 7:30 p.m. by Chairperson Barbara Clark. PUBLIC HEARING Stanley Tucker, Applicant/Reputed Owner - 39 Townline Road - TM # 24.-1-1.1 - Site Plan Review for Proposed Gun Shop Board Secretary Joan Fitch read aloud the Public Hearing Notice which had been duly published; Proof of Publication has been placed on file for the record. Chair Clark recognized the applicant who explained to those present that he was seeking approval to put a gun shop in the basement of his existing house. The shop would be open only part-time, that he might buy and sell guns, there would be no target range, and no shooting. Chair Clark asked if there was anyone present who wished to speak on the subject application; there was no one. With everyone being heard who wished to be heard, the Public Hearing was closed at 7:35 p.m. REGULAR MEETING The Regular Meeting of the Town of Groton Planning Board was called to order at 7:36 p.m. by Chairperson Barbara Clark. APPROVAL OF MINUTES — 18 JUNE 2009 A motion was made by Member Mark Baxendell to approve the Minutes of the 18 June 2009 meeting of the Town of Groton Planning Board, as submitted. The motion was seconded by Member Ed Neuhauser, with the vote recorded as follows: Ayes: Chair Clark Nays: None Member Baxendell Member Carey Absent: Member Donlick Member Haines Member Gloster Member Neuhauser Motion carried. This becomes Action #18 of 2009. Page 1 of 3 (T)Groton Planning Board Minutes of Public Hearing&Regular Meeting 16 July 2009 OLD BUSINESS Stanley Tucker, Applicant/Reputed Owner - 39 Townline Road - TM # 24.-1-1.1 - Site Plan Review for Proposed Gun Shop At the request of the Chair, Board Secretary Fitch read aloud Part II of the Short Environmental Assessment Form. Negative responses were obtained to all questions in Part II. A motion was then made by Member Monica Carey that the proposed action, based on the information submitted, will not cause any significant adverse environmental impact, resulting in a Negative Declaration under SEQRA. The motion was seconded by Member Baxendell, with the vote recorded as follows: Ayes: Chair Clark Nays: None Member Baxendell Member Carey Absent: Member Donlick Member Haines Member Gloster Member Neuhauser Motion carried. This becomes Action #19 of 2009. With no further comments or questions, a motion was made by Member Neuhauser to approve the Final Site Plan for the proposed gun shop, as requested. The motion was seconded by Member Janice Haines, with the vote recorded as follows: Ayes: Chair Clark Nays: None Member Baxendell Member Carey Absent: Member Donlick Member Haines Member Gloster Member Neuhauser Motion carried. This becomes Action #20 of 2009. NEW BUSINESS James R. Henry, Attorney, Applicant/Susan Harrison, Reputed Owner - 1031 Cobb Street - TM #s 14.-1-6.2 & 7.11 - Flag Lot Subdivision Chair Clark recognized the owner's rep, Attorney James Henry, who explained that Ms. Harrison was seeking approval of a Flag Lot Subdivision, dividing the two tax map parcels into a one-acre lot and a 1.61± acre lot. He noted that consolidation of these two parcels into one parcel had previously been approved in 2006, but the Tompkins County Department of Assessment would not accept this until all "back" taxes were paid; this, he said, will be done upon the sale of the one-acre lot and house. The proposed division was shown on both a copy of the tax map, and a portion of a copy of a "Survey Map" updated in 2006 which accompanied the application. Parcel 1 is the one-acre conventional lot; Parcel 2 would be the proposed flag lot with a 20-foot pole. Because of the division, he stated, variances will be required for the front/side yard setbacks. He asked the Board if he could receive approval for the flag lot conditioned upon receipt of the required variances from the Zoning Board of Appeals. Chair Clark acknowledged that "under 6 NYCRR Part 617.5(c)(10), (12) or (13) of the State Environmental Quality Review Law, the proposed action is a Type II action and is determined not to have a significant impact on the environment, or is otherwise precluded from environmental review under the Environmental Conservation Law, Article 8." Page 2 of 3 (T)Groton Planning Board Minutes of Public Hearing&Regular Meeting 16 July 2009 With no further comments or questions, a motion was made by Member Carey to approve the Flag Lot Subdivision, conditioned upon receiving the required variance(s) from the Town of Groton Zoning Board of Appeals. The motion was seconded by Member Baxendell, with the vote recorded as follows: Ayes: Chair Clark Nays: None Member Baxendell Member Carey Absent: Member Donlick Member Haines Member Gloster Member Neuhauser Motion carried. This becomes Action #21 of 2009. ADJOURNMENT At 7:55 p.m., a motion was made by Member Neuhauser to adjourn the meeting. The motion was seconded by Member Haines, with all members present voting in favor. Joan E.
