Proposal for Site Plan Review to build addition on home of JAMES
JENSEN , Chipmans Corners Rd . , Town of Groton .
WOOD : Mr . Jensen applied for a Buildig Permit to add to his home which
is used as a boarding home to comply with the requirements of the
Department of Social Services in Albany . It is a matter of not
being able to use some of the roomes now because of ceiling height
problem he has to take rooms he, is now using out of. service and
build an addition .
JENSEN : I put on an addition some years ago and the ceiling is not as high
as 8 foot . The new part of , the house has only 7 foot• ceiling .
Albany decided to enforce rule that the ceiling had to be 8 foot .
We could either . comply or, they would try -for a . waiver , They were
talking about moving the children . . I expect to . put anti 8 by 24
with 8 foot ceilings on the back .
TOTMAN : Gary , you have looked . it over ?
WOOD : I have not yet .
TOTMANs Does it . comply with the side lot; how far from edge of boundary?
JENSEN : 400 feet .
WOOD : I would like to ask Mr . Jensen a few questions . . What are the
ages of the children you keep .
JENSEN : Social Services class them as retarded ; two are in wheelchairs ;
ages 2 to 9 ; the older child is 20 .
WOOD : Is this your sole source of income ?
JENSEN : No .
WOOD : You also operate a garage on the property?
JENSEN : Yes ,
TOTMAN : What would you classify property ?

WOOD : A boarding house .
TOTMAN : If there is no -side lot problem and your meeting the State require -
ments and meeting Gary ' s standards as building inspector we can
procede . Are there any questions. or comments ?
TWIGG : This does not require any parking ?
JENSEN : No .
McNELLe. I make the motion we use the short procedure for the addition on
the dwelling of JAMES JENSEN on Chipmans Corners Rd .
OSTRANDER * I section the motion
VOTE : all in favor ; motion carried .
TWIGG : I make the motion that the Board approve the application of JAMES
JENSEN for an addition to the dwelling on Chipmans Corners Rd . ,
Town of Groton .
McNEIL : I second the motion .
VOTE : all in favor_; motion carried .
Discussion of Max Barber sub-division on the Brown Road , Town of Groton :
NESBITT : I own adjacent land on Brown -Rd . and would like to know what is
going on there . I_' understood . the land was -. , to be divided into
four lots . There . is possibly six ,going ' in • there now . I would like
to . know what the original development called for. * it ' 16 being divided
and people are buying the land and it is more than four lots .
You approved 4 lots and the . County Health Department only approved
4 ;. something to do with the sewage and drainage .
WOOD : The trailer put in this fall did have a sewage treament designed
by the County Health . Department .
TOTMAN : We will find the original ' Sub-division proposal and approval
and get back to you on it .

POST : You are moving all the business from Peruville Rd '. ?
PLUNKETT : All the TV related business .
TOTMAN : Moving a Commercial activity from an Agricutural Ds .trict .

OSTRANDER ** I make the motion the Board use the short form Site Plan Review ,
TWIGG I second the motion .
VOTE : All in favor ; motion

OSTRANDER : If they stopped business as a TV repair ship for a ' certain period
of time and another person bought the property , they would need
another permit ?
TOTMAN : Yes . It is not changing any of . the. District .
TWIGG : Anything other than the TV business requires another permit :
PLUNKETT : /Something related to the TV business , like satalite antennas ,
microwave ovens , stereos , be covered wish this permit ?
TOTMAIV : Yes , the application is for a TV and Appliance shop .
WOOD : If he wanted to add ' on to the bulding for the same use , then he
requires another Site Plan Review?
TOTMAN : Any addition requires the Site Plan Review ,
OSTRANDER : The building is okay as fat- as the . Uniform Fire and Building Code
is concerned ?
WOOD : ' Compliance is , in progress . There ' is adequate parking .
TWIGG : I make the motion the Board approve, the Site Plan Review application
for a TV and Appliance Shop on the corner of Route 222 and Salt Rd .

WOOD : Shortly after I took over this job I went to Mr . WkBriens . Since
then I have been trying to get him to come and face the Planning
Board . You know what he has going up there . At one time he
promised me he would get the junkpcats out of - there this summer .

TOTMAN : This request on same ground the other autos laying around the yard ?
What you are saying to the Planning Board is you have been dealing
with Mr . O ' Brien., getting him to comply with the junkyard ordinance
and you have not been successful yet ?
WOOD : He is looking for the Planning . Board ' s approval for a Motor Vehicle
Repair Shop business with the stipulation that the junk would go ;
the junk is not gone yet . . I have cited him on both points now .
OSTRANDER : I am pleased to see he is trying to do this much .

WOOD : He only did it to get himself off the violation hook .
OSTRANDER0 . The grren sign is authorized by - ' the State .
WOOD : I understand he needs a permit . by the local authorities before
they would issue it . The State requires approval by the locality
first .
POST : Is .there pending litigation on the junkyard ?
WOOD : Thata is going before the ZBA . As soon as he received violation
letter he called . I told him that I had said several times to fill
out application and he did not do it . He said ' you were going
to mail me an . application ' . ..
'OSTRANDER : How many times did you tell him to ' get the application?
WOOD : 3 or 4 times .
TOTMAN : Is he familiar with the Ordinance ?
WOOD ': I don ' t know if he has read it . I `. amr '=:; reasonably sure he
knows it requires a Public Hearing by the Town . Board on the
junkyard .
McNEIL : Is he making any, attempt to cleanup ?
WOOD : No . Could you table that application pending the decision by
the . ZBA or would that be delaying it ?
TOTMAN You have 2 ' problems . here . Number one , I think he should be given
a copy of the Section of the Ordinance so he knows what has to
happen ; then , if he complies with that and comes to the Planning
Board meeting with the sketches and other requirements called
for in Section 440 and we follow the book ; r:: after he makes violation
corrections with the Zoning Officer and the ZBA . We cannot act
upon this while he has a case pending in front of the ZBA .
GLEASON ,* As soon as he complies with + the Zoning Officer and the ZBA he
returns to the ' Planning Board and follows Section 440 procedure:,.
He must get the application - to the . Board ' ten days before the
meeting which is the third Tuesday of the month .

GLEASON's He has not followed the proper procedure . He should be sent a
letter stating what he has to do before we will consider it ,
TWIGG -If he put in a Motor Vehicle - Repair Shop he is not in compliance
with the Motor Vehicle Ordinance .
WOOD There is no . section . entitled ' Motor Vehicle Ordinance ' . If there
is a request for . 'a - Motor• Vehicle Repair Shop they would come
before the Planning Board . In other .sections it talks about signs
and parking , and such * but there, is no special section on motor
vehicle repair shop .,
I will contact Mr . O ' Brien and tell'` him the Planning Board could
not act on his application until he complies with the request turned
down on the junkyard ordinance ; and I will get a copy of Section
440 , Site Plan Review procedure to him .
GLEASON : I will make the motion to defer the application of SHERRY O ' BRIEN
for a Motor Vehicle Repair Shop on Sharpps;teen Rd . , Town of Groton ,
until he complies -with the junkyard violation. pending with the ZBA .
McNEIL : I second the motion . '
VOTE : All in favor ; motion
carried .
WOOD : Explain . to me how to handle the time on the applications . I
take them in to Colleen withiniten° . days , ' As that the deadline ?
TOTMAN : . The way it is worded in the Ordinance is the application has
to be to the Secretary of the . Planning Board ten days prior to the
meeting . so the .members can become familiar with it .
McNEIL : I make the motion the meeting be adjourned .
POST I second the motion .

The next regular meeting of the Town of Groton Planning Board will be
Tuesday , January 150 1985 .
