TOTMAN , chairman , opened the Planning Board meeting at 8 : 00 p . m . Minutes of the April , 1986 meeting were read and approved . PROPOSED Sub- division presented by LESTER SMITH , Peru Rd . - Rt 38 , Town of Groton : TOTMAN : Mr . Smith is applying for a Minor Sub- division on Peru Rd . - Rt 38 , almost to Peruville intersection . He wants to divide lot into two lots . L . SMITH : Make a lot north of the house and south of my house . ( Mr . Smith showed the . .Board the location of the homes on the Tax Map . ) RANKIN : How much road frontage is there? L . SMITH : About half a mile . WOOD : The lines do not come to the road frontage . SMITH : There is a question on the turn off where the old road used to be . Ten years ago it was mine , now the State claims the old road bed . •The State has allowed for the driveway permit . Also had the Health Department there to check it out . Drew Davidson was going to get the survey . G . WOOD : There is no scale on the map . G.. TOTMAN : Did you check with the Town Clerk on what the Ordinance required for copies of the layout? IF we do our job right , we are suppose to have it drawn out into three different parcels . There is no dimensions on the land for the Board to study . G . WOOD : The Health Department r-equires � 6115a foot diameter circle . You can ' t get that in there . There is no way to build on this parcel . ( indicating parcel on drawn diagram ) PLANNING BOARD MEETING - 2- May 20 , 1986 L . SMITH : That trailer has been there for years . I ' m selling the trailer to my kids . Be ANDERSON : That ' s existing lot . The Health Department said there would be no problem . RANKIN : You already have a septic system there? L . SMITH : Yes , for 30 years . We want to move the trailer ahead ,' put a cellar under it and add an additional room to it . G . TOTMAN : The Board has to warn what the Health Department is going to do . They have to approve it before final approval is given . They require 150 foot . . . . . . On• an existing system , there is the possibility they take a different look at it . Anything that we do is contingent on what they do . We can ' t control what they do . L . SMITH : I can ' t see if there is already an existing trailer on a lot why now have to go to different Ordinance because I want to move it ahead . G . WOOD : You don ' t have a Health Department permit for the new lot . The new lot is being created by the sale of property to George . That lot has to conform with the current regulations . Be ANDERSON : You might better do somethig with the land and- , get some taxes out of it than let it sit there . G . WOOD : It would look like you are heading in the right direction . But the surveyor has not come across with the formal drawing yet . Be ANDERSON : Because of the right - a- way question , it is not done yet . . That is not going to make any difference to us as long as we can get the driveway across . G . TOTMAN : We have a book to go by that requires copies of property , dimensions of each lot for sub- division and they are not on that drawing . G . WOOD : How far back did you make the first application? G . MacCRACKEN : April 3 . G . WOOD : We been . . . . . for a month and a half . Be TOTMAN : We have to go by the rules assigned to us by the Town Board , we have to follow the book . Because of the general plan of the Town , if we don ' t we are not doing our duty . You don ' t have the dimensions on the lots . v PLANNING BOARD MEETING - 3- May 20 , 1986 Be ANDERSON : We need to get started on this thing . Gi TOTMAN : It does not appear there is any problem with frontage . The only problem with this property here ( indicating drawing ) is the existing trailer is being moved south , it is keeping the same distance from the road . 1/ : RANKIN : Is it keeping the same septic system? Be ANDERSON : I thought could come with that map tonight . Bruce Davidson is in Watertown , I thought I could get the map from his secretary but she didn ' t know where it was . G . TOTMAN : When you file for a sub- division , it is also a rule which the County has , the copy has to be submitted to the County Clerk . -- also . We don ' t have the proper paperwork tonight . G . WOOD : The County requires a milar or linen copy with embossed stamp on it . G . TOTMAN : The best I can do is , as soon as you get to me with the map , I can call a quorum of the Planning Board and set a Special Meeting to look at the land . We can ' t do anything without the proper paperwork . We can ' t make a decision until we have more information and the proper papers . L . SMITH : When somebody is applying for this stuff , they should get a book to see what we have to have . PROPOSED Minor Sub -division by ANN HORA , Sovocool Hill Rd . , Town of Groton : J . HENRY : I ' m asking the Board ' s indulgence on this . I thought an application for a sub - division had originally been submitted . Since you agreed to consider it tonight , Ann Hors is applying for a Minor Sub- division on Sovocool Hill Rd . property . The main Hora farm , until Joe ' s death , was owned by both of them . Parts of it have been before the Board before . That ' s the situation . Two previous lots are considered , Ann and Joe Hors sold to Mou- and Turco.; then Bogartis , did not have any sub- division aproval both got a situation where other prople than the Horse owned the property . Phil Empson wants to buy a lot from Ann Hora , a minor sub- division approval is required . The farm was originally 90 acres . Mrs . Hora tells me she does not plan to sell off any more lots out of the farm during her lifetime . What we ' re doing at this point is . asking for a Minor Sub- division consisting of two lots previously sold and Phil Empson ' s lot as the third lot then residual 82 acres or so will remain with Mrs . Hora . Looking at the sketch plan from the Tax Map , the problem we have presented before us to be considered tonight , the original sub - division was dealing with smaller parcels . We are just dealing with 3 lots and another 80 some acres , it would cost quite a deal to have a survey . What we would PLANNING BOARD MEETING -4- May 209 1986 i really like to do is just present surveys on Mau and Bogartis tracks , Phill Empson ' s lot is now being done by Milt Greene , I you don ' t and up with a sub - division plat . We would like a plat with the three parcels then note parcel for residual 80+ acres . Can we do that? i G . TOTMAN : On that particular track . of land , the third lot sold? I N . OSTRANDER : There is another one , the Mau place , the trailer then one lot with a driveway is sold but no house has ever been there , then another lot . . . . . just another one up from the trailer where Pierson put in new style house . J . HENRY : The property right beside Mau lot is a complete�'separate 30 acres belonging to the Joe Hora Estate . It is a separate deed , separate tax parcel , separate ownership . It is totally separate entirely . i G . TOTMAN : I ' m sure you read the Ordinance about presenting the right copies . What we call preliminary sketch , if you are at the next meeting with the right layout with the figures on the whole works . . . . What you presented so far , it looks like it could be acceptable , from my estimation . WE can ' t approve it tonight . J . HENRY : We are giving you the preliminary , not a sub - division plat . My concern is we don ' t want to get into a major sub- division . When we present the plat do you want the labeling puton side of lot for the residual acres for form and not have dimensions of forth lot . G . TOTMAN : That would be okay . PROPOSED Rural Sub- division presented by ROGER GLEASON , corner of Old Stage Rd . and Clark St . Ext . , Town of Groton : Be TOTMAN : One question the Board had was on mobile homes being installed on lot that was not big enough . The Ordinance calls for lot an acre of land , individual acres of land unless it is a park . The people proposing to buy the lot were going to put two trailers on it , even though there is enough acres it was not separate , which would require formation of a park or separate land amounts . I understand , between then and now , it has been determined by the seller that the stipulation will be in the deeds that no mobile homes will be allowed on the lots . We are to make decision tonight on the proposal before us presented at the last meeting for a Rural Sub - division noting that restriction . N . OSTRANDER : Does that restriction stay with the property when it changes hands? i PLANNING BOARD MEETING - S - May 20 , 1986 G . TOTMAN : Yes . , Roger , did I state that correctly? R . GLEASON : The people that are going to buy the lot are in agreement with that . N . OSTRANDER : Did Colleen get all the information together for us? G . TOTMAN No , not yet . VERL RANKIN made the motion the Planning Board accept the Rural Sub-division presented by ROGER GLEASON located on Old > Stage Rd . and Clark St . Ext . with the restrictions ; NANCY OSTRANDER seconded the motion . Tax Map No . 121 - 1 - 2 . 2 �" VOTE : All in favor Motion carried Application for BUILDING PERMIT presented by GARY and ELLEN CORNEL'IUS for property on Old Stage Rd . : directed to Gary Wood Application for SPECIAL PERMIT presented by NANCY OSTRANDER , Devlin Rd. , Town of Groton for Sharpening Service to be operated in home basement . Classified under Section 351 Sub• 141 . 4 : Secondary Residential Activity , Home Occupation ; Repair Service MIKE POST made the motion the Board suggest to Gary Wood he issue a Zoning Permit to NANCY OSTRANDER for above application ; MONICA CAREY seconded the motion . VOTE : All in favor Motion carried G . TOTMAN : Is it agreeable with the Board when SMITH submits Plat the Board get a quorum together and meet with them before the next meeting? Board members agreed . G . TOTMAN : Also , if J . HENRY gets the plat ready by the SMITH meeting , we consider that one too? Board members agreed . G . WOOD : Would you like me to call the Health Department on the Smith property? G . TOMAN : Yes , Planning Board meeting was adjourned ; next regular meeting will be the third Tuesday in June , 6/ 17/86 , at 8 : 00 p . m . Respectfully submitted
