PUBLIC HEARING Walpole Real Estate , Applicant / Tammy Thomas , Reputed Owner - Bossard Road - TM # 15 - 1 - 43 .2 - Major Subdivision Chair Carey opened the Public Hearing and read the Legal Notice as published and placed on file . Chair Carey recognized Bob Walpole , representing Tammy Thomas , the owner of the subject property , who gave a brief overview of the proposed Major Subdivision . He explained the owner was seeking approval to subdivide the minor subdivision (approved 5 / 16 / 02) lot of 26 . 18 A. into an 11 .75t acre parcel of land . The owner also wants to subdivide her 5t acre corner lot into Lot A- 1 (2 .69 A) and Lot A-2 (2 .41 A. ) as shown on the map submitted . Each of these lots have 240t feet of road frontage on Bossard Road. Mr. Walpole stated that a purchase offer had been received from Steve Thane (who was present) for the 11 . 75t A . lot which had 389t feet of road frontage along Bossard Road with a depth of approximately 1316 feet. By subdividing again created six lots , a Major Subdivision , requiring this Public Hearing. Chair Carey asked for any comments from the public . Duane Hall, who was sitting at the rear of the courtroom where the hearing was held, did not hear Mr. Walpole 's explanation of the proposed subdivision and approached the Board so Mr. Walpole could re-explain the proposed subdivision to him. Mr. Hall 's concern was drainage from the proposed subdivision which flowed onto his property. The existing ditches, he stated , did not handle the runoff. The water comes down Bossard Road to the corner and then flows onto his land . The Town Highway Superintendent should be contacted who , in turn, may be able to get drainage assistance from the County. With all persons wishing to be heard having been heard, Chairman Carey, upon a motion by Brad Albro , seconded by Janice Haines, with all Board members voting in favor, closed the Public Hearing at 8 : 43 PM. Chair Carey reported that the application had been forwarded to the Tompkins County Planning Department who responded that the request was technically adequate and was being returned for local determination . The problem drainage onto Mr. Hall's property was discussed . Board Member Tom Guihan commented about the abandoned vehicles on part of the owner's property , and the Board felt these should be removed before the property purchase is closed . Board Member Mark Baxendell then read aloud Part 11 of the Short Environmental Assessment Form. Therefore , it wa determined by the Planning Board , upon a motion made by Member Barb Clark, that the action , based on the information submitted , will not cause any significant adverse environmental impact, resulting in a Negative Declaration . The motion was seconded by Member Albro , with the vote recorded as follows: Ayes : Chair Carey Nays : None Member Albro Member Baxendell Member Clark Member Gloster Member Guihan Member Haines Motion carved . This becomes Action # 17 of 2003 : A motion was then made by Member Mark Baxendell to approve the Major Subdivision , as requested , with the recommendation that the Town Highway Superintendent review the potential drainage problems , and that the abandoned vehicles presently on the property be removed before closing on the property . The motion was seconded by Member Janice Haines, with the vote recorded as follows : Ayes : Chair Carey Nays: None Member Albro Member Baxendell Member Clark Member Gloster Member Guihan Member Haines Motion carried . Applicants / ROs - 434 West Groton Road _ TM #s 15 - 1 - 33 43 * 29 44 - Boundary Line Change Chairperson Carey recognized the Neuhausers who were seeking approval to combine four parcels owned by them into one tax map parcel , as shown on the map accompanying their application . It was noted for the record that under 6 NYCRR Part 617 . 50( 10) , ( 12 ) or ( 13) of the State Environmental Quality Review Law , the proposed action is a Type II action and is determined not to have a significant impact on the environment, or is otherwise precluded from environmental review under the Environmental Conservation Law , Article 8 . A motion was made by Member Guihan to approve the boundary changes to consolidate the subject parcels , as requested . The motion was seconded by Member Clark , with the vote recorded as follows : Ayes : Chair Carey Nays : None Member Albro Member Baxendell Member Clark Member Gloster Member Guihan Member Haines Motion carried . Portzline , Applicant / RO - 617-618 Peru Road - TM #s 31 - 1 - 7 . 1 & 7.2 - Boundary Change Chair Carey recognized the owner who wished to combine his two parcels, one of 75 . 37t acres improved with a milkhouse , and the second of 1 . 43t acres improved with a house . At present, with two parcels , he explained , he's paying for two lots with two road frontages ; he wanted to receive one tax bill. The road dissects his property , with the milkhouse on one side and the house on the other side . It was noted for the record that under 6 NYCRR Part 617 . 5©( 10) , ( 12 ) or ( 13 ) of the State Environmental Quality Review Law , the proposed action is a Type II action and is determined not to have a significant impact on the environment, or is otherwise precluded from environmental review under the Environmental Conservation Law, Article 8 . A motion was made by Member Janice Haines to approve the boundary change as requested . Sam Rose , RO - Old Stage Road - TM # 16 - 1 - 33 & 32 . 1 - Minor Subdivision & Boundary Line Chan e Chair Carey recognized Mr. Rose who was appearing before the Board requesting approval subdividing his property to separate the house and yard lot out of TM # 16 - 1 -33 , with the remaining property to be combined with TM # 16 - 1 - 32 . 1 , as shown on the survey map accompanying the application . CEO Senter advised that what was being requested was actually a boundary line change , plus a subdivision . Board members agreed . It was noted for the record that under 6 NYCRR Part 617 . 5©( 10) , ( 12 ) or ( 13 ) of the State Environmental Quality Review Law , the proposed action is a Type II action and is determined not to have a significant impact on the environment , or is otherwise precluded from environmental review under the Environmental Conservation Law , Article 8 . After a brief discussion , Member Baxendell made a motion to declare the request a Minor Subdivision and a Boundary Line Change . The motion was seconded by Member Haines with the vote recorded as follows : Ayes : Chair Carey Nays : None Member Albro Member Baxendell Member Clark Member Gloster Member Guihan Member Haines Motion carried . Jim & Carolann Darling Applicants / ROs - 1300 SRring Street_ Ext. - TM #s 23444. 1 & 14.2 - Boundary Line Change Chair Carey recognized the Darlings who were seeking approval to combine two of their tax map parcels into one, as shown on a copy of the tax map accompanying the application . It was noted for the record that under 6 NYCRR Part 617 . 5©( 10) ; ( 12) or ( 13) of the State Environmental Quality Review Law, the proposed action is a Type II action and is determined not to have a significant impact on the environment, or is otherwise precluded from environmental review under the Environmental Conservation Law, Article 8 . A motion was made by Member Baxendell to approve the boundary line change as requested . ARplicants / Rft - LaFayette Road - TM #29 - 1 - 13 . 2 - Minor Subdivision, Chair Carey recognized Attorney Fierce of Mahlon Perkins' law firm who was representing the applicants . Mr. Fierce presented a map to the Board on which was indicated the previous lots approved by the Planning Board . They now wanted to subdivide TM #29 - 1 - 13 . 2 into three lots , two of which would be combined with adjacent existing approved lots owned by Larry Converse and Gregg McConnell. Mr. Converse stated he wanted a boundary change to consolidate all three of his parcels into one tax map number. Chair Carey stated that without Mr. McConnell being present to assure the Board that he was actually going to purchase the 10 . 13t acre parcel, they could do nothing, because if not combined the parcel would become landlocked. The attorney had no copy of a purchase agreement, although he stated there was one. At the conclusion of the discussion, the Board affirmed that they could really take no action on the subdivision request without ascertaining that Mr. McConnell was actually going to purchase the aforementioned lot, and without a copy of a Purchase Offer/ Agreement. No Action Taken Page 4 of 6 (T) Groton Planning Board Minutes of Regular Meeting } � Lawrence & Magy Alen Converse ARRlicants / ROs - LaF'ayette Road- TM #s 29- 1 - 13 .2 . 13 .4 & 2 . 7 - Boundary Dine Change After deciding that there could be no action on the Minor Subdivision requested by the Tillotsons , the Board then took up the application of the Converses to combine the three referred to parcels, also as shown on the Tillotson map accompanying the application . After an extensive discussion of this request, Board Member Baxendell clarified what was being requested , as it was somewhat confusing. The 8 . 26f acre parcel (Part of 29 - 1 - 13 . 2) indicated on the map would be combined with TM # 29 - 1 -2 . 7 , as would TM #29 - 1 - 13 . 4 by the simple elimination of the boundary lines as shown . It was noted for the record that under 6 NYCRR Part 617 . 5©( 10) , ( 12 ) or ( 13) of the State Environmental Quality Review Law, the proposed action is a Type II action and is determined not to have a significant impact on the environment, or is otherwise precluded from environmental review under the Environmental Conservation Law, Article 8 . A motion was then made by Member Haines to approve the Boundary Line Change, as requested . This becomes Action #24 of 2003 . With regard to the 10 . 13t acres (TM #29 - 1 - 13 . 2) "Parcel to be Conveyed to McConnell , " as shown on the subdivision map shown , the Board advised the attorney that a copy of the Purchase Agreement should be brought in for the file . CEO Senter stated he had advised Attorney Perkins that this was not a subdivision , but a Boundary Line Change. Chair Carey stated that the purchaser (McConnell) should submit an application for a Boundary Line Change for his property . .Tack & Linda van Almelo . ARRUcants / ROs - 1006 Spring St. fart. & Smith Road - TM #s 22 - 1 - 19 . 3 & 19 . 12 - Boundary Line Change Chair Carey recognized the Mr. van Almelo who was seeking to combine their two parcels into one parcel, as shown on a copy of the tax map accompanying the application . The two parcels to be combined, they explained, are shown on the map as containing 47 . 22t acres (TM #22 - 1 - 19 . 3) and 35 . 14t acres (TM #22 - 1 - 19 . 12) , It was noted for the record that under 6 NYCRR Part 617 . 50( 10) , ( 12 ) or ( 13) of the State Environmental Quality Review Law, the proposed action is a Type II action and is determined not to have a significant impact on the environment, or is otherwise precluded from environmental review under the Environmental Conservation Law, Article 8 . A motion was then made by Member Baxendell to approve the Boundary Line Change , as requested .
