Dear Mr . Totman :

Your recent letter _ indicated that the Town of Groton Planning . . Board
has proposed an amendment to the Town Land Use and Development Code
defining and regulating " flag lots " ; you enclosed a copy of the proposed
provision and asked for our review .
We have reviewed the provision you enclosed : It appears to be
consistent with that portion of Town Law , Section 280 - a , which requires
access of at least fifteen feet width to parcels of land before a building
' permit may be issued ( see Town Law Section 280 - a , subdivision 5 ) . We
note , however , that the definition you enclosed would require the " flag
lot " to have access to a " public road : right -of -way . " We believe this
portion of the definition to be too limited . Town Law , Section 280•- a ,
subdivision 1 ( the basic provision requiring access before a building
permit may be issued ) provides that access may be provided by a street
shown on a plat approved by the planning board , in addition to public
streets '. Streets shown on subdivision plats are often offered for
dedication to the town and may then be accepted as a public street .
However , the decision whether the street will be offered for dedication or
i remain as a private street is that of the subdivider , not the planning
board ( Town Law , Section 278 ) . Thus , it is possible that a street shown
on a plat approved by the planning board may be a private street ; this
would still meet the access requirements of Town. Law , Section 280 - a , but
'• not the terms of the definition you provided . We would suggest modifying
the proposed definition to insert reference to streets shown on plats
approved by .the planning board in addition to public rights - of -way .

We do not have the other provisions of . the Town ' s Land Use and
Development Code , and thus cannot comment on the regulations that apply to
" flag lots . "
