HomeMy WebLinkAboutMilitary Roll 1854TO THE ASSESSORS OF THS STATE. By the law of this State it is made the duty of the Adjutant -General to prepare rolls in such form and style, accompanied by instructions, as will enable the assessors to make a perfect and complete enrollment of all the militia residing within their respective towns and wards, and to contain a statement of such other facts, connected therewith, as may be necessary to enable the Adjutant -General in his annual reports to faithfully comply with the laws of Congress and the requisitions of the War Department at Washington. It is very desirable that the enrollment shall be full and complete, in order that we may receive for this State, from the United States, the annnal quota of arms and equipments to which we are fairly entitled, by virtue of a law of Congress, passed April 23d, 1808. In consequence of defective enrollments heretofore, great losses have been sustained in this respect. The enrollment being by law entrusted to civil officers, they are called upon, by every con- sideration of duty, faithfully to discharge the trust. The reports made to this department since the enrollment was entrusted to assessors, whilst they in many cases exhibit a strict compliance with the law, in many other cases they show ,gross carelessness, and sometimes willful neglect of duty. The assessors will notice, at the head of each column on the roll, the facts they are required to note respecting each person enrolled, giving the particular section of the statute governing each case. All persons subject to enrollment, claiming exemption from the commutation, must show their written vouchers, or, when their papers are lost, make affidavit to the facts on which exemp- tion is claimed. Assessors ought to prepare themselves with blank affidavits, so as to be in readiness at all times to administer the proper oath when called upon, and whilst taking the assessment. Subscribed and sworn to before me, this day of 1854. 13.ssessor." When any person is excused from payment of commutation, on his own oath, the fact should be noted in the column of " Remarks." Assessors will, at the time they post up the notices of the day or days on which they will meet to hear appeals from the assessment of ' taxes, also give notice in like manner that they will, at the same times and places, hear the excuses of persons claiming exemption from enroll- ment and the payment of the commutation of fifty cents in lieu of the performance of military duty. This will lessen the expense of the towns, and greatly add to the convenience of all. Assessors will observe that it is not their duty to enroll any persons who they know to be under 18 or over 45 years of age; and they also will strictly observe not to enroll any persons between those ages who are physically unable to perform military duty. The loss of a finger, toe., or a scar from a cut or wound, which does not prevent the free use and exercise of the limbs, is not a sufficient excuse from enrollment, as supposed by some; neither should an occasional attack of rheumatism excuse him, any more than occasional tooth- ache or headache. Whenever the non-commissioned officers of any company of infantry shall, in addition *Meersofhi- to the equipments required by law, uniform and equip themselves in the manner following, that tor beex'mptn. is to say : With an infantry ca.p, or with the plate and feather heretofore in use in the city of New -York; a tight bodied blue coat, with yellow or white metal buttons; a white vest and pantaloons, and black gaiters or half -boots; and shall parade, so uniformed and equipped, for the space of seven years then next following, sickness or unavoidable accidents or absence excepted, at all the parades directed by law; and shall also perform all such military duties as may be lawfully required of them ; such non-commissioned officers shall, from thenceforth, be excused from military duty, except in cases of insurrection or invasion, or except when called into actual service. Certifieate to � 2. Whenever the non-commissioned officers of any such company shall appear upon parade, be given. so uniformed and equipped, the commandant of the company shall deliver to every non-com- missioned officer belonging to such company, and so appearing at such parade, a certificate in writing, stating that the person therein named is uniformed and equipped in the manner men- tioned in the preceding section, and has so appeared upon parade. Such certificate shall also state that if the person therein named shall continue to appear at all the parades required by the preceding section, for the space- of seven years then next following, sickness and unavoid- able accidents or absence excepted, and if he shall perform all such military duties as may be, lawfully required of him, that then he shall from thenceforth be excused from military duty, as above mentioned. Endorse- 3. The commandant of the company shall, at the last parade in every year, or as soon meet tobe thereon. thereafter as may be convenient, endorse upon such certificate that the person therein named has paraded, in conformity to the first section of this Title (if such be the fact, and not other- wise); and such certificate shall, at the expiration of the said seven years, be countersigned by the commanding officer of the regiment, and be conclusive evidence of the services therein mentioned. The assessors, chosen in each city, village, town or ward, shall annually, between the Enrollment. first days of May and July in each year, make out a roll which shall contain the names of all persons in their respective assessment districts, between the ages of eighteen and forty-five years, liable to be enrolled by the laws of the United States, arranged alphabetically. 4. It shall be the duty of the adjutant -general to prepare a roll, in such style and form as Adjutant - General to he shall deem most convenient and proper for the use of the assessors; and in addition to the prepare names, as herein directed, the assessors shall take and set down in separate columns, to be roll. designated on said roll, opposite to each name, such further information as the adjutant -general may deem important and requisite to comply with the law of Congress. 5. The adjutant -general shall attach to said roll such instructions as shall enable the Adjutant - General to assessors to carry out the provisions of this act; and on or before the 20th day of April, In preparein- each and every year, he shall furnish to the supervisors of each city, village, town or ward in structions. this state, sufficient numbers of said roll, so prepared as aforesaid, to enable the said assessors of the towns, villages, cities or wards to carry out the provisions of this act. The supervisors shall deliver the said rolls to the assessors, immediately on receiving the same from the adj utant-general. G. The assessors shall sign the copy hereby required by the 12th section to be delivered, 8 ssess rs hall make And shall attach thereto an affidavit substantially as follows: _ affidavit. «The undersigned, assessors of the town of in the county of being severally sworn, say that they have made strict and diligent inquiry to ascertain the names of all persons required to be enrolled, as liable to military duty, by the laws of the United States, residing in said town, village or ward of that the roll hereto annexed is, as near as these deponents can ascertain, a correct roll of all persons residing in said town or ward who are liable to be enrolled." The said affidavit may be taken before any officer authorized by law to take affida- vits, whose duty it shall be to take the same without fee or reward, 7. All tavern keepers, keepers of boarding houses, persons having boarders. in their families, Duty oftav- ern keepers, and every master and mistress of any dwelling house, and plead of quaker or shaker societies or &c. communities, shall, upon the application of any assessor, give information of the names of all persons residing or lodging in such house, or belonging to such society or community, and liable to be enrolled, and all other proper information concerning such persons as such assessor may demand. 8. If any person, of whom information is required by any assessor in order to enable him P n tyfor to comply with the provisions of this act, shall refuse to give such information, or shall give information. false information, he shall forfeit and pay ten dollars for each item of information demanded of him by any assessor and falsely stated ; and the like sum for each individual name that may be refused, concealed or falsely stated; and every person who shall refuse to give his own name and proper information when applied to by any assessor, or shall give a false name or informa- tion, shall forfeit and pay a like sum, to be recovered in any court of competent jurisdiction in the name of the commanding officer of the regiment; and it is hereby made the duty of the assessors to report the names of all persons who may incur the penalty in this section pre- scribed, to the commandant of the company district in which they reside. � 9. As soon as the roll is completed, the assessors shall forthwith cause notices thereof to rollmeenotfen. be put up in three of the most public places in the village, city, town or ward, which notices shall set forth that the assessors have made their roll of all persons liable to be enrolled accord- ing to the laws of the United States, and that a copy thereof is left with one of their number to be designated in such notice, at some place to be specified therein, where the same may be seen and examined by any person interested therein during twenty days; the assessor with whom such roll is left shall submit the same, during the twenty days specified in such notice, to the inspection of all persons who shall apply for that purpose. 10. Any person whose name appears on the said roll, and who claims that he is not liable Affidavit to to military duty on account of some physical defect or bodily infirmity, or that he is exempt hers nee by to from the performance of military duty by any law of this state or of the United States, may, beexe aimipt. within the said twenty days, and not after, file with the assessor having such roll an affidavit stating such facts on which he claims to be exempt or not liable to do military duty. Such affidavit may be made before the assessors, or one of them, either of whom is hereby authorized "to administer an oath for that purpose, and the assessors shall cause all such affidavits to be filed in the office of the city, village, or town clerk; and if any person shall swear falsely in such affidavit, he shall be guilty of perjury. 11. On some day or days after, in the first week in August, the assessors shall meet and Asses Ile to determine who are exempt or not liable to do military duty; and in a column prepared for that who ate purpose in such roll, opposite the name of each person not exempt, shall insert <<fifty cents;" exempt. 4 Assessors to 12. When the said roll shall be completed, as aforesaid, the said assessor shall r� oke one eopyof the fair copy thereof, and shall sign it, and attach thereto an affidavit, as hereinbefore provided, ri11' which copy shall be delivered to the supervisor of the town or ward, with the assessment roll of the town or ward, who shall deliver the same to the board of supervisors at their next annual meeting, and it shall be called the I military roll of such town or ward." To use forms 13. The assessors, in the execution of their duties, shall use the forms and pursue the &e., sent by Ad'jt-Gen'►. instructions which shall from time to time be transmitted to them by the adjutant -general. neglect orr . 14. If any assessor shall refuse or neglect to perform any of the duties required of him by refusal. this act, he shall forfeit and pay the sum of not less than ten nor more than fitty dollars, to be recovered in the name of the commanding officer of the regiment within the bounds of which he resides; and if any assessor shall willfully neglect or refuse to perform such duties as hereby required, lie shall be deemed guilty of a misdemeanor. If any assessor shall neglect or from any cause omit to perform his duties, the other sors to per- form duties assessors, or either of them, of the city, village, town or ward, shall perform such duties, and omitted shall certify to the commandant of the company district, with their roll, the name of such delinquent assessor, stating the cause of such omission. boardDuty r 3 16. The board of supervisors of each county in this state, at their annual meeting, shall supervisors. cause the military roll of every city, village, town or ward, to be compared with the assessment roll of the same city, village. town or ward; and all names on the said military roll liable to pay the said commutation of fifty cents, shall be transferred to the corrected assessment roll of the same city, village, town or ward ; and in a column, to be provided for that purpose in the said corrected assessment roll, shall be set opposite the name of every person so liable to pay such commutation the sum of fifty cents; and if' the person shall be assessed for real or per- sonal property on such assessment roll, the said sum of fifty cents shall be added to the other tax against the same person. Mode of cul- 17. The said sum of fifty cents, against every person who shall appear by the said assess- leul-ment roll liable to pay the same, shall be collected at the same time and in the same manner as other taxes are collected in the said county. And the warrants, annexed by the supervisors to the assessment rolls of the several towns and wards, shall direct the collector to collect the said sum of fifty cents, from every person appearing by the said assessment roll liable to pay the same, in the same manner as other taxes are collected, and to pay the same to the county treasurer. And where the name of any person between the ages of eighteen and twenty-one years shall appear on the said roll, liable to pay the said commutation, the said warrant shall direct the collector to collect the sante of the hither, master or guardian with whom such person shall reside, or out of any property such minor may have in the city, village, town or ward. The fund so created shall be applied exclusively to,niilitary purposes, for the benefit taryfUnd. of'ethe militia of said county; except that the town or ward shall receive from said funds the sum of three cents for each person, enrolled and liable to do military duty in such town or ward, who shall pay his commutation tax, to be paid by the county treasurer, out of the said fund, to the supervisor of the town, ward or city, and to be applied to the contingent expenses of said town, ward or city. The board of supervisors of each county shall determine the number of persons for which pay shalt be allowed to such town, ward or city, underthis section,. No money 23. After the said enrollment is completed, as herein directed, it shall be the duty of commandants of company districts, annually thereafter, carefully to correct their rolls, from the lists furnished by the assessors, as herein provided; all persons whose names appear in said enrollment shall be regarded as legally and properly enrolled, and the notice given by the assessors, as prescribed in section nine of this act, shall be a sufficient notice of such enrollment. If the name of any person, liable to be enrolled, shall have been omitted by the assessors, the commandant of the company district shall add such name to his roll, and notify the person thereof, and also the assessor of his district.
