PLANNING BOARD PUBLIC PRESENT ( * Denotes Members Present ) Joan Jurkowich James Henry,, Esq . George Totman ,, Chairperson * Douglas & Marjorie VanBenschoten Monica Carey Cecil Twigg Verl Rankin George VanSlyke G . TOTMAN called'' the meeting to order at 8 : 07 p . m . G . TOTMAN : We have two setssof minutes to approve for October 14 ,. 1993 ,, and October 21 ,, 1993 . Page three of 10/14/93 minutes should be corrected on page 3 . to read Devlin Road instead of Dublin Road . G . VANSLYKE : Made motion to approve 10/14/93 minutes with correction to be made as stated above . V . RANKIN : Seconded the motion . VOTE : ALL IN FAVOR ; MOTION CARRIED UNANIMOUSLY . G . VANSLYKE : Made motion: .to -:approve ._10/21 /.. 93 : minutes .. M . CAREY : Seconded the motion . VOTE : ALL IN FAVOR ; MOTION CARRIED UNANIMOUSLY . G . TOTMAN : We have Joan Jurkowich with us here tonight . She is scheduled on the agenda for 8 : 45 but the two individuals ( Beckey Vallely and Robert Walpole ) who were scheduled before her are not here yet . , So why don ' t we continue the meeting by taking care of Joan . Does anyone object ? Planning Board members nodded in agreement . G . TOTMAN : The purpose of Joan being here is that we have to make a formal recommendation to the Groton Town Board of a comprehensive plan to the Groton Town Council . J . JURKOWICH : There is one change . An error in the draft report . Teresa u Robinson made note of this change ( referen6ing 'L, 11/93F ,plan sentence ) . G . TOTMAN : Mentioned the fact that the 10/14 minutes were actually incorrect as far as having to hold a public hearing referenc- ing this plan if there were corrections . But ,, if there is no corrections to be made ,, then a public hearing does not need to be held . We are not making any revisions so no need for a public hearing . RANKIN . Made motion to approve Comprehensive Plan to Groton Town Board as presented . M . CAREY : Seconded the motion . VOTE : ALL IN FAVOR ; MOTION CARRIED UNANIMOUSLY . G . TOTMAN : Anything else Joan? J . JURKOWICH : No . G . TOTMAN : If Groton Town Board accepts this ,, we should have separate monthly meetings . It is clear that we do want to define the ordinance by making it more understandable . C . TWIGG : I think we have a better idea of what we are doing ,, don ' t you? G . TOTMAN : Yes . J . JURKOWICH : They require that certain actions that you take go to Town Planning Department for review ( gave a brief summary of rules and regulations on 239 , L ,, M,, and N--nothing within 500 feet of county or state road; in an agricultural district ) . C . TWIGG : Is this a request or a requirement ? J . JURKOWICH : A requirement . G . TOTMAN : The State definition . If we do it as required within 30 days . G . VANSLYKE : Why is this being done like this ? J . JURKOWICH : Another political power tool . G . TOTMAN : We have received a lot of complaints as far as the County not responding in a timely manner . J . JURKOWICH : At the next County Planning Board Meeting ,, they are asking for a brief presentation . G . TOTMAN : Who wants to do it ? M . CAREY : Suggested G . Totman attend . G . TOTMAN : If anyone else wishes to go ,, it is the third Wednesday of each month . J . JURKOWICH : Next meeting is December 8 ,, 19930 G . TOTMAN : Ended this item of business and continued with remaining items of business on agenda . Again,, at this time ,, neither Becky Vallely nor Robert Walpole are here . We do have Jim Henry with us here tonight . J . HENRY : I am missing my clients . Town - of - Groton - Planning - Board Meeting ,, Thursday,, November 18 ,, 1993 , 8 : 00 p : m : - - Page - 3 AV J . HENRY : What I have is a sketch plan . The parcel outlined on 680 Stevens Road . Parcel No . 2 contains Doug and Marjorie ' s residence . At this time,, they want to refinance their mortgage but their bank does not want to refinance all the land because Parcel No . 3 they want to convey to their child . G . TOTMAN : Jim is here to represent Douglas and Marjorie VanBenschoten of 680 Stevens Road . They have applied for a review and approval of a subdivision,, TAX MAP NUMBER : 31-1-19 . 2 and 19 . 3 . What they are applying for is a minor subdivision approval . J . HENRY : It is pretty straight forward . V . RANKIN : Number 1 is who? J . HENRY : The daughter . C . TWIGG : Two is where they live and 3 goes to their child and 4 is remaining . Will it be a separate tax parcel ? J . HENRY : No,, because it will not be deeded . This is the Tompkins County Trust Company where they say the land does not add that much value . I particularly do not follow this logic . ( At this time , 8 : 40 p . m . , the VanBenschotens arrived at the meeting . ) C . TWIGG : How soon will the parcel going to the .: son be deeded? J . HENRY : They are only going to mortgage part of their land . G • TOTMAN : I have never dealt. with a bank doing it this way . It probably depends on what the lawyer records . M . VANBENSCHOTEN : There is one other quirk . We also have a home equity loan with TCTC where we will have to get a release when we deed this parcel to our son . I do not foresee any problem with this . It will not be deeded to our son for at least another year or two . C . TWIGG : It is to your advantage to leave it as one tax parcel . M . CAREY : You do not have any plans to sell that fourth parcel right ? M . VANBENSCHOTEN : No,, not at this time . G • TOTMAN : Are you aware when the survey is properly signed that it has to be filed with the Clerk within 30 days before null and void? Co TWIGG : Did they have to have this parcel officially surveyed-.to satisfy who? J . HENRY : Some independent banks do not require an updated survey such as Groton and Dryden National Banks . What we are asking is a survey for l ,. 2 ,, and 3 . Groton Planning Board members reviewed survey map . TOTMAN : How do the Planning Board members wish to handle this tonight? Does the Planning Board want to handle this tonight ? Board members muttered in ; agreement . G . TOTMAN : Do you feel we need to have a public hearing ? Board Members stated no . G . VANSLYKE : Read the SEQR form to be filled out as follows . Pt . A : No Be No C : 1 . No 2 . No 3 . None 4 . No 5 . No 6 . None 7 . No D : No M . CAREY : Made motion to declare a negative declaration . C . TWIGG0 Seconded the motion . VOTE : ALL IN FAVOR ; MOTION CARRIED UNANIMOUSLY . V . RANKIN : Made motion - to ,waive filing . time =_and public hearing , and approve minor subdivision . G . VANSLYKE : Seconded the motion . VOTE : ALL IN FAVOR ; MOTION CARRIED UNANIMOUSLY . Douglas and Marjorie VanBenschoten made a check out for $ 20 to the Town of Groton for filing fee of minor subdivision . V . RANKIN : Made a motion to adjourn the meeting . G .
