Fitch , Recording Secretary Monica Carey Robert Walpole Sheldon Clark *Jeff Lewis Verl Rankin Cecil Twigg George Van Slyke The meeting was called to order at 8 :02 p .m. by Chairman George Totman . G. Totman : Okay, let's call the meeting to order. Approval of Minutes - Meeting of September 18 , 1997 G. Totman : Has everybody read the minutes of the September meeting? (All members present acknowledged that they had read them.) Do you have any corrections? Or do you want to make a motion to approve them? G. Van Slyke : I make a motion to approve them . M. Carey: Second it. G. Totman : All in favor? (All members present indicated they were in favor. ) The minutes are approved for the September meeting. Next thing on the agenda is real estate tycoon Robert Walpole . Roger Gleason - Lick Street Subdivision - Tax Map # 26444 . 372 G. Totman : Bob is representing Roger Gleason on Roger's first land subdivision . Robert, it's all yours . R. Walpole: Well , basically, it's 24 acres G. Totman : On tax map number 27- 1 - 14 . 372 - - M. Carey: 26 , R. Walpole: 26 , not 22 . Anywhere , there's 24 . 88 acres and it will be broken into four acres and two acres, one's got 300 ft. of road frontage ; the other has 166. 3. There's approximately 18. 88 acres left with 116 feet of road frontage . So, basically , it's a two-unit subdivision . There's a possibility here that we may, in the end - - just depends on how the 18 acres is sold - - go to flag lots. But we don' t know at this point. G. Van Slyke : What is that 116 at the road , but it's 100 back in . Is that just the way it' s staked out? M. Carey: The field is huge. R. Walpole: It's just the way the field is . G. Van Slyke : I was just asking why it was only 100 back where the lots are being taken out -- is that just how they surveyed it, or did they try to square them out, or what? R. Walpole: That could be the way the line is -- I guess you'd have to go back and look at the surveyor's thing and how the degrees and stuff are . I think this back portion hasn't been surveyed yet. 1 ---Groton Town Planning Board Meeting 16 October 1997 C. Twigg: I 'll make a motion to the effect that we bypass the public hearing on this and approve this subdivision as presented . G. Totman : Thank you , sir. G. Van Slyke: Second , G. Totman: Anybody opposed? (No member present was opposed ; all were in favor. ) Carried. Has anybody else got anything they want to bring before the Board other than the McLean problem? Discussion of the Adult Entertainment Establishment in McLean G. Totman: Do you want to read that and pass it around? What I'm asking you to read and now you all have is from the EOC to the Planning Board and to the Town Board and it's because the EOC is the agency involved with the Headstart Program in McLean . They are concerned about this business that's going on in McLean and having a Headstart Program in the same area that has a nude bar. I just want it on the record that we got it. As I understand it, the Town Attorney had George do his thing and close them down last Thursday, a week ago today. And they got a court restraining order, and yesterday they went to court and the judge declared the restraining order illegal and they opened back up last night. They are now scheduled 'to go before the Zoning Board of Appeals a week from tonight, here, to appeal the decision that George made to close them down in the first place -- or that George was told to do . I don't think that George made that decision himself. This will bring you up to date . So if the Zoning Board of Appeals rules that it should go before the Planning Board as a Site Plan Review, then we will get it. So what I really want you all to do between now and then, because once -- if we have to have that meeting, you can be well assured that the room will be packed with people. And it's a serious thing because there's going to be attorneys involved and we've got to really know what we're doing . I've got some information here that I' d like to pass around , and I'd like to have you all read it . It's a memo from the Council of Mayors, New York State , and there's some ordinances in there from the City of Rome, the City of Cortland, the Town of Cortlandville - - just to give you ideas of what some places are doing for ordinances. The majority of the towns around here are just about like Groton as far as having ordinances for this type .of activity. As far- as I know right now, the Town of Dryden, Village of Dryden, Town and Village of Lansing do not have anything more than we have . They're working on it. I've been meeting with their lawyers because my other hat is that I'm responsible for coming up with something for the Town I work for. The reason I got some of this information is because, like anything else , you have to be careful how you write up an ordinance so hopefully it will stand up in court. If you write up an ordinance that won't stand up in court, then the Town can be sued and it can costs hundreds of thousands of dollars. I 'm sure our Town Attorney will sometime come along and give us some guidance . Our Town Attorney, Fran Casullo , went on vacation, so in his absence, another member of his law firm, Mr. Baranello , is handling it. The citizens of McLean have hired their own attorney. They hired Mahlon Perkins from Dryden. But , nevertheless, these are some of the things that we got to look for when we're getting called to do for this particular project if it comes before us. It's going to be a tough decision . So , has anybody else got anything else to say? Adjournment V. Rankin: I move we adjourn . M. Carey: I'll second it. G. Totman : All in favor? Van Slyke : What I'm referring to is this thing here - - it's 116 up front; how did it get down to 100 back here if -- are the starting lines square? What were they trying to do here? R. Walpole: I think that probably a lot of it depends on the centerline from Elm Street down . This line out here may not be quite perpendicular to here - - I can't answer that. G. Van Slyke : They would have to share here - - either share the roadway or -- G. Totman : What's that? Each one would own half of it. G. Van Slyke : 50 feet approximate? R. Walpole: 50 feet or 58 feet. G. Totman : But he's not asking for that now. As I understand it, the 18 . 88 acres is going to be advertised as one parcel. And if somebody only wants half of it, then they'll make two flag lots out of it. R. Walpole: There's a person looking at it right now -- for the whole thing. G. Totman: Anybody got any more questions? R. Walpole: The worst scenario is that someone wanted half of it and would come back for a site plan . G. Van Slyke : So we're just taking this chunk and going 2 acres, two units? R. Walpole: Yes. As it stands right now . Both the 2 acres and the 4 acres are both sold -- they haven't closed yet, but they're going. G. Van Slyke : Will this end it? R. Walpole: No . We've sold more property this week for him; just need to get it closed . G. Van Slyke : What I'm saying is does it end his subdivisions and all that? R. Walpole: No. G. Totman: You didn't fill out a SEAR on this did you? R. Walpole: I filled the first page out, just like I'm required to. G. Totman : I don't even have that in the folder here . You haven' t turned it in yet? She normally puts one in the folder. V. Rankin: Now you're talking about the 4 acres and the 2 acres and what's sold? R. Walpole: Yes. That's correct. This whole thing is 24. 88 acres and the only thing we've done is hold six acres of it which is leaving 18 . 88 acres. We're just waiting now for the final surveys. G. Totman ; Anybody got any problems? George , would you like to read the SEAR Part II . Board Member George Van Slyke then reads aloud Part II of the Short Environmental Assessment Form. Negative responses were obtained to all questions in Part H. Therefore , it was determined by the Planning Board, upon the motion made by Monica Carey, seconded by Cecil Twigg, with all members present voting in favor, that the action, based on the information submitted, will not cause any significant adverse environmental impact, resulting in a negative declaration. G. Totman : Now, what's your -- do you want to approve this tonight? Do you want to have a public hearing? 2
