Architectural Design Business
Chair Monica Carey opened the Public Hearing for the proposed business at 7:30 p.m.; Board
Secretary Fitch read aloud the Legal Notice as published on 6 September 2006. Proof of Publication
has been placed on file for the record.
Chair Carey asked if there was anyone present who wished to comment about the proposed landscape
architectural design business (reference August Planning Board Minutes). There was no one.
With everyone being heard who wished to be heard, Chairperson Carey
closed the Public Hearing at 7:32 p.m.
REGULAR MEETING
Chairperson Carey opened the Regular Meeting of the Planning Board at 7:33 p.m.
OLD BUSINESS
Christine E. Hughes, Applicant/RO - 155 Brown Road - TM #34.-1-26.1 - Site Plan Review -
Proposed Landscape Architectural Design Business
With no further discussion, motion was made by Member Mark Baxendell to approve the Site Plan for
the proposed Landscape Architectural Design business, as requested. The motion was seconded by
Member Mary Gloster, with the vote recorded as follows:

This becomes Action #49 of 2006.
NEW BUSINESS
Bruce DeForrest, Applicant/Owner- 449 West Groton Road -TM #22.-1-4.3 - Minor Subdivision
Chair Carey recognized the applicant who was seeking approval to subdivide his 23± acre parcel as
shown on a copy of the tax map accompanying the application. The applicant stated he planned to
build on the 15± acre parcel, he deeded the 4.7± acre parcel to his son Eric, and the remaining
acreage (4-5± A.) contains the existing house and barn along the road. CEO Gary Coats advised that
the proposed setbacks meet all the requirements, as does the 200' wide access strip to the 15± A.
parcel.
With no further discussion, Chair Carey acknowledged that "under 6 NYCRR Part 617.5(c)(10), (12) or
(13) of the State Environmental Quality Review Law, the proposed action is a Type II action and is
determined not to have a significant impact on the environment, or is otherwise precluded from
environmental review under the Environmental Conservation Law, Article 8."
A motion was then made by Member Gloster to approve the Minor Subdivision, as requested. The
motion was seconded by Member Ed Neuhauser, with the vote recorded as follows:

This becomes Action #50 of 2006.
The applicant was advised of the required maps and time limits by Chair Carey and CEO Coats.
APPROVAL OF MINUTES - 17 AUGUST 2006
A motion was made by Member Janice Haines to approve the 17 August 2006 Minutes, as submitted.
The motion was seconded by Member Barb Clark, with the vote recorded as follows:

OTHER MATTERS
Bob Walpole/Holden Subdivision
Chair Carey advised the Board that Bob Walpole will be coming to the October meeting of the Planning
Board for a subdivision. According to a note from Town Clerk April Scheffler, there is some question

as to whether the proposed subdivision will be a rural or minor subdivision. (The note has been
placed in the file for the record.)
Chair Carey stated that on page 11 of the Subdivision Regulations it should be a three-lot Rural
Subdivision, as (1) a piece of the property was already sold to Ed Neuhauser in 2004 and the three-
year period had not expired, (2) the subdivision would result in a total of from 3-5 lots, each of which
is 5 acres or more. CEO Coats also stated that the subdivision as shown on the tax map sketch
accompanying the paperwork is comprised of a non-contiguous lot (divided by the road); the
subdivision request, if approved, would eliminate this problem.
After an extensive discussion regarding the calculation of fees, Chair Carey felt that the charge should
be $80 for a Rural Subdivision of 3 lots, with one parcel already gone (to Neuhauser). Ed's parcel
needs to be included in the subdivision as the three-year time limit has not expired. This is a topic for
the Codes Workshop.
This application will be placed on the October 19, 2006 Agenda.
Miscellaneous
• Chair Carey reminded Board Members of upcoming workshop by Town of Ithaca & Department of
State regarding planning and zoning, 29 November at 7 p.m. Place to be announced.
• CEO Coats reported there was nothing "earth shattering." More building permits issued this year
than last year. More housing units this year than last.
• Muka property was discussed. Judge ruled in Town's favor. Doesn't know status at this time.
ADJOURNMENT
At 7:55 p.m., a motion was made by Member Clark to adjourn the meeting. The motion was seconded
by Member Neuhauser, with all members present voting in favor.
