Dear Mr. Stevens :
This letter is in response to your correspondence to our office dated March 29, 2005
concerning the above referenced property. You had stated that Mr. Adams intends to rent
to a tenant who plans to use the facility as a pizza parlor. You are requesting
recommendations with respect to its use as a pizza parlor.
The previous use of the building was a small retail shop that mainly sold crafts and
fabrics, but that also sold pies. To our knowledge, the pies were made elsewhere and
sold at the shop. A pizza shop where pizza is made on the premises would change the
nature and volume of the liquid waste . This would require a conversion permit.
The Tompkins County Sanitary Code Article VI, Sm6 .03 (a.)3 states in part,"Conversion
of a building by alteration, enlargement or extension of an existing building(s) or
structure(s) in such a way as to result in a change in the volume or characteristics of the
liquid wastes therefrom. . ."
A conversion permit requires a lot that is served by a well to be one acre of land in which
a 150 foot diameter circle fits or if the lot was created prior to August 17, 1977 a 30,000
square foot lot may be considered if all other Code requirements can be met.
From the survey map our office attained from the Tompkins County Department of
Assessment, this lot is much less than 30 ,000 square feet. The minimum lot size and
minimum lot dimentions may be waived by the Permit Issuing Official where a Design
Professional is responsible for the project. A Design Professional ' s submission is not a
guarantee the Health Department can approve the proposal .
In addition, a food service facility' s water system is regulated as a public water system.
We have no information about the water system serving this property. We note,
however, a gasoline spill in this area was investigated and remediated from 1989- 1997.
A public water system needs to meet requirements outlined in Part 5 - 1 of the New York
Sanitary Code.
If your client plans to hire a design professional please have him contact our engineering
staff, John Andersson, P.E. or Steve Maybee, P.E. (at 274-6688) to discuss this lot prior
to designing any plans.

business before the Public Hearing in January .

# 38 . -4-5 - Site Plan Review / Special Permit for Proposed Renovations & Vehicle Sales Lot
Chair Carey recognized the applicant who stated he had purchased the former Patchwork & Pies
building at this intersection in McLean , and he wanted to renovate the existing building to include two
2 -bedroom apartments on the second floor, and an efficiency apartment , professional office , and car
sales office on the first floor. The car sales office would be used in conjunction with a proposed vehicle
sales lot to be located in the front of the existing building as shown on an extremely rough sketch
accompanying the application .
Chairperson Carey noted the applicant was seeking approval to park 16 cars on the proposed sales lot .
Mr. Adams stated it would be more likely 5- 10 , but he wanted as much as possible because he heard
the County may be re-doing the intersection and he would lose some of his road frontage . Supervisor
Glenn Morey stated this has been rumored for the last five years . Chair Carey stated she had talked
with County Planning who had just received Mr. Adams ' application , but they hadn 't completed their
review under GML. In a letter to Chair Carey, dated 16 December 2004 , the Tompkins County Planning
Department informed her that they had many concerns and issues , and may request more detailed
information as they performed their review; they also noted that the submittal they received "may be
incomplete . " The letter, which has been placed on file for the record, stated that although the Town
could hold a public hearing on the matter, it could not make any decision until it received County
Planning's 239 recommendation .
Chair Carey stated that the rough sketch provided by the applicant left a lot to be desired, especially
with regard to parking on this . 49± acre site . Mr. Adams stated that there was additional parking
available at the rear of the parcel - enough for at least ten cars . He stated he had already placed a
couple of cars out front for sale and had received a lot of response . Member Janice Haines commented
on the difficulty with line of sight at that intersection , especially if cars are parked on the proposed
sales lot .
Chair Carey asked the applicant if he had talked with the Health Department regarding the proposed
increase in sewage from the expanded use of the building, including offices and apartments . Mr.
Adams said he had, along with CEO Coats , but had not received any response as yet. CEO Coats
stated he had a letter and will get a copy of it to the Board members. Chair Carey stated the Board
would want to see what the Health Department says , and she advised the applicant that if he gets the
go-ahead, he would need Health Department approval . CEO Coats stated there were lots of things to
consider with mixed occupancy: fire separations , egresses , parking requirements for the dwelling units
(2 per unit, 1 for the efficiency, for a total of 5) . Customer parking would also have to be provided .
Chair Carey stated the Board would need a letter from Tompkins County Highway, and she thought
the request for 16 sale vehicles was too many for the lot. Member Tom Guihan stated he would like to
see a Site Plan , drawn to scale . CEO Coats advised that the applicant would have to go through the
Building Permit process once the Planning Board decided what was going to be allowed , and there were

problems with natural light and ventilation because of the arrangement of the windows in this
building.
Chair Carey informed the applicant that the Board could not act on his application at this meeting as
they needed additional information—letters from County Highway and the Health Department, a
response from County Planning, and a detailed Site Plan , to scale . Member Guihan also wanted to see
a sketch indicating the layout of the proposed apartments and offices for each floor .
With no further discussion , a motion was then made by Member Brad Albro to postpone any action on
the application until the 20 January 2005 meeting of the Planning Board . The motion was seconded
by Member Guihan , with the vote recorded as follows :

Cingular Wireless , Applicant / Russell Demond, RO - 1075 Old State Road - TM # 19 . - 1 -24 . 1 -
Proposed Cell Tower
Chairperson Monica Carey recognized Terri Burkholder, representing Cingular Wireless who was
seeking approval to construct a 195 -foot cellular tower on this site . Ms . Burkholder presented a very
complete , precise application which included a health safety evaluation of electromagnetic fields , a " no
hazard" letter from FAA, a NEPAS Environmental Summary Report & Checklist, an Easement
Agreement and a Ground Lease Agreement between Cingular and the property owner, Russell Demond .
Ms . Burkholder explained the siting process and why this particular parcel was selected . It is proposed
to cover Routes 222 and 90 . The type of tower selected had the least visual impact, which was a
concern of CEO Coats . A photo of the proposed monopole tower (which has no guy wires) was shown
to the Board members . She stated that the applicant "tries to co-locate any time they can . " The
proposal was submitted to FAA and , as stated earlier, they had received a no-hazard letter from them
and the tower would not have to be lighted . A four-foot lightning rod would be placed at the top of
the 195-foot tower, making the total height 199 feet. An existing access road would be used which
they will upgrade by adding # 2 stone . Technicians visit the site four times a year - every quarter - for
required inspections ; parking is indicated for two vehicles , with a turnaround .
Member Guihan asked about the fall zone for the tower . Ms . Burkholder stated that this had been
addressed . CEO Coats advised that the lease was for a 100 ' by 100 ' property, with fencing within at 80 '
by 80 . They have also obtained a permanent easement from Mr. Demond agreeing not to put any
buildings , etc. within the fall zone (an additional 99 feet) , as shown on a map accompanying the
application . The fence will be locked using a chain and padlock. Chair Carey asked Town Attorney
Monty if she saw any problems with the application ; she stated she had received a copy of everything
and had no concerns .
CEO Coats reminded the Board that if the tower is not used for a period of twelve months , there is an
agreement with the owner to remove the tower and restore the land to its original state to a depth of
two feet below the surface . This agreement will also be with the Town - which has been provided .
Board Member Guihan asked what the antennae / platform would look like . Ms . Burkholder stated the
antennas are between 4 and 6-feet tall and 8 inches wide, and they are attached to a triangular
platform (w/ adjustable height) on the tower. There will be six per platform . She stated they had a co -
location agreement with all the major carriers , who could also utilize the proposed tower . Lee
Shurtleff stated that he was present as the County Administration was interested in what the plan
was for the proposed tower, and they are looking to upgrade the County's radio system by utilizing
from 8 - 12 tower sites throughout Tompkins County in an attempt to co-locate on them as needed .

Please be advised that the Planning Department has received the Town of Groton ' s request for a review of
a site plan and special permit application pursuant to §239 -1 and -m of the New York State General
Municipal Law. We have received the application, short environmental assessment form, and preliminary
site plan information.
Staff is in the process of reviewing the project and will submit comments to the Town within thirty (30)
days in accordance with § 239 -1 and -m of the New York State General Municipal Law.
Some of the potential issues that we may be looking at include the impacts to traffic circulation and
safety, and the adequacy of parking spaces to accommodate each of the proposed uses of the site .
We ' d also like to note that the submission may be incomplete . We believe that a drawing, to scale, that
shows the location of parking and access to the site is necessary to appropriately assess the impacts of this
project. We may request more detailed information as we perform our review.
The Town may hold a public hearing on December 16, as you indicated in your letter requesting this
review, but you may not make a decision on the proposal until you receive our 239 recommendation. You
may want to keep the hearing record open until you receive our recommendation.

for the above referenced property. At this time we can not process your application for
conversion any further. From the information I gathered from the Tompkins County

Dear Ms. Carey:
This letter acknowledges your referral of the proposal identified above for review and comment by the
Tompkins County Planning Department pursuant to §239 -1 and -m of the New York State General Municipal
Law. The Department has reviewed the proposal, as submitted, and has determined that it is incomplete.
GML§239 —m requires the referring body (the Town of Groton) to submit a "full statement of such proposed
action" to the county planning agency. A "full statement" is defined as all materials required by the referring
body as an application on the proposed action. The required materials are outlined in the preliminary site plan
checklist in Article 4, Section 441 . 3 of the Town' s Land Use and Development Code . We are unable to
complete our review without a full statement that includes a site plan that is drawn to scale showing:
boundaries of the property (including highway rights of way),
location of parking for all proposed uses,
location of access and egress,
- provision for pedestrian access,
- location and design of buffer areas, including existing vegetative cover.
The Department offers the following preliminary comments for your consideration:
We are concerned that the proposed use of the site for a used car lot will create visibility problems at the
existing intersection. Without a site plan drawn to scale, it is difficult to determine if there is room for the
proposed 16 cars without encroaching on the right of way. Parking should also be provided on site for the
apartments and offices proposed. We are also concerned that there is not enough room for internal vehicular
circulation. A back in, back out configuration on the entire site creates a dangerous vehicular and pedestrian
situation.
There should be a landscaped buffer between the roadway and the proposed vehicles to provide an improved
aesthetic to this major intersection in the hamlet of McLean. The buffer should also provide enough room for
safe pedestrian movement outside of the roadway.
We look forward to receiving additional information to complete our review of this proposal .

Dear Mrs. Koski,
TO Miller, P.C. was hired by Mr. Augie Adams to review the existing structure and septic
system at 3 Stevens Road 1n .the Town of Groton and correspond with your office to determine
an acceptable use of the property.
It is my understanding that in November of 2004 Mr. Adams submitted a Sewage Construction
Permit Application for the property with the intent of expanding the septic system to allow for the
use of the property as either an apartment complex or a pizza parlor. You denied this request
in a letter dated November 19, 2004 which stated the tot was undersized to accommodate an
expansion under the waiver provisions of the current Sanitary Codes.
I reviewed a survey map prepared by Denkenberger and Green dated 6-23-92 and last revised
10-21 -04 and concur with your assessment that the lot does not have suftIcient free space for
an expansion of the existing system .
I performed a site inspection on 5.13.05 to try to determine the location and size of the existing
system as well as to review the existing use of the structure.
I was unable to determine the exact location of the existing septic system beyond the septic
tank. The lateral foam the structure leaves the east side of the building and according to Mr.
Adams flows into a buried septic tank just west of the Lafayette Road right-of-way. This tank
was buried at the time of the site visit so I was unable to determine Its size or where the flow
goes after leaving the tank .
The existing structure is a two-story framed structure. The upstairs was apparently last used as
an apartment as it has a full bathroom, and washer and dryer hook-ups, It is serviced by its
own hot water heater. The space is very undefined but as an open studio apartment could
accommodate 2 or 3 beds. The downstairs was apparently used as a retail space as it includes
a separate half bath and a kitchen sink also with it's own hot water heater. This space is open
as well but apparently has been used for one large or two small otficetretall spaces.

In discussions with Mr. Stephen Maybe of your office we Moth agreed these conditions would
dictate that Mr. Adams keep the existing use of the building the same so as. not to overstress
the existing septic system .
These were my findings on the current use of this property. I make no certification as to the
functioning of the existing system, nor any interpretations of the local building or zoning codes
that may dictate the use of the property.

Dear Mr. Coats :
As you are aware, Augie Adams applied for a sewage system permit to convert the above
property into a pizza parlor or multiple apartments . The conversion permit was denied because of
the limited size of this parcel . However, we would not object to utilizing the current sewage
system for the existing or similar building use as long as it is functioning properly.
We concur with Andrew Sciarabba, P .E. regarding his findings and recommendations (see
attached letter) . The studio apartment must not exceed one bedroom. The downstairs must be
used for retail office space only. We recommend that the drinking water be tested for bacteria
and nitrate on a regular basis .
