that serves 477 Lafayette Road . As we discussed, we appreciate the letter that you provided during our meeting from
Better Housing regarding funding for a drilled well for 477 Lafayette Road . It appears evident from this letter that it is
only a matter of time before the spring is disconnected .
We will contact you again mid- September to determine the status of your drilled well and the connection to the Whalens .

Re : Spring Water Supply, 501 Lafayette Road, Town of Groton
Dear Mr. and Mrs . Dexter:
On May 24 , 2006 , the Department was contacted by Paul Speight (Turtle Dreams B&B ,
481 Lafayette Road, Groton-T) regarding a waterline that was severed during the
installation of a new sewage system on his property . During that time we became aware
of a spring located on your property that serves a home at 470 Lafayette Road owned by
Doris Short. The waterline from the spring apparently is routed through the Speight
property and gravity fed downhill to the Short property located on the west side of
Lafayette Road. That day I met with Doris Short and Paul and Fran Speight to inspect the
spring and discuss the situation. The result of our investigation is summarized below.
The spring is an uncovered shallow source constructed from concrete blocks . Pictures of
the source were taken during the visit. I mentioned to everyone present that this spring is
an unprotected water source that is subject to contamination from disease causing
pathogens found in surface water such as enteric viruses, e-coli bacteria,
cryptosporidium, protozoa and giardia. UV or chlorination disinfection alone is
insufficient to ensure that the water is safe to consume . I mentioned that the water is not
safe to consume and commercial bottled water should be used for drinking .
During a phone conversation with you on 5/26/2006, we discussed that this is an unsafe
source. We also discussed, Article S- 7. 01 b. of the Tompkins County Sanitary Code that
states "No persons shall serve, provide or make available or accessible for others,
drinking water which is not potable or from a supply which is not protected or
maintained ".
Despite the deed restrictions you shared with us, since the spring is on your property we
deem you are responsible to comply with Article V1I . Therefore :
You must submit your written plans for correcting this violation to Tompkins
County Health Department. The plans must include how improvements will be
made to the present source, or disconnect the source, or develop a new source on
your property (drilled well), or Mrs. Short to drill a well on her property. The plan
must include a time frame on when work will be completed . Please submit the plan
by August 31 , 2006.
We encourage all involved to work together to agree on a satisfactory solution that will
provide safe water. In the interest of public health, the best option would be for the Shorts
to drill a well on their property . If the spring must be improved (rather than replaced)
please call us to discuss in detail the work that needs to be done .

6. The intent of the project is to modify the current property to provide an Agri-tourism
Destination within the local community. The project will provide an educational, story
telling, workshop center. The overall project will be done in two phases.
The Phase I project will provide the following:
Retain a Landscape Designer/ Engineer to develop land use designs.
Retain an Architect for the design modifications for the house, stage, kitchen-bath-house,
60 ' diameter timber framed lodge.
Design and Upgrade the existing Bed & Breakfast facility to provide a new living space
for the family, an upgraded dining space for the quests, upgrade the kitchen space, add on
a new two story covered deck on the West & South sides of the building.
Design and construct a new Rustic Privacy Fence for the 656' South property line.
Upgrade the current driveway and parking lot to accommodate 60 cars and bus access .
Design and construct a 15 'x 25 ' timber framed (pressure treated) covered stage.
Design and construct a Long House type kitchen and bathroom building. A new septic
system will be installed for this building. A new well will be installed to provide water to
the kitchen/ bath-house facility .
Design and Construct a 60' diameter Yurt style timber frame facility. This structure will
accommodate 100 people, have open side walls and covered with a fire rated canvas roof.
Design and construct ten ( 10) 8 'x 8 ' vendor "temporary-use" sheds for events.
Level an area in the NE corner of the property to set up four (4) 24 ' diameter Tipis.
Construct a 30 ' diameter YURT to serve as a classroom/ training facility.

Phase U of the project will provide the following:

It is intended that these units will be self-contained in nature. Self-composting toilets will
be installed, solar and/ or wind power for utilities, an independent well for all 6 units,
"gray water" to be delivered to the kitchen-bathouse septic system.

8. Turtle Village will work with all the required agencies to ensure compliance with local

Homestead- we have cultivated a large vegetable garden and plan on expanding it to
produce enough for a roadside fruit and garden stand. There are approximately 25 apple
trees that will produce fruit fof the stand .

renovated barn circa 1850 situated in the rolling hillsides of Groton .

This project will enhance the agritourism and education experience in New
York by providing accommodations for school groups, scouts and other
groups from across the state and region. Our educational aspects will include
the use of the "Ag in the Classroom" learning kits (provided by CCE),
learning about small homestead style farming and visits with farms that will
provide comprehensive tours with hands on experience . We can also offer
stream studies of Fall Creek, studies of the night sky, bird watching, and
more . Our central location provides a destination that is close to I41 , Ithaca,
Cornell , Cortland, the Finger Lakes and is situated in the esthetic rolling
hillsides of Groton. This project will open from April to November and costs
will range from $ 12 .00420 .00 per person per night and include breakfast.

PROJECT DESCRIPTION (please limit to one page)
Briefly describe the work for which funding is requested and how the project fits into one of the
three grant option categories (see page 1 ).
The Turtle Village project that we are seeking funds for fits into the stop and stay
category. The 50,000 dollar award would be used for: the site development, construction
materials, well, plumbing and electrical costs of a handi-capped accessible bath house
accommodating 40 to 50 people, the building materials for a dining pavilion/ classroom,
4 tipis for lodging, anA expansion of the parking area.
Education—We would host school groups, scouts, organizations and other guests
for overnight visits on our homestead farm. We would develop a list and arrange visits
with local farms providing a safe and comprehensive tour of their operation. We would
provide safe, fun, hands on instructional learning opportunities that would deepen
participants understanding of the agricultural industry and the role it plays in New York
State. Our programs will be comprehensive and use the "Ag in the Classroom" learning
kits to insure the appropriate criteria are met for the visiting group. We will also work
with scouts to be sure badge requirements are met. We are able to offer additional classes
such as : Fall Creek stream studies, the night sky and bird watching. We will work with
educators and adapt the program to meet the needs of guests. The program ' s recreational
component will include storytelling around a campfire, tandem bike powered plow relays
and down time for volleyball, frisbee, badminton and other games.
Agriculture- We would promote the farms on the growing agritourism list as well
as local farm tours and other agritourism venues that are able to host class sized tours.
We would provide a safe destination in a convenient and picturesque location for groups
from across the state and region. The Turtle Village project is situated on a property free
of typical farm hazards and the bathhouse being of new construction contributes to a
project that has ideal safety and accessibility conditions. This project will promote the
agritourism industry and provide revenue to farmers who are able to host safe tours. This
project will have spin- off revenues for the local markets and other area tourist
destinations.
Accommodations- The Turtle Village project' s unique lodging will provide a
truly down to earth sleeping experience. Tipis are really wonderful sleeping spaces that
will help participants get connected with the outdoors and enhance their experience in the
country. Turtle Village breakfast ' s will feature local farms produce whenever possible
and will provide selections for vegetarian and non-vegetarian patrons. We will keep the
fees family and school friendly as to accommodate for diverse financial resources.
Qualifications- We have the skills to make this project happen. We have 16 years
worth of combined educational experience including eleven years of teaching adapted
physical education, four years of special education classroom experience and one year as
a high school student activities .director. Both of us were summer camp instructors, we
are both lifeguard and CPR certified, we have both been asst. Girl Scout leaders and we
are both certified Special Olympic coaches. We have worked together in all the above
capacities to provide quality recreational programming for children. We are already
business partners for our family friendly bed and breakfast and the safety of our guests is
our first concern. I have also been a camp cook, serving up to two hundred and fifty
people, spent three years as a pastry chef apprentice and have cooked in restaurants all
over Australia_ Canada and the I Jnited States.

I . Two (2) wells will be installed for the project. One septic system will be
installed per Tompkins County Health Department requirements. The self
contained living units will be served by a "public" well and pump, have self-
composting toilets, and a Gray water drainage system.

provide recommendations on accessibility in case of an emergency .

may require a central distribution building. At this time we are not sure what

The meeting was called order at 7 :30 p . m. by Acting Chairman Brad Albro .

Acting Chair Albro recognized Fran Speight who was seeking approval to operate a bed and breakfast in
her home. In response to Acting Chair Albro 's questions , she stated that the home had previously
been a bed and breakfast and , after she and her husband purchased the home , they wished to
continue the business ; it was strictly a change in ownership. They would be using three second - floor
bedrooms, two with baths and one smaller room for guests; the Speights would occupy the first floor as
their residence .
Member Gloster asked about the permits required and CEO Senter stated that a bed and breakfast was
different from a hotel , ` so it would not require any special permits from the Health Department, etc .
CEO Senter explained to Ms. Speight that she was allowed five bedrooms , ten lodgers , and has to be
owner-occupied . He also stated that it met all setback requirements, etc . There was sufficient parking
in the rear of the home .
Mrs . Speight stated that the name of the business would be "Turtle Dreams Bed & Breakfast. " With
regard to a sign , she advised that she would be using the sign that was there . CEO Senter commented
that she would need to come in and fill out a sign application .
Having a public hearing was discussed . Member Baxendell stated that this is an existing business and
is simply changing owners , so he did not think a public hearing should be held .
With no further discussion , a motion was made by Member Tom Guihan to waive the public hearing
and approve the bed and breakfast as requested . The motion was seconded by Member Janice Haines ,
with the vote recorded as follows :

Dear Mr. and Mrs . Speight:
We appreciate your letter dated August 29, 2005 (received by fax on 9/ 13 /05 ) regarding the water source serving 1350
Elm Street Extension, 473 Lafayette Road, and 477 Lafayette Road , Groton-T. We have agreed to cancel the office
conference- scheduled for Friday, October 14 , 2005 .
You mentioned in our phone conversation on Tuesday, September 13 , 2005 , that the Aikens have drilled a new well to
serve their two properties at 1350 Elm Street Extension and 473 Lafayette Road . The Whalens are in the process of trying
to obtain funding to drill their own well, and Turtle Dreams has consulted with Randolph Well and Pump to drill a well .
You stated in your letter that you have been providing commercial bottled water to your guests .
Section S- 7 . 01 of the Tompkins County Sanitary Code requires that no one may serve or make available drinking water
from a supply which is not protected or maintained . You must stop providing water from a poor source . You may either
provide water from a satisfactory source or abandon the source . Our concern was that you work with the neighbors and
not abruptly stop the connection . You indicated that you have been working with the neighbors .
We appreciate that you have been providing bottled water to your guests and all of your efforts. We also understand that
you inhcritcd this water supply with the purchase of your property, and have showed concern that the water from this
supply may not be safe to consume . We will contact you again in 4 months to determine- the status of your drilled well and
the connection to the Whalens .

Subsection S-7 . 01 of Article VII of the Tompkins County Sanitary Code (TCSC) states that:
b . No persons shall serve, provide or make available or accessible for others, drinking water which is not
potable or from a supply which is not protected or maintained .
c . All drinking water supplies shall be developed, maintained, and operated in accordance with the latest
published NYSDOH specifications, principals, and practices .
As you are aware, the water source that serves the Turtle Dreams Bed and Breakfast and three other adjacent properties
located on your property is an unprotected water source that is subject to contamination . In our August 9, 2005 letter
(attached), we requested written plans for correcting the violation to Tompkins County Health Department before August
31 , 2005 . As of this date, no plans have been received .
Therefore, we have scheduled an office conference for Friday, October 14, 2005 , at 10 : 00 a . m . , in the Environmental
Health offices at 401 Harris Dates Drive, Ithaca, NY, during which we will discuss the enclosed Draft Compliance
Schedule . This agreement is offered as an alternative to a formal administrative hearing. If you agree with the draft
agreement, and are willing to sign it without discussion just return the signed agreement before the date of the office
conference . Please contact Stephen Maybee, P .E. at 274-6688 if you need to reschedule the meeting to an earlier date .

Dreams Bed and Breakfast to also serve 1350 Elm Street Extension, 473 Lafayette Road, and 477 Lafayette

We also agree to comply with the following Public Health Director' s Orders effective when signed by the
Director :
1 . To submit written plans for correcting this violation to Tompkins County Health Department before October
31 , 2005 . The plans must include a time frame on when the new well will be drilled . If we do not intend to
continue supplying water to the neighboring properties, the plans must include a time when the current
water source will be disconnected .
I understand this agreement is offered as an alternative to a formal administrative hearing and that we are
subject to further enforcement action if we fail to comply with the Orders .

The water source is apparently a spring on a hillside . The only features that can be
observed are a pipe from the spring that flows into a small cattle water trough . The water
trough has a section of corrugated metal roofing over it to keep debris out. From the
water trough the water is distributed by gravity to the above residents .
This spring is an unprotected water source that is subject to contamination from disease
causing pathogens found in surface water such as enteric viruses , e-coli bacteria,
cryptosporidium , protozoa and giardia. UV or chlorination disinfection alone is
insufficient to ensure that the water is safe to consume. This water is not safe to
consume and commercial bottled water should be used for drinking.

To abate this violation , an adequate source of water must be provided . During our

proposed educational project. In addition, you also mentioned your desire not to be
responsible for this spring on your property. Attached please find a list of registered well
drillers .
You must submit your written plans for correcting this violation to Tompkins
County Health Department before August 31 , 2005 . Include a time frame on when

We the neighbors of the surrounding area of Turtle Dreams Bed & Breakfast
have the following .conces and questions regarding the expansi
rn on of their
business operation :
1 . Insurance Coverage: Is there adequate insurance to cover off site
accidents resulting in lawsuits (le. Injury/death in Fall Creek or along
LaFayette Road & Elm Street)? Property damage to neighbors (fire,
trespassing, theft)? Are we as neighbors exposed to liability? How
much coverage do they plan on obtaining? Is this a minimum required
or are they planning to go. above and beyond that if needed?
2. Fire Safety: The McLean Fire department has expressed concern over
.fire truck access to the proposed kitchen/bath house and the tipis. Paul
has said there will be fire pits in each tipi plus a bonfire area. We, as
neighbors are concerned for our property if afire gets out of control.
This could also be a liability issue for both the town and/or the residents
if, for instance, there , is a lawsuit due to injury or death in a fire where
the fire trucks were restricted because of access or if afire were to
cross the adjacent property lines. What is the fire - safety plan? Do they
plan on working with the local .fire officials to have an adequate access
in case of a fire?
3. Increase in traffic : By growing from a 4 bedroom Bed and Breakfast to a
facility accommodating up to 60 persons, there is a potential for a large
increase in traffic on the rural -roads surrounding . In the case of special
events (such as :.weddings & reunions the amount of local traffic will be
:greater. There is also the risk of guests driving while intoxicated after
attending a wedding or reunion as stated by the Speights they will be
allowing guests to provide their own alcohol.
4. Parking facility. The site plan drawing shows an area designated for
parking. What is the maximum capacity for thes parking ' lot? If there is
a special event where the number of cars exceeds the parking lot
capacity, where will the, overflow parking be? There is no shoulder on
Lafayette Road in this . aarea and Turtle Dreams is located on a blind
curve, therefore parking along the road could be hazardous and
.prompts the, question of liability to the town and residents traveling the
roads that may have an accident when confronted without a proper view
of the corner and drivewa�s if cars were obstructing such view.

5. Noise: Turtle Dreams is located in a quiet, residential area with working
families and young children. litany of these families rise at an early .
hour for work. The Speight's advertise didjeridoo and drum circles, and
are planning a stage in their expansion (for; possible concerts and , ,
plays). In addition, special events such as a wedding, would mean a
band or DJ playing to a. larger crowd. What allowances will Turtle
Dreams make to keep the character of our community peaceful and
rural? Will they accommodate ' curfew and a reasonable time for
weeknights and weekend activities to cease?
6. Formal business place. What is the business plan? What is their goal
for the future (2 years, 5 years, 10 years)? Will "Phase 2" resurface with
further expansion? If no farms agree to allow "Ag-tours", is this still an
agricultural endeavor? ` Do they have any agreements with any,local .
farms for hosting Ag-tours? What type :and quantity of 'animals do they
plan to raise? How do you plan to keep these animals upon -their
property?
7. Guest activities: We have received mixed messages about the activities
available and the age groups that will visit Turtle Dreams. What is the
target age group? ®u'r .concern is that young people who are not
constantly entertained will be tempted to stray. For example, a group of
young adults (assuming with chaperones) comes on are overnight trip.
Some individuals . become bored or there is a lull between activities so
they go out to explore . the surrounding areas, the result could be
trespassing , damage to private property; or personal Injury upon
neighbors land. The ' Speights have shn on the site plan map- that
most of the borders are Ri
. natural. oor

8. Existing spring : There is currently a spring fed waitercourse In the
Northeast corner of the Speight's property that servesAhouseholds.
The reservoir . is above the ground and could easily be contaminated, as
could the watershed, during construction or by guests. That measures
will be taken . protect the quality of the watershed and above ground
tank?
9. Fall Creek usaqe : Turtle ®reams is advertising Fall Creek as an .
attraction (canoeing/paddling, tubing and fishing ). The ''Public Fishing
Rights" access points are defined on the DEC Website as "permanent
easements along game fish streams .that allow the public to wade and
walk along the streambed and banks for the purpose of fishing, and for
no other activity". Much of the stream is private (see attached map)
which is not accessible to fishing. Accidental injury or drowning could
result from unauthorized use of the stream and its access points as well
as property damage from trespassing.
We have met with the Speights and toured their Business and as you have
read above we have many questions that leave us with concerns about the
future of our neighborhood. Therefore we request that their application be
denied. Thank you.
