Part I - Project and Setting
Instructions for Completing Part 1
Part 1 is to be completed by the applicant or project sponsor. Responses become part of the application for approval or funding,
are subject to public review, and may be subject to further verification.
Complete Part 1 based on information currently available. If additional research or investigation would be needed to fully respond to
any item, please answer as thoroughly as possible based on current information; indicate whether missing information does not exist,
or is not reasonably available to the sponsor; and, when possible, generally describe work or studies which would be necessary to
update or fully develop that information.
Applicants/sponsors must complete all items in Sections A & B. In Sections C, D & E, most items contain an initial question that
must be answered either "Yes" or "No". If the answer to the initial question is "Yes", complete the sub -questions that follow. If the
answer to the initial question is "No", proceed to the next question. Section F allows the project sponsor to identify and attach any
additional information. Section G requires the name and signature of the applicant or project sponsor to verify that the information
contained in Part lis accurate and complete.

Brief Description of Proposed Action (include purpose or need):
Abundant Solar Power (Groton), LLC plans to install a 5.0 MW -AC solar farm on approximately 40.3 -acres of vacant farmland (tax parcel ID: 20.-1-31.22),
located Cortland Road in the Town of Groton. The 37.1 -acre project area will consist of about 2,254 free-standing, tracking solar tables (total of 27,048
modules/panels) to be installed on vacant farmland. Anchored into the ground via H -piles, each row of solar tables will be about 8.1 ft. in height, 6.5 ft. in
width and of variable length. The solar panels will occupy approximately 28.5 acres of the project site and the ground disturbance will be limited to about
15.3 acres. Low -growth pollinator -friendly seed mix will be planted underneath and in between the solar tables. For utility connection, both underground
and overhead electrical lines will be installed as required by the utility company. Other project elements include: 25 -ft. rear and side setbacks, 30 -ft. front
setback, agricultural fencing, security gate, small operational & control structures, and mostly unimproved access roads. Abundant Solar Power (Groton),
LLC will participate in the NYSERDA NY -Sun Initiative to provide clean energy to local businesses and residences.

Dear Ms. Vitulano:
The New York State Department of Environmental Conservation (NYSDEC) is in receipt of
your August 23, 2019 email requesting a jurisdictional determination for the Abundant Solar
Power's proposed 5.0 MW -AC solar array project on 40.2 acres of vacant farmland located
at 704 Cortland Road in the Town of Groton.
Based on the information you provided in your August 23, 2019 email, it has been determined
that no NYSDEC Permits for Protection of Streams, Navigable Waters, Freshwater Wetlands,
or Protected Species will be required to perform this project. However, please keep in mind
that there are NYS Water Quality Standards that must be maintained at all times during
construction of this project and every effort should be made to control any erosion, siltation
and pollution to all waterbodies and wetlands.
Soil disturbance of one or more acres of land from construction activities must obtain permit
coverage under the NYSDEC SPDES General Permit for Stormwater Discharges from
Construction Activities by submitting a Notice of Intent and developing and implementing a
Stormwater Pollution Prevention Plan. For further information see the NYSDEC Stormwater
web page at www.dec.nv.ciov/chemical/8468.htmI. You may also contact Julie Melancon with
our NYSDEC Division of Water at 315-426-7550.
The parcel lies within Agricultural District TOMPQ01. Lands that are under the protection of
NYS Agricultural District Law, are administered by the New York State Department of
Agriculture and Markets. Farmers interested in adding land or removing land from a locally
approved, state certified Agricultural District should start by contacting their county planning
representative. Under SEAR, the Lead Agency must take into consideration that a project is
in an Ag District, when determining if the project will be a Type I or Unlisted Action.
