G . TOTMAN : First item of business is that we have Van and Clara Travis regarding
permission to establish a small retail business located at 10 Cemetery
Lane ,, McLean,, New York ( see Attachment A ) . The house is located
next ' door to the cemetery . Before we begin ,, turn to page 64 of your
Land Use & Development Code book . Section 133 . 1 . 13 is allowed where
Section 133 . 1 . 14 is not . In order to pass this ,, we have to determine
what area this is allowed . Otherwise ,, we have to turn it down and
have them go before the Zoning Board of Appeals ( ZBA ) .
G . VANSLYKE : You are going to bring in quilts?
C . TRAVIS : Just bring in the fabrics for the quilts to be made into the finished
product .
G . VANSLYKE : Patch work supplies mainly?
C . TRAVIS : That is coorect .
G . TOTMAN : I suggest that we call it Convenient Sales and Service—Section 133 . 1 . 13 ,
M . CAREY : I agree . Are there going to be classes taught ?
V . TRAVIS : Yes ,, there are .
G . TOTMAN : Lets get the proper classification first . Who wants to make a motion?
V . RANKIN : Made the motion to classify the business as Section 133 . 1 . 13 as
Convenience Sales and Service .

M . CAREY : Made the motion to declare it as a negative declaration .

G . TOTMAN : Does anyone have any further questions ?
G . VANSLYKE : Are you going to have a sign? How are you going to advertise?
G . TOTMAN : If you are going to have any kind of a sign,f you must go before the
Code Enforcement Officer ( CEO ) George Senter .
C . TRAVIS : No sign . Networking .
G . TOTMAN : What about parking ? What about hours of operation? According to
Attachment A,, parking is within property boundaries . Hours of
operation wiil be from 1 : 00 p . m . to 8 : 00 p . m . three days a week .
Merchandise will not be made on the property . No access noise .

V . RANKIN : Made the motion to approve site plan review as presented with the
stipulations that we go with the " short form" --Section 440 . 13
of the Land Use & Development Code ,I page 95 . ( This short procedure
will eliminate the public hearing because no immediate - neighbors will be
affected . )
G . VANSLYKE : Seconded the motion .
VOTE : ALL IN FAVOR ; MOTION CARRIED UNANIMOUSLY .
G . TOTMAN : Second item of business is to pass the minutes from the last two
meetings--March 10 and March 17 .
M . CAREY : March 17 minutes ,, Page 2 ,, " It is called a reality subdivision . " What ' s
that mean?
G . TOTMAN : Anything over five , the realtors have to apply with various County
departments and/or Iboards - in towns where they do not have subdivision
laws . For those towns that do not have a planning board , they have
to do the formalities with the State and the County .
G ® TOTMAN : March 10 minutes- the fifth sentence down . It reads " as well as the
Courthouse . " It should read Code Enforcement Officer . Penny,, -,the
Town ' s stenographer ,I has agreed to correct the original minutes to
reflect this change as well as the day and date in the heading .
G . TOTMAN : Third item of business is Roger Gleason . He wants to give a preview
before the Board of a developers conference as far as what he will
be presenting at the next meeting to make sure nothing will be
pending his plans .

R . GLEASON : Do you know when the ordinances will be updated ( flag lots ) ?
G . TOTMAN : Hopefully#+ before summer is over .
R . GLEASON : As far as having in effect ,I before January,I if possible?
G . TOTMAN : Yes .
R . GLEASON *& Tax Map No . 26-1-14 . 372 : I want to start selling some land . Twenty-
five acres south on Elm Street . Prospective buyer interested in 3
( more or less ) acres and another prospective buyer interested in the
remainder ( see Attachment B ) .
G . TOTMAN : We will adopt the State and County Statute of Limitations . The way we
look at it ,I our regular ordinance ( s ) reads he can sell his own lot
off . The other has to come before the Groton Planning Board ( GPB ) .
R . GLEASON .* So I can sell one lot and the remainder as another one lot , then I
do not have to come before the GPB, but if I sell the one lot and
decide to sell the remainder as more than one lot ( as two lots ) ,
then I have to come before the GPB .
G . TOTMAN : That ' s correct . When you sell one lot , it ., makes ..two , _:butLif /you .sell
it as two lots #, that makes three ,, and you can ' t go three .
R . GLEASON : So#r sell one lot and sell the remainder .
G . TOTMAN : That ' s right . Does someone want to make the motion that if Mr . Gleason
sells Parcel A#( the GPB says that ' s agreeable and it is a legal thing
to do without coming to our subdivision because the others have been sold
long enough that they are not being counted as lots sold: �on that .,parcel
at this particular time?
M . CAREY : Made the motion to reflect what the Chairperson said above .

R . GLEASON .* Tax Map No . 16 4218il2 : Corners ` of Clark. - Street and :- Lick-Street:. Parcel
A having 34 acres, I would like to sell as two lots . Thirty acres of
this parcel is woods . ( See Attachment C ) .
C . TWIGG : That ' s a lot of woods .
G . TOTMAN : On Parcel A, you have approixmately 285 feet of road frontage . What do
you have on Parcel Be Parcel B has two pieces of road frontage . One
of them illegal .
R . GLEASON : The reason why I drew the line there is because right there is a hedge
row . It ' s about 200 feet .
G . TOTMAN : So both lots are legal lots as far as the Town of Groton is concerned .
G . VANSLYKE : Won ' t that make it a strange configuration? Are you going to split it
where the hedge row is?

G . TOTMAN : I think it leaves Lot B worth more money if he leaves 60 feet .
He could sell that land and have someone use it as a flag lot for their
driveway and put a house in there . If he didn ' t have that , then he
could only use the road frontage from the 200 feet down below .
R . GLEASON : Also , Parcel B also has a 60-foot right-of-way down on the lower end
of Clark Street .
G . TOTMAN : So Parcel B could be broken up three times more if you had a flag lot .
R . GLEASON : Exactly .
G . VANSLYKE : You can ' t say that much for Parcel A .
G . TOTMAN : If these two lots are the only two lots left of this particular tax
parcel where Roger may want to sell them in its entirety,, I see no
reason . . . . . It ' s one big lot where he wants to make them into
two lots . You can make him go through a lot of meetings and/or
public hearings ,( you ' ll end up passing what he has right here .
I guess what I am trying to say is that what would we gain if we
took it any further?
V . RANKIN : Nothing . Just cost the Town money .
G . TOTMAN : Does anyone have anything against . . . �
V . RANKIN .* Absolutely not .
C . TWIGG : Not to me unless it would trigger a major subdivision .
G . TOTMAN : . The reason for waiving it is because there is nothing else to be sold
off this tax parcel .
R . GLEASON : Tax Map No : 121-1-21 . 2 . North side of Old Stage Road . Lot D next ;. i. .
to 121-1-16 . 1 ,1 which is next to Knuutila ' s property . I may, in the
future , offer them the additional . That leaves Lots A, B, and C .
If Knuutilas wish not to purchase Lot D,� I don ' t know how � I will sell
these off . Lots A ,, B,, and C are 5 . 5 acre lots each .
G . TOTMAN : How much road frontage do they have?
R . GLEASON : Each one has approximately 300 . . . . There ' s 11'+ 420 feet total .
Two hundred feet would go to Knuutila . Leaves a remainder of 1 ,� 220
feet divided by three equals approximately 406 .
C . TWIGG : It ' s mostly open field then?
R . GLEASON : Right .
G . TOTMAN : He wants to present it to us at the next GPB meeting where he will look
up the rules and regulations for subdivisions for the �Town of Groton
and present it to us as if it is a major subdivision .
R . GLEASON : I would like to request a copy of these minutes be sent to my home .
G . TOTMAN : That ' s fine .

Board members nodded in agreement .
G . TOTMAN : I would like to approve these for the record . We decided to hold
our next meeting Thursday,, April 28 ,, here at the Town Hall at 70. 45 p . m .
We have decided to meet on an additional night which is the fourth
Thursday of each month . Penny does not need to attend . She can
read our notes or transcribe from tape . Even though we meet the first
Thursday of each month for the updating and/or revising of the codes ,I
we are adding an additional night ( last Thursday ) so we can expedite
the completion of this project . We do not really need a quarum for
the meeting ( s ) —only when we need to approve .
V . RANKIN : Made the motion to approve the April 7 minutes in addition to closing
the meeting .
M . CAREY : Seconded the motion .
VOTE : ALL IN FAVOR ; MOTION CARRIED UNANIMOUSLY .

There will be no goods made and sold on the premises .
All parking is expected to be handled within the confines of our property
boundaries .
The business will be operating approximately three days per week from
approximately 1 p . m . to 8 p . m .
