Secretary *Verl Rankin *Monica Carey *Cecil Twigg G . Totman , Chairman , opened the meeting at 8 : 00 p . m . Minutes of the May 20 , 1986 meeting were read and approved as presented . PROPOSED Minor Sub- Division presented by LESTER SMITH , Champlin Rd . Town of Groton . TOTMAN : This is the preliminary application of Lester Barber . The proposal consists of Parcels A , B , C , and D . Parcel D has 3 . 8 acres ; Parcel C is 2 acres ; Parcel B is 2+ acres and Parcel A is 2+ acres . Three parcels have 250 foot road frontage and the fourth has 650 foot frontage . Parcel A is 435 feet deep ; Parcel B is 450 feet deep ; Parcel C is 385 feet deep and Parcel D has on one side 385 feet and the other side is 107 feet deep . This land is on Champlin Rd . just north of the Hamlet of McLeaa:_o The nearest residence to this property is occupied by Lester Barber ' s daughter . The request is to divide into four parcels of land creating a minor sub - division . Mr . Barber proposes to have put in the deeds for the parcels the restriction that there will be no mobil homes placed on the lots and that the homes built on the lots conform to the homes already in the area . ( In related business ) TOTMAN : I have received phone calls questioning whether we should be having more Public Hearings on Sub - divisions . I spent the afternoon going through the Ordinance to figure out ^whether it is legal to go the short procedure without a public hearing . The Rules and Regulations we have have some ambiguities in procedures to follows . For example : Section 202 . 2 : . . . resulting in 3 to 5 lots with less than 5 acres no public hearing is required . The facts are ` r�eviewed in 2 preliminary meetings by the Board and may require a public- hearing if desireable by the Planning Board . . . ; Section 234 : says-} - . a public hearing shall be held 45 days after submission . . . ; Section 290 : . . . where Planning Board finds , due to special circumstances to goal improvements do not require a Public Hearing ; . . . waive such requirements provided such waiver does not effect or : ,' , n'111fy intent of the official map . PLANNING BOARD meeting - 2 - June 17 , 1S86 TOTMANa I take it from that , an area where there is no direct neighbors , there are no homes across the road , the only home bordering the area agrees and is a member of the family . In this case , you are taking a wooded area that is not at this particular point or in the past of any value to the Town as far as tax - _ basis and your going to put at least 60 to 70 thousand dollar homes on it . TWIGG : It is left to our discretion whether we have a public hearing . CAREY0 Who is there to complain ,; ( concerning present proposal ) TWIGG : What is the Town offibialsLinterpretation of the Ordinance? TOTMAN : As you read the Ordinance back and forth through , it creates questions . TWIGG : Where does it say we have to have a public hearing? OSTRANDER : Is there a problem of time involved here? ( speaking to Mr . Barber ) BARBER : I do have a man who wishes to build , however , he ' s anxious to do something there but he does not want to order until he has approval . There will be a months waiting after he orders before the material is delivered . That would put him into the middle of July before he can start building . This is the only thing . OSTRANDER : We. u_are required to have a plat made of this proposal . TOTMAN9 I explained to Mr . Barber that we could not pass proposal with a sketch . We have to have the surveyors layout . We can ' t pass it unless we have a full sketch plan . . The only thing we could do is pass it if we want to and have the date of passing - upan the submission of the property sketch plan . OSTRANDER : I don ' t see any problem with it . I ' m quite confident it . will -_ be passed but I ' m wondering if we should form some sort of pre- cadence , whether we should always do a public hearing . WE could do it within ten days . . . . someone else want to do one . On Rural Sub=Divisions . . . . if there is a problem we could go with it . TWIGG : I don ' t see why we should have a public hearing on it . They put us in here to make a few decisions . - If there was a traffic problem , it would be different . That is why we are here , to make these decisions . OSTRANDER : If we had a public hearing , could we pass it that night ? If everything was done , we could pass it at that time? PLANNING BOARD - 3 - June 17 , 1986 TOTMAN : It depends on the circumstances . If the proposed sub- division is in a populated area , where all kinds of people are living around the area , those people should have a chance to voice their opinion on what goes in next to them . There are lots of people who have bought land in a certain area and like it the way it is . There are people who buy land in areas and check the Zoning Ordinance to find out whats available in that area . A lot of people , if they are going to spend a lot of money , make sure what is in the neighborhood . The closest resident to this sub - division , the house is worth somewheres near $60 , 0000 TWIGGm '?' I see no reason to hold up the applicant , what , five or ten days , 20 days . If it is legal to put in the deed restrictions , in the past there have been approvals contingent on .deed restrictions . I suggest we pass.s,it contingent on deed restric- tions . CECIL TWIGG made the motion the proposed minor sub - division by LESTER BARBER , Champlin Rd . , Town of Groton , be approved in conjunction with Section 202 . 2 of the Town Zoning Ordinance resulting in 3 to 5 lots of�, 41ess than 5 acres , requir khg .-two�-z� a1 submissions by the subdividers on the contention the Planning Board does not consider it needs a public hearing ; NANCY OSTRANDER seconded the motion .- VOTE : All in favor . Motion carried . NANCY OSTRANDER made the motion the application for a Minor Sub- division by LESTER BARBER , Champlin Rd . , Town of Groton , with the deed restrictions heFas asked for ; i . e . no mobile homes will be placedon the lots and the homes built will conform with the market value of those in the area ; MONICA CAREY seconded the motion . VOTE : All in favor . Motion carried . BARBER : I intend to do everything you told me . Is it safe to tell my man to order building supplies and go ahead? TOTMAN : As soon as you return with the survey and it is signed by the Board , he can apply for a Building Permit . REVIEW of Minor Sub- Division application of ANN HORA : The Board has not received the final survey . ANY other business to come before the meeting : no one present to present any other business . PLANNING BOARD -4 - June 17 , c; 1986 TOTMAN0 We had a meeting a month or two agao when we tried to discover discrepancies made in the Ordinance . Tonight we experienced some of the things that are contradictory in the Ordinance . TWIGG : They were not contradictory . TOTMANa We discussed it before , we tried to have a special meeting to talk about changing things and it did not work . Would anybody be adverse 'to 2 or 3 people meeting a couple of times to go over these things and bring them to the Board meeting and discussing them? If you agree , I ' ll get some members of the Board to get together . Board members agreed good idea to go with committee . VERL RANKIN made motion the meeting be adjourned ; NANCY OSTRANDER seconded the motion . All weretin favor , motion carried and meeting was adjourned .
