PUBLIC HEARING PPUBLIC HEARING PLANNING BOARD PUBLIC PRESENT ( * Denotes Members Present ) * George Totman, Chairman Joseph & Judith Longo * Monica Carey Kathy Cornell * Veryl Rankin Ed McElroy * George VanSlyke Teresa Robinson Sheldon Clark Cecil Twigg JUDITH LONGO,r 28 MCLEAN-CORTLAND ROAD, MCLEAN,P NEW YORK,� FOR APPROVAL OF GIFT SHOP George Totman called the public hearing to order at 8 : 08 p . m . Mr . Totman read the legal notice that was in newspaper ( attached ) . G . TOTMAN : The general procedure in something like this is all of the neighbors were sent notice of this meeting ,( and if anyone had any objections of the proposed action that they were invited to come here tonight . Does Planning Board members have any questions that they wish to ask these people? Well it is 10 after 8 p . m . , and if anyone was going to come, I am sure they would be here right now . So with that , we will close the public hearing . Does the Board want to ask questions or make a motion or have a discussion? M . CAREY : What about the classification that was in question from before? G . VANSLYKE : We did SEQA last week . We went through all things that were in the book and not one of them seemed to apply to a gift shop situation in that zone . I asked about the way it was written as far as convenience sales and service . G . TOTMAN : 103 . 13 . G . VANSLYKE : Right . I asked the question from the last time , and I really didn ' t get any real definition . I do not know why a gift shop would qualify under a convenience sales and service situation . If you are specifically saying it is going to be tobacco, magazines , and drugs ,, that means you can only open up a drug store in that zone . Right ? And not have any gifts in there . G . TOTMAN : I think it ' s the general consensus of the Planning Board at the last meeting that the intent here of the ordinance was to allow a convenience store in that zone , and that ' s what decided in order to hold a public hearing . Does everyone agree with that concept ? M . CAREY : Yep . G • TOTMAN : We did discuss hours of operation, I think,, from the last meeting . M . CAREY : Evenings from 6 to 8 p . m . and at Christmas time . J . LONGO : I would say evenings from 6 to 8 p . m . and Saturdays - from 10 to 5 . Sundays 1 to 5 . VANSLYKE : You are really looking at the Christmas business rather than a regular business . We are not trying to force the people to be for the hours they state . What we are trying to do is to have you tell us what hours you want to run the business and those are the hours ( maximum ) that we expect you to be open . You can close anytime . If you want to be' off Sunday;, you can be off . G . TOTMAN : You don ' t have to open at all if you don ' t want to . The intent is to give some guideline for the Code Enforcement Officer to go by in case someone calls up and says that you are violating the special permit where they are not suppose to be open Mondays ,( but they are . For the record now,( we are putting down . . M . CAREY : 10 to 5 on weekends . Six to 8 . . . G . TOTMAN : 10 to 5 Saturdays , Sundays , and holidays and 6 to 8 weekdays . It will also state in there that you will provide off-street parking . I have no further questions . Does the Board agree as well ? G . VANSLYKE : It seems there is no one else here to oppose or voice their opinion,( so I will make the motion to let them have the retail sale with the conditions of the hours of operation,( the parking ,, the sign,( etc . V . RANKIN : Seconded the motion . VOTE : . ALL IN FAVOR : MOTION CARRIED UNANIMOUSLY . G . Totman closed the public hearing at 8 : 20 p . m . Board reviewed minutes from last meeting . G . VANSLYKE : Made a motion to approve August minutes . M . CAREY : Seconded motion . VOTE : ALL IN FAVOR ; MOTION CARRIED UNANIMOUSLY . ALAN STICKELS-PRELIMINARY ON MAJOR SUBDIVISION-TAX PARCEL NO . : 30-1-18 . 2 G . TOTMAN : At last meeting ,, we told him that if paperwork was in on time that we would hold a public hearing tonight . M . CAREY : Well I thought we were going to have a public hearing on it tonight ,( but it wasn ' t on the agenda . G . TOTMAN : There seemed to be a lack of communication about scheduling ,+ so it was set for a later date . If there are any questions ,, I would like to hear from people . I personally do not see anything wrong in what he is trying to do . If anyone else sees it differently . . Board members uttered in agreement . G . VANSLYKE : Provided a SEQA form to be filled out . Part II-Environmental Assessment : A . No Be No Co 1 ) No 2 ) No 3 ) None 4 ) No 5 ) No 6 ) No 7 ) No D . No At this point ,I we will make it a negative declaration . M . CAREY : Made the motion to approve preliminary plan and to schedule a public hearing for Alan Stickels ' Major Subdivision,, Tax Map Number 30-1-18 . 2 on Stevens Road . G • TOTMAN : We will hold public hearing on Thursday at 8 : 00 p . m . October 21st , G . VANSLYKE : Seconded the motion . TOTMAN : Since the previous conversation with Teresa did not get in the minutes ,, we should discuss it so we have something on record . My personal opinion is that it is not such a big deal , as it is made out to be except for this one guy,, Wilbur ,, I believe up on Lick Street . As far as I am concerned,, our law clearly states that in order to have living quarters for more than 30 days ,, your residence or building has to have 840 square feet . Right or wrong ,, if there is an ordinance on RVs that says you cannot live in it year-round, there is really nothing wrong . I see nothing wrong in living in an RV if certain provisions are made in the ordinances for something like this . M . CAREY : I agree . G . TOTMAN : The intent of the 200 feet was for open space . The Health Department governs the use of the septic system on an acre of land . This guy has been there even before any of these rules were made . G . VANSLYKE : Are you telling me this guy has a house on his property because he has a camping trailer that he is actually living in? Who lives in the house? M . CAREY : Daughter and her boyfriend . G . VANSLYKE : Is he hooked into the same septic ? G - TOTMAN : Last I knew they were. The septic line ran right across from the top of the ground . M • CAREY : That was the water line . G • TOTMAN : Well the ZBA met the other night and they are putting a hold on it waiting to revise an ordinance . G . VANSLYKE : Why are they asking us to revise an ordinance because of this guy coming in here with this problem? Why don ' t they make the decision? G - TOTMAN : Monica is right when saying this action should have been taken care of when it was brought up six or seven years ago . Teresa is right in saying when we redo the ordinance , we should be looking at the 840 square feet . Even with the granny flat ,, it still would be temporary . It could be attached to side of house . G . VANSLYKE : This thing is qualified as a granny trailer . When re-writing ordinance ,, lets talk about granny clause . G • TOTMAN = Set public hearing for Master Plan . We had originally set for September 23rd . The public hearing is tentatively set for September 30th at 8 p . m . Did anyone get a notice of meeting for next week? It ' s at the Lehigh Valley House . The Town will pay . Did anyone read the Local Government Forum? . If you fill out the form and give it to Carol , she will make out a voucher to pay for it or pay in advance and then get reimbursed . It ' s in Newark Valley . I think it would be a good Forum . Anything else to be discussed? V . RANKIN : Made motion to closing meeting at 8 : 52 p . m . M . CAREY : Seconded motion .
