PLANNING BOARD PUBLIC PRESENT ( * Denotes Members Present ) * George Totman ,, Chairperson George Senter,, Code Enforcement Officer * Monica Carey David Pierce * George VanSlyke Tom Pierce * Sheldon Clark Robert Walpole * Veryl Rankin Cecil Twigg George Totman called the meeting to order at 8 : 16 p . m . G . TOTMAN : Does someone want to make a motion that we approve ,, disapprove,, or make any corrections to the February minutes? M . CAREY : One thing it should say on the minutes as far as McMasters is concerned is the hours of operation,, how many vehicles ,, and the type of lighting . I know we discussed it during the meeting ,, but nothing was ever really approved . G . TOTMAN : We overlooked the fact that this area was in a low—intensity area where it is not allowed and was not discovered until after the meeting , therefore ,, could not approve the project . He does have the option to pursue the matter by applying for a variance and presenting it to the Zoning Board of Appeals ( ZBA ) . Does anyone wish to make a motion to approve the minutes with the noted changes mentioned above? G . VANSLYKE : I make the motion to approve the February minutes with the noted changes mentioned . M . CAREY : I second the motion . VOTE : ALL IN FAVOR ; MOTION CARRIED UNANIMOUSLY . G . TOTMAN : Next item of business is Forshee regarding a minor subdivision . Dave ,, would you like to explain to the Board what you would like to do? D . PIERCE : I am purchasing a ::5-acre _. lot . I would like to put a house on lot number 4 . Long future plans include building weight equipment to aid the handicapped . G . TOTMAN : This is not what you ' re proposing now . D . PIERCE : No, way in the future . D . PIERCE : Lot 1 is Forshee . Lot 2 is what David owns on Elm Street . His brother ,, Larry,, owns Lot 3 . You are buying five ` acres which is Lot 4 . What is the road frontage on that ? What ' s the survey show? D . PIERCE : It ' s 671 . 20 feet for road frontage . G . TOTMAN : This is the fourth lot on that subdivision,, and if we want to divide the subdivision up again,, there are restraints we have to follow . Within a three-year period and the property is divided where it hits number 5 ,, the State law kicks in as well as the Health Department ,, which costs a lot more money . If it is over five ,, it ' s called a realty subdivision . T . PIERCE : Eventually, he would like to buy the land ,, part pasture and part open field, behind the back . G . TOTMAN : If he buys Lot 4 and wants to buy the land in back of him for whatever purpose ,, he is not actually creating a new tax map number but adding to the one he already has and would be considered a boundary change . So it would not be a subdivision . ( No road frontage . ) G . VANSLYKE : Why wasn ' t the one down in the corner listed as a lot at that time ? G . TOTMAN : That was previously sold . G . VANSLYKE : Why are we calling it a lot now? Do you see what I mean? Now we have four lots when we were only talking three before . How do we correct that? G . TOTMAN : That was before we changed the boundary line . T . PIERCE : His grandfather gave that to David when he was alive . Now that he has passed away,, it belongs to Robert and Geraldine Forshee . G . TOTMAN : The end result is to be four lots . What this Board decides on David is not what you are going to do with at this point but the division of land . With that in mind,I we should fill out Part II of the SEQR . ( George briefly explained what a SEQR is to the Pierces . ) G . VANSLYKE : Part II of the SEQR . TOTMAN : Any more questions ? Any comments? M . CAREY : I make the motion to pass this minor subdivision . G . TOTMAN : Do you want to include the fact that a public hearing is not required? M . CAREY : Noted . V . RANKIN : Seconded the motion . VOTE : ALL IN FAVOR ; MOTION CARRIED UNANIMOUSLY . G . TOTMAN : Next on the agenda is Robert Walpole . R . WALPOLE : Where do we stand on the flag lots? G . TOTMAN : We are in the process of signing a contract with the County . It is called a Circuit Rider Program . I would say at least six months away . Groton Town Board wants all our changes in one package . R . WALPOLE : On the Cornelius farm . On the south side of the road is approximately 50 acres where we want to break it into four lots . We are going to offer at least one lot for sale . There is 250 feet road frontage,f rural subdivision . What we are doing is offering this lot to the East first . We want to test some waters out there first . We do not know if it is going to be a double wide or modular . ( See Map A . ) G . SENTER : How are you going to break the lots? R . WALPOLE : It is going to be zagged . We are trying to meet the Town ' s minimum requirement of road frontage ( 200 feet ) . Nothing will be landlocked . G . TOTMAN : For educational purposes , if you had flag lots , you could really make these lots look favorable . You could get at least six lots and better use of the land . We need a flexible zoning ordinance . R . WALPOLE : If one lot sells , it will give us a feel of what people are looking for . However, ii and when the first lot is sold,, you will be totally abreast of what activity is going on . G . TOTMAN : So basically,, this is an informational meeting . Before the second lot is sold,, Robert Walpole will know an approval has to be made for a minor subdivision . R . WALPOLE : Referring to Map B, we are going to break it off into eight lots that meet the 200 feet road frontage . We are looking at the first lot to be sold ( VanBenschoten ) . We have one individual looking at 20 acres to build a house on . M . CAREY : What about the land going over the top of the hill ? R . M . - - - - - - - - - - - - Page - 4 R . WALPOLE : Building permits can be applied for before a minor subdivision is triggered . Tax Map Number 26-1-17 . 2 ( Pachai ) : there ' s a lot at the end of Mack Street where there is a piece of property that is 4 acres . G . TOTMAN : Our Board requested that he leave open a paper road in his deed so the back of the lot could be accessed . It ' s there for future developers to look at . R . WALPOLE : I understand that . In the past two or three Board meetings #, we have had the Town abandoning roads . . G . TOTMAN : There ' s a difference . R . WALPOLE .* I don ' t know about difference . All this is a paper street until they have ownership of it . Mr . Pachai wants to sell his four acres . G . TOTMAN : Then he has to go for another variance . R . WALPOLE : He doesn ' t have 200 feet of road frontage . What ' s the Planning Board ' s recommendation going to be on that ? V . RANKIN : Don ' t give it to him . G . VANSLYKE : The reason why we agreed to have him build a house was because it was a hardship . R . WALPOLE : No hardship . That 60 feet was designed to give access . G . TOTMAN : The ZBA defines hardships . Somebody created a parcel of land with good intentions and somebody comes along and buys it . V . RANKIN : The guy knew what the Town law was when he bought it . If the ZBA wants to give him a permit ,f fine . G . TOTMAN : We are trying to put better use to land . ***Discussion was made concerning paper streets . * * * G . TOTMAN : Monica,, Sheldon ,, and I were at the meeting with the girl from the County Planning Board . It is our job to go through the code book page by page to make any revisions and/or updates . I would like to have from the GPB members meet with the Tompkins County Planning Board about these revisions/updates . How does the GPB wish to go about this ? G . VANSLYKE : My comment is when it gets 9 : 30 or late at night, it is too late . I rather meet a different night of the week . G . TOTMAN : Do you want to have it as a whole? I would like to have you look through the book before we meet so we do not spent most of our time reading the book during our meetings . I would like to have Lyle Raymond of the ZBA sit in at a few of these meetings since some concerns are in connection with what we are doing . Does everyone want to meet the first Thursday of each month with Tompkins County Planning Board, 7 : 30 p . m . ?
