TOWN OF GROTON PLANNING BOARD Tuesday , February 1 , 1983 PUBLIC HEARING George Totman; Chairman Others present : Lyle Raymond* Fred Tanner Roger Gleason* Jim MacNeil Cecil Twigg* Nancy Ostrander * Don Payne ( *denotes present ) Chairman , George Totman , opened the Public Hearing by reading the Legal Notice Dated January 17 , 1983 attached . G . Totman : Normally at a Public Hearing there is some contro - versy . Obviously there is no controversy because the Town is abandoning a road , giving the land back to property owners . At this point we ask those of you attending for any Icomments for or against the proposal . F . Tanner : I don ' t have anything against it , I ' m all in favor of it . G. Totman : The reason we go this route , by the nature of the New York State law , according to the Town Attorney , for making any chage the Town Board refers it to the Planning Board ; the. Planning Board makes a recommendation to the Town Board ; After this hearing we meet , we draft a letter , send it to the Town Board with comments . F . Tanner : I wanted to keep myself informed on what was gaoing on . I thought maybe there would be two or three more people here . PUBLIC HEARING _2 _ February 1 , 1983 G . Totman : From this point we will get a letter to The Town Board , they meet next Tuesday night , that is when they will take action , because they want to get it off the books . F . Totman : *uld the tb rd Tuesday of every month be okay for our regular meetings . `Ve have to start working on the Official Zoning Map . Bring it up to datRas far as new ordinances going in . 'We ' ve talked of it a lot but never done anything officially about it . The Town Attorney thinks we ought to update it and bring it into focus on subdivisions . I hope he will meet with us and give direction on what avenues to take to make it more compatable with the County . L . Raymond : Is there any particular problem ? G . Totman : No , basically he looked it over ; he is quite familiar with planning and zoning ordinance ; and he very quickly decided , after looking at outs , that it ' s copied verbatum from the State ' s suggestions of subdivisions regulations . It does not specify the area your from ; very general : ordinance . He suggests we bring into focus to a small town . L . Raymond : He has specific parts to be considered ? G . Totman : I think so . L . Raymond : Has the Town Board discussed this ? G . Totman : Teresa was . at ':the meeting . She was in agreement with decision to go over various changes that • . _2_ Gary Evans suggested in the total ordinance and he thinks subdivision should be on of the things worked on . From out last meeting of April. and in the Fall Teresa got with Gary and went over it . Gary read it over again ; Gary and the lawyer met ; then we met one morning just to go over the fine details . Basically the only change is the coding , making references to certain things easier and a few parts of the sentences made better to understand . From that Gary stated at that time we would have/EoyThe first - of the year . The County Planning Board was buying a computer which would be able to print it in booklet form that all members of Boards would have a copy of the ordinances . Once they got the copy the Town .Board would act on it . I thought it would be here by this meeting but it ' s not . I think we should have it very soon . If we hold out next meeting in March the Town Board would have brought it up by then . Then we can plan on having meetings from then on every third Tuesday . ALL PRESENT DECIDED THE THIRD TUESDAY OF THE MONTH SPAS A GOOD MEETING TIME . G . Totman : We need to approve the minutes of the last meeting . Has everybody read them ? L . Raymond : I move we approve the minutes of the April , 1982 meeting . N . Ostrander : I second the motion . ALL WERE IN FAVOR , MOTION CARRIED , G . Totman : The purpose that Fred is here is to answer the call for the Public Hearing , e will adjourn our meeting until after the Public Hearing . axd G . Totman ; 14e.811 now reconvene the Board meeting and make a decision what to do with the abandoned road . .Are you all familiar where the road is ? C . Twigg : Pretty much . (looking at the map ) Is this the place right here ? Is this Munson ' s here ? N . Ostrander ; The antique store . G. Totman : The fire station is down here . This is Glenn Munson ' s property; the fellow that was here owns this property ; this property is Fred Ballard ' s . To get it in perspective , this is where I live ; this little property owned by guy with school bus . This road being abandoned has notbeen used for over 20 years . The stated six years in the notice was stated by law. *bn I moved there 25 years ago it was very seldom used . Since then , as my children remember and they are both married now , . that was all lawn . You would never know it was a road . The Town , until they take it off the rolls , officially abandon it , is responsible for it . If somebody looked at that map and drove down the road and got stuck , the town would be responsible . It ' s to their benefit to do something now . In years gone by , that was the official road . The other road did not exist . lie have to draft a letter to the Board as to our feelings . C . ' Twigg : I recommend that we4abandon it . L . Raymond : We are not abandoning the ownership , just the public use of that part of the property that has been taken for public use . What we are abandoning is the fact that they have to give that part of property to public use . Most deeds go to the middle of the road . That is not purchased property . That is given to public use by requirement in the name of public good for transportation . Technically we are abandoning that requirement of those property owners . N . Ostrander : Also abandoning requirement of Town to main- tain it . C . Twigg : It will give those people peace of mind to know that somebody is not going to come in and reopen that road or they can build something without the ordinance of being so far . back from that road . L . Raymond : Technically , somebody could purchase a lot there and put it back in busines by having the street by their place . N . Ostrander : There is no lot there . Can ' t buy the strip . G . Totman : The motion reads : ' Cecil Twigg moved recommend to the Town Board that the road extending from County Road #180 , Church Street , in a general southerly or southwesterly direction to County Road #104 , Stevens Road , in McLean , New York , bounded on the north by Tanner and Ballard and on the south by Hill , Munson and Daviddon , be officially abandoned by the Town of Groton ' . Seconded by Lyle Raymond , C . Twigg : 'What effect on these proper owners , will it change their frontage a lot . There is none of those in danger ? G . Totman : No one property really affected . Munson is hardly affected at all , just make his property to a point : The Hill property mentioned in this is the property No . 1 , is. not big enough to do any- thing with ; just going to add 20 fee which gives it 80 foot frontage . Hallards adds nothing to road frontage . This Tanner , in NO . 9 gives him 20 more up through land . But what it does is Tanner made a deal with No . 1 to buy piece of land - 5- once the road was taken car of . No . 9 will own and 1 . That is probably why he is interested . His driveway goes up that roadway . Before that road was abandoned he drove off the road into his residence . MOTION WAS PASSED , G . Totman ; The only thing that will cost money , Mr . Fitzgerald suggested we suggest to the property owners that they use the same attorney to have their abstracts and deeds brought up to date , which could be expensive . I don ' t know if it is necessary because you are not borrowing any money . ; not really having a money transaction . If they want to sell land they have to have an abstract brought up to date . R . Gleason : They have to do it any way . G . Totman : Mr . Fitzgerald suggested do it now but soomer or later it will be brought up to date . . C . Twigg : N Now are these people deeds going to read with that raod in there ? L . Raymond ; That will have to be changed . C . Twigg ; Your ' re not going to change their deeds ? G . Totman : It is up to the property owner . C . Twigg : When somebody buys property , to bring the abstract up to date , how are they going - to know it is abandoned ? L . Raymond ; That is one of the responsibilities of the attorney . G. Totman ; Each ,year the Tax Map is brought up to date . Normally when anybody borrows money the attorney gets a copy of the Tax Map ; that road will be taken off that map . When they survey the property they find they have 20 more feet than they had before . L . Raymond : , The easment will be removed for public use . G . Totman : The new Tax Map will be relined . R . Gleason : The public easement will be removed is all . G . Totman : When we meet in March nakXcxxt the Town Board will have met twice and if they can ' t pass+Ae first meeting , hopefully by the March meeting they will have had the other public hearings necessary; other than that I don ' t think there are any other problems . CO Twigg : What affect would a public hearing have on it ? G . Totman : Just let people know what it is . C . Twigg : Can anything be changed ? R . Gleason : Unless somebody comes up with any strong objections . G . Totman : We ' ll start working on official manual * have the Town Attorney at the March meeting , for the sub- division problems . N . Ostrander : Figure out new order to find sections easier . - G . Totman : Yes , corrected the coding . Gary Evans of County Planning Office updated the book ; he is suppose to reprint whole book ; should have in our hands next meeting . I have been to all the Hearings Zoning Board of Appeals have had to help explain parts of the ordinance . I also , during the absense of Bob Brown acted as Zoning Enforcement Officer , by request of the Town Board . I attended four meetings it the past year of the New York State Planning Federation . They meet usually 3 days in the Catskills . I was elected to the New York State Board of Directors on Zoning which meet four times a . year . Basically , if you go to all the meetings that I went to all last three ,years , you don ' t really pick up much . They ' re pretty much repetitive . They use the same speakers from the State What I find helpful going to them is wKftuxKutx#st not just the meetings but meeting other people from other parts of the State . We find our problems the same all through the State . One of which is Town Boards not acting as fast as we think they should . R . Gleason : We are going to get into subdivisions next time ? G. Totman : In March , staring in March I think probably want to do in large extent is break up in sections instead of doingthe whole thing in meetings , to bring up to date . R . Gleason : I understand Dryden brough theirs up to date they have some things incorporated in- that there is something to look at on , for instance large lot division , which really arn ' t lots so you don ' t have to get into subdivision . G . Totman : Fitzgerald though ours a little restrictive on that . I ' ll get a copy of theirs and go over it for our next meeting . Then get Fitzgerald here to help decide our problem . R . Gleason : In last Planning Newsletter there was something about this from the Federation . L . Raymond : I ' ll make the motion we adjourn . R . Gleason : Second the motion Meeting adjourned .
