Secretary Roger Gleason , Old Stage Rd . *Cecil Twigg *Monica Carey Verl Rankin *Bill Casolara G . TOTMAN , Chairman opened the meeting at 8 : 15 p . m . when a quorum was reached . C . TWIGG made the motion the July , 1987 minutes be approved as presented ; B . CASOLARA seconded the motion ; and the MOTION CARRIED . TOTMANs Philip Munson was scheduled first on the agenda but he is not here so we will move on to the second item . Last Friday night I talked to a fellow who wanted to build a 30 x 50 foot barn , which is not our problem , but in that barn he wanted to establish an auto repair shop . SITE-PLAN REVIEW for Auto Repair Shop proposed by Donald Scheffler , 1364 Sovocool Hill Rd . , Town of Groton . Tax Map No . 24- 1 - 15 . TOTMAN : Mr . Scheffler knows he did not get it in within the ten days prior to the meeting and he called me to see what the particulars are he has to follow . I explained to him if he wanted to come to tonight ' s meeting to show the Board what he proposes , the Board would decide how to handle it . CASOLARA : What is the ten days in relation to ? TOTMAN : In relation to the business of the Board meeting . CASOLARAs Just for our purposes ? TOTMAN : Yes , so it can get on the agenda and we know what is happening the night of the meeting . CASOLARA : I would comment that I was aware of this beforehand . TWIGG : This request is for a special permit ? TOTMAN : Yes , he plans on repairing cars for hire . CAREY : You are going to put up a new building? SCHEFFLER : Yes , the buildings I have are not suitable for what I want to do . PLANNING BOARD -2- August 18 , 1987 I TOTMAN : The house that Mr . :>Munson owns , is that directly across the road from you or down the road? SCHEFFLER : It ' s . across the road and on the corner about 1 , 080 feet away . That ' s the only other house on the block . TOTMAN : The major effect that I can see he would have would be on the last parcel of land Munson - is selling . CASOLARA : There isrno one there now . TOTMAN : Not •now , no . TWIGG : Actually a repair shop is not that , well actually the noise is not that much , it is when they start piling junk around . TOTMAN : As long as he hasn ' t started yet , we can do it on a much better basis than trying to get things cleaned up after the fact . You can put stipulations in the permit - so itAdoesn ' t become like a junk yard . TWIGG : ( referring to map provided Board ) This is your house and barn and you are putting it in the field west of the house ? SCHEFFLER : There is a floor and foundations there where a saw mill was at one time . We would be building it there , it would be directly north of the first building you come to . CASOLARA : In relation to the environmental assessment what about storage of fuels , gas and the containment of waste oil or any other petroleum by products . SCHEFFLER : The waste -.- oil I would have to keep in a tank to be pumped , other than burning it in a waste6-Voil heater , that is possibly something in the future I might do . Other than burning it , it is put in a tank and having it pumped , that is what I would do with it . CASOLARA : I ' m comfortable with that ;`� and ''; I4kn6w�rthrough his job that he is aware of the environmental impact of petroleum products . I have no problem with it . He knows he has to meet certain regulations . TOTMAN : How about the number of cars in the area , you are not going todo any selling , right ? SCHEFFLER : No , I don ' t plan on it . TWIGG : . This thing is back off the road how many feet ? SCHEFFLER : Around 150 feet from the road . TWIGG : Your house is between that and the road , so that really should not be much of a problem if people build across the road . PLANNING BOARD -3- August 18 , 1987 SCHEFFLER : They wouldn ' t be building directly across the road , it would be kitty corner: TWIGG : Even if they did build across the road , it is set back far enough it should not affect the neighborhood at all . TOTMAN : What would you be comfortable with in the number of cars setting outside the garage , visable from the road? SCHEFFLER : From my own standards , I would not want too many . I plan on a one -man business for quite a while . I can ' t forsee any more than 10 at any one time . TOTMAN : You are also aware there is a regulation , not only from the Town but the State , concerning the number of unlicensed vehicles sitting on lots . The reason I mention that is , somebody might bring a car in that is not repairable but you can use for parts , and it sets there and it becomes an eyesore to the rest of the area . The Town of Groton states you can ' t have more than 2 but the State rules include debris and junk and unusable machinery , cars and such just setting there not being used or with no intention of being used . You would be comfortable with the limit of no more than 10 outside the barn located within the area of the barn , not in front of the house ? SCHEFFLER : Also there is a row of trees on two sides of the building so it would act as a buffer . TOTMAN : ( to the Board ) You have the option tonight to approve it tonight . You have two options . ONe to go with the short form Site Plan Review and not go to a public hearing , there are no-: neighbors living around there now ; then a motion to approve with stipulations or disapprove the proposal: CASOLARA : Are you going to put up a sign? SCHEFFLER : I had not thought much about it other than the repair shop sign that goes on the building . CASOLARA : There is no problem with a sign , I only bring it up to make you aware there are regulations with regard to size of signs . I did want to make you aware of that fact if you did want to put a sign up it must meet the regulations , as to the size and where you put it . SCHEFFLER : I can live with that . TWIGG : I see no need for a publich hearing since there are no neighbors . CECIL TWIGG made the motion the Board go with the Short Form Site Plan Review without a public hearing for '.:theq= proposed Auto Repair Shop by DONALD SCHEFFLER AT 1364 Sovocool Hill Rd ; BILL CASOLARA second the motion . PLANNING BOARD -4- August 18 , 1987 VOTE : All in favor Motion carried . CECIL TWIGG made the motion the Planning Board approve the Site Plan Review forpan Auto Repair Shop proposed by DONALD SCHEFFLER , 1364 Sovocool Hill Rd . with the stipulation 1 ) limited to 10 cars in close proximity outside the building ; MONICA CAREY seconded the motion : VOTE : All in favor Motion carried . PROPOSED RURAL SUB-DIVISION for the MARVIN TOROK property located on Sincerbeaux Rd . , Pleasant Valley Rd . and Torok Rd . in the Town of Groton presented by ROBERT WALPOLE . Tax Map No . 31 - 1 -26 . WALPOLE : w11' approached the Board in May and indicated we would be selling the property of Marvin Torok at public auction . ( referring to worksheets presented previously ) Unit 1 on Sincebeaux Rd . , consisting of 2 parcels was sold as one unit ; thereais no subdivision involved there . Unit 2 with Parcels 3 , 4 and 5 was sold as one unit . The new owner of Parcels 4 and 5 plans to sell those parcels to Marlin Houston . TOTMAN : That does not require a subdivision if dividing parcel into two . WALPOLE : Unit 3 : Parcel 9 was sold as separate parcel , Parcel 10 was sold as separate parcel , Parcels 7 and 8 were sold as one unit that becomes 17 acres and Parcel 6 becomes five acres to meet the Rural Subdivision requirements . That requires Rural Sub-division approval . UU Unit64 , Parcel 11 : There was a variance on record , transferable by deed , was sold as one unit . TOTMAN : To clarify , the Board of Zoning Appeals approved a variance for this in April , 1981 giving variance for the road frontage . WALPOLE : Unit 5 , 61 acres , Parcels 12 , 13 and 14 was sold as one unit . All acres , based on new survey exceed the five acres plus needed for a Rural Sub -division . We are asking for a Rural Sub -division approval on Unit 3 . TOTMAN : Do you have the maps for that all put together? WALPOLE : We are not providing surveys for the whole thing . We are providing surveys with the house parcel only . The deeds will be recorded as is . PLANNING BOARD —5— August 18 , 1987 TWIGG : ; There is no survey map for the whole thing? WALPOLE : There will be survey map for Parcel 10 and Parcel 6 , there was no reason to survey the balance of it and we wall survey the west line of Parcel 14 , TWIGG : Does Parcel 6 go to Parcel 10 ? WALPOLE : No . CAREY : Does Parcel 8 come down between Parcel 6 and 10 ? WALPOLE : Parcel 8 has frontage on both roads ; 170 feet frontage on Torok Rd . CAREY : Parcels 7 and 8 are one unit ? WALPOLE : Yes . TOTMAN : A survey is required on the whole only.gif the Board requires it . WALPOLE : We have surveys on the house and on Parcel 10 . I don ' t think its necessary to survey any other units ; as they were sold as whole . CAREY : How much is the road frontage with No . 10 ? WALPOLE : 470 feet . Parcel 9 has 460 ; the total involved with 7 & 8 is close to a thousand feet . TOTMAN : When you make out the request for the Rural Subdivision and we sign it , it has to go to the County Clerk for filing . CASOLARA : Have these been sold already ? WALPOLE : The deed has not crossed hands . The purchase offer states we have to meet this regulation before we can pass title and the bankruptcy lawyers have the final say on this . TOTMAN : The Board is familiar with this type of subdivision; with what is required ? TWIGG : They are all five acres lots or more . TOTMAN0 As far as I know , right now I don ' t have an application . WALPOLE : We brought 3 or 4 copies to the Clerk ' s office . TOTMAN : Ok , it came with the minutes . WALPOLE : I will send the copies of the surveys when they are received . The west side of Sincerbeaux Rd . will be surveyed . We will send copies of surveys for 6 and 10 when we receive them . PLANNING BOARD - 6- August 18 , 1987 BILL CASOLARA made the motion the Board approve the proposed Rural Subdivision of the MARVIN TOROK property located on Sincebeaux Rd . , Pleasant Valley Rd . and Torok Rd . Tax Map No . 31 - 1 -26 ; CECIL TWI= seconded the motion : VOTE : All in favor Motion carried . PROPOSED SALE of ROBERT H . & MARGARET M . KLUGE at 690 Clark St . Extension , Town of Groton , Tax Map No . 17 . - 1 - 26 . 1 : WALPOLE : This is presented to the Board for informational purposes to let you know the planned sale by Auction of the Robert and Margaret Kluge property on Clark St . Ext . ( read attached letter ' dated August 18 , 1987 from Glenn H . Munson & son , Auctioneers ) . I would like to brief you on what has occurred in the last ten days . No . 26 . 2 was sold at publickauction a year ago and they are building a new home on it . Robert and Margaret Kluge have sold in the last ten days 44 acres , marked in pink on the map . We are going to be selling the remainder of the parcels , no . 1 , 2 , 3 and 4 on September 4 , 1987 . We are going to be offering it as a combination and as an entire package . It may be sold as an entire package , and if so that tax parcel will include 92 . 58 acres and it will only be broken into 2 parcels . The pink is 44 acres , Parcel 2 will #'containuapproximately 15 acres , Parcel 1 will contain approximately 15 acres , the two building lots fronting on the Salt Road will contain approximately 9 acres each . We will be doing a survey on this property except for the 44 acre , we had nothing to do with that sale . TOTMAN : What you are basically saying here , Bob , you are making the Board aware of it so that at a subsequent meeting when you return , if you sell this land and come back and request approval for a rural sub-division . WALPOLE : At this point I am advising you that this is going to happen on September 41 and to make you aware we may be applying for a Rural Sub-division , TWIGG : Which parcel is the house ? WALPOLE : The house sits on Parcel 1 . If there are any questions I want to iron them out now before . When the proposal is printed up we will send it to the Board . PROPOSED MAJOR SUB -DIVISION proposed by ROGER GLEASON Old Stage Rd . , Town of Groton , Tax Map No . 121 - 1 - 21 . 21 GLEASON : I brought in the survey , I ' m not sure if its what you wanted . I told him what I wanted and he gave me this yesterday so I brought it with me . I have five copies . PLANNING BOARD -7- August 18 , 1987 TOTMAN : What you ' re saying is you are breaking this up into 3 parcels and you are asking for a Major Sub -division? GLEASON : We have to do it that way because of the previous activity on the parcel . TOTMAN : We have to have a public hearing . GLEASON : I think the map does meet the meet the criteria you gave at the June meeting except for one thing you asked for . Item 3 before make a Major Sub -division you have to have the perk test , things for sewer and water . I discussed this with Mr . Anderson of the Health Department . We are doing this as a Major Sub -division because of the number of pieces but I have nothing to do with the sewer and water , the individuals buying the property will be putting them in, . At this point we know not where they will be putting the houses . So whatever we do will be a waste of money and time and they ( Health Department ) don ' t want to come out . If you take a soil map , which I brought with me , it is Bath-Valois Howardasoil :r� Ittis very suitable for house sites . We are not putting in small lots . They are 2 . 6 , 2 . 7 and actually Proper ' s will be 14 acres , which the most that will be on it is 3 houses . TOTMAN : Basically all we are doing tonight is looking at the preliminary plans and calling a Public Hearing . The Public Hearing canbe set for the September meeting if you desire to accept what Roger gas given us . After the Public Hearing , either that night or later , we can make the decision . TWIGG : I see nothing wrong with what he has presented so far . CASOLARA : I just want clarification on the missing item Roger mentioned . TOTMAN : There are people who will disagree with me , but my feeling is when you are dividing land for the sole purpose of dividing land , some of the things we look for in a Major Subdivisaido not apply . Number one you do not know what is going to happen to the land . You have no way of knowing when a guy buys nine acres of land where the house is going to go on that so you can ' t do a sewer and water test . Which is , in difference to that , if you got that land and you want to put a little industrial park in or you want to take that land and put in &. ten unit sub-division in there then you are going to have to follow the rules because then we know what you are going to do with the land . In this case , the perk tests for water , we don ' t do that anyways , the Health Department does that . Roger read it in the book that the Board can require that . We have not asked him for that . GLEASON : The :las:tatime we talked about this you said I needed to . TOTMAN : The main purpose we are here tonight is to determine if what Roger has presented to us is enought so that we can take it to a public hearing . i PLANNING BOARD -8- August 18 , 1987 TOTMAN : Are there any questions or a motion to put forth? No more questions from the Board . MONICA CAREY made the motion the Board accept the proposed plans for a Major Sub-division presented by ROGER GLEASON , on Old Stage Rd . and Clrk St . Ext , in the Town of Groton and set a public hearing for Tuesday , September 15 , 1987 at 8 : 00 p . m . ; BILL CASOLARA seconded the motion . VOTE : All in favor Motion carried . TOTMAN : If no further business to come before the meeting , the meeting is closed .
