George Totman called the meeting to order at 8 : 25 p . m . to discuss the previously passed
subdivision of Roger Gleason,, which shortened road frontage on one lot on Lick Street-
Tax Map Parcel No . : 1-121-21 . 2 .
G . TOTMAN : Without another Board member being present this evening ,, we do
not have a quaram . Therefore , no vote can be made this evening .
With that , Roger has asked previously to discuss his situation .
To give pp g you a brief summation , we have approved a subdivision
for Roger up on Lick Street . At that time ,, we asked Roger to
put in a 60-foot right-of-way so that if someone wanted to
buy the back part of land in the futures it could be done so .
The northern part of the last lot bordered onto a little piece
of property,, used to be the old schools and nobody really
knew exactly where the line was ,(, but the lots we agreed to had
or have 200-feet of road frontage . Since that approval ,! ,, surveys
were conducted and it turned out that the lot had 13 less feet
than wahat we originally thought it had . So the last lot in
the subdivision we approved turns out to be 187 feet instead
of 200 . Roger went to the Zoning Board of Appeals ( ZBA )
after meeting with us first . The ZBA is not quite sure how
to handle this one . So they wanted the GPB to review options
that were presented at their last meeting . Or do we have a
problem in approving the 187 feet? They did not know at the
time that the 60-foot right-of-way for future road was our idea .
The ZBA thought it came from Roger . We did it for protection .
Personally,, I would like to have the 60-foot right-of-way left
alone to protect the back lot ( s ) and go ahead and approve the
187 feet because it was not self-inflicted . It was something
no one knew anything about .
R . GLEASON : The ZBA suggested that the lot be rotated the other way .
G . VANSLYKE : You want the frontage to come from Old Stage Road .
R . GLEASON : I had it measured the distance from my house , 398 feet roughly,,
to the corner of my house . My lawyer says the school house
lot will encompass . . . . . Originally the description said 50
squrae rods . My lawyer says making any lot that goes this way
will put this right in the corner and says it will not sell
worth a darn . There ' s a question on who owns it .
G • TOTMAN : Would you like us to make a recommendation?
R . GLEASON : Yes ,, but there is another interesting thing . At the ditch line is
191 ' feet ,, so you only have 9 feet .

G . VANSLYKE : I cannot recall . Was this a five-lot subdivision?
R . GLEASON : Originally yes .
G . VANSLYKE : This was not tied up in something else , was it? Coming back
towards your house .
R . GLEASON : It ' s too expensive to make a road . It would make a nice cul de sac .
R . GLEASON : We have not approved this lot . We found an 1810 deed and wrote
to the people and said they were not interested .
S . CLARK : Who pays the taxes on it ?
R . GLEASON : Mortons in Batavia .
Individuals took time to review original sketch and lot that was approved .
G . TOTMAN : This is what we approved . Roger wants to add this lot to
these . Five or more makes it a major subdivision . Roger,
you may want to talk with your lawyer about the realty law .
You will have to go to the Health Department and get approval
for all these lots . Talked about the three-year duration of
no activity since day it was approved . As far as they are
concerned , you are starting a new .
R . GLEASON : It looks like the best thing to do is withdraw the whole thing .
G . TOTMAN : We are saying do not take this here because it will make it an
economic hardship . Once you go back to the ZBA and they give you
a variance contingent upon us . .
R . GLEASON : I will go to the ZBA and withdraw that one lot .
G . TOTMAN : Go back to the ZBA . Do you have anything else ,, Roger?
R . GLEASON :
Yes I do . This is north of Clark Street Extension where my son
lives . My son lives at the corners of Lick and Clark Street
Extension . Mr . Root ' s son and daughter-in-law want to buy
a lot to build . This would be south of the barn . Mr . Rood
wanted to have 100 feet But Mr . Rood decided he did not have
enough money to buy it . So the son and daughter-in-law
decided they wanted to buy 300 feet .
Individuals discussed dimensions and possible options without identification . Maps
were copied and identified by letters for visual clarification ( see Attachment A ) .
G . TOTMAN : Now that we have better visual identification, lets back up
for the record . Number 1 was originally going to buy some
extra land and have the boundary change in Number 2 . Now
you have a purchase offer to buy Number 2 , which would make
it a subdivision . Number 4 being s small parcel of land is
going to be traded to 16-18 . 11 and you ' re going to pick up
Number 5 . That way,, Number 3 will go straight back and will
not have that jag coming out of it . Lets carry on .

G . VANSLYKE : How will you access Number 6?
R . GLEASON : I own about 285 feet on the North side of Lot 1 . There is
a 60-foot right-of-way,I which is past McMasters .
G . TOTMAN : He has a right-of-way from Clark Street and 200 feet from
Lick Street so he is not land-locking any land . By trading
Number 5 ,+ it would not be nothing more than a boundary change .
When you come to our next meeting ,, you will present a preliminary
for approval . We do not have a quarum so we cannot vote on it .
We are giving you a consensus of the members that are here tonight .
You do not have anything more up your sleeves , do you? The next
;. . meeting As scheduled for February 17 . When the weather breaks ,+
the survey can be scheduled . So are we finished?
R . GLEASON : Yes .
G . TOTMAN : We have next Mr . Walpole .
R . WALPOLE : On the old Cornelius farm on South Main Street ,; we know the Town ' s
position on this flag lot theory . We have ruled out public water .
Not enough pressure to meet the Tompkins County Health Department ' s
standards unless we come from Mack Street . We are taking a view
of increasing the tank size . What we are going to do is cut
from the east side of Robert VanBenschoten ' s house 2 to 2 . 5
acre lots -and test the waters within the next 30 to 45 days
to see what type of reaction we get for building lots with
the idea of putting modular homes . Spec at this point . It ,
will all fit into the Master Plan . We are waiting for the 60-
foot strip . . . . . four units private road . . . . .
G . TOTMAN : Does everyone understand why Robert is talking only four
lots on a private road and not five or six?
G . VANSLYKE : Not really .
G . TOTMAN : According to the State interpretations , if you are on a private road ,,
you cannot have more than four parcels on that private road or you
have to go into homeowner ' s association of red tape .
Re WALPOLE : The Village engineers are very interested in doing something
with water ., Having 15 to 20 lots , cluster housing , is not
in today ' s price market . f
G • TOTMAN : Any land developed at a later date ,, it is dated that there
would be no litigation . This is progressive planning . Taking
good use of land and making more use of it and making use of the
tax dollar .
G . VANSLYKE : When you were talking about the four units ,, would there be
individual cul de sacs?
R . WALPOLE : There would be a 60-foot right-of-way .
G . TOTMAN : Could be either way . We could require a " T " or how you want to
lay it out . Most of them are dead end .
G . VANSLYKE : It would be up to the homeowners to maintain these roads and not
the Town right ?
R . WALPOLE : Tha is right .

Meeting with Mr . Walpole concluded .
G . TOTMAN : Regarding the Comprehensive Plan , the Groton Town Board has approved
what was presented to them . Until we make a formal presentation ( s ) ,,
they will not act . Does not want it in pieces . Flag lots ,t ZBA ' s
problems ,, and other things we should talk with the ZBA about
and see what problems they have and incorporate any changes .
Association of Towns Seminar is next month . Anyone interested
in attending should have their reservations in next week . Everyone
is is to go . According to new rules ,I we should have a
training session a year .
