Special Meeting , .Tuesday , June 10 , 1986

PROPOSED Minor Sub- Division presented by LESTER SMITH , Peru Rd . , Rte 38 ,
Town of Groton .
G . Totman , Chairman , opened the meeting at 8 : 15 p . m .
TOTMAN : This is the map presented by Lester Smith with the dimensions
on it as requested at the Planning Board meeting of May 20 ,
1986 . Presently there is a trailer in Parcel D . Parcel C
has a trailer on it . "
MacCRACKEN : Planning to build on Parcel B . We ' re planning a cellar and
an addition to the trailer on Parcel C .
TOTMAN : Who lives in Parcel D?
ANDERSON : Lester Smith ' s daughter .
TOTMAN : Parcel D creates a problem . There is no problem with the other
parcels as long as the Health Department agrees .
ANDERSON : Probably , as soon as she leaves or whatever , when the trailer
on Parcel D goes , nobody will put another one in there . But ,
C and D are existing trailers . Parcel C will have a cellar
added and an addtion .
TOTMAN : You already have the sewer and water there? *`
MacCRACKEN : Yes .
TOTMAN : If you were putting it in new now , if there was no trailer
already there , you could not do it ;. because of the 150 feet
required by the Health Department . This will be contingent
on the Health Department approval . Since it is already there
they will probably call it grandfathered in . You only have
123 feet on the largest part of the lot . You might have a
problem with the Health Department requirement of 150 feet .
POST : WE can approve or disapprove dependant on the Health Department
approval ?

TOTMAN : I ' m not sure what to do . withv,Parcel D . We are not suppose to
approve lots= so ;blatantly illegal- in size .
ANDERSON : It is going to be there , you already have the headache . It is
not going away just because the Health Department comes and says
so .
CAREY : Owner of Parcel C , if that trailer on Parcel D were removed
would you buy that lot?
MacCRACKEN : That is a possibility .
TOTMAN : Even if buying brand new , the Health Department would not approve
it .
ANDERSON : All this is holding me up . It ' s not like anything different
than what is already there .
TOTMAN : Do you understand all the lots here ( referring to Parcel E ,' and
surrounding area ) are owned by Lester Smith and ?
ANDERSON : Yes .
MacCRACKEN : Yes .
TOTMAN : He ( Smith ) is not selling his larger lot .
POST : We don ' t have a problem with this , contingent on the Health
Department approval . There is enough road frontage .
TOTMAN : The Zoning OFficer ( G . Wood ) does not agree with Parcel C and
D . If you pass a non - conforming lot for one person , then
everybody wants it .
ANDERSON : No matter what you do at this point , unless you get the Health
Department in to condemn style of this lot .
TOTMANa Does the person living on Parcel D ;, own that land?
MacCRACKEN : No , Lester does .
TOTMAN :- Am I safe in assuming , if we pass Parcels C , B and E , and leave
Parcel D as part of Parcel E , je ' wouldipass on then-contingency -
of the approval ' of the Health - Department?
Board in agreement .
TOTMAN : We would eliminate Parcel D , when we vote we would vote on
Parcels A , B , C and E . Lester Smith must initial the plat
and cross off Parcel D .

MIKE POST made the motion the Planning Board approve the proposed
Minor Sub- Division by LESTER SMITH , RTe 38 , Peru Rd . , Town of Groton ,
of Parcels A , B , C and E contingent on the approval of the Tompkins County
Health Department for Parcel C ; M . CAREY seconded the motion .
VOTE : All in favor
Motion carried .
